Lexington Board of Health Meeting, November 18, 2009 at 7:00 p.m.

Heiger-Bernays called to order at 7:00 p.m.
The Board reviewed the minutes of October 7, 2009. Perlmutter motioned to accept the
minutes with corrections. MacKenzie seconded. All approved.
The Board reviewed the Community Health Report.
Environmental Health Report
Dabin Update – Cody advised the Board that as a result of a recent inspection, Dabins
was issued an order to correct and there were several deficiencies with the food code
including but not limited to the HACCP plan for Sushi was not being followed. Maureen
Lee was hired by Dabins as a result of the Board’s decision that Dabins hire a food
consultant. Lee updated the Board of the steps being taken for Dabins to be in
compliance with the food code. The hearing will be continued at the December meeting.
Khushboo Hearing – Cody advised the Board that during a routine food inspection on
June 10, 2009, 10 critical and 21 non-critical violations were found. An order to correct
was issued and on June 30, 2009 all violations were corrected. On November 7, 2009, an
inspection took place at Khushboo by Stephanie Scogland and there were 8 critical and
10 non-critical violations of the food code. Many of the violations were repeat violations.
In reviewing the Khushboo file, Cody discovered a pattern of repeat violations. After a
discussion, Perlmutter motioned that due to the number and type of violations that have
been observed during the last two food inspections, it is the opinion of this Board that a
food consultant has been listed with the Department of Public Health Food Protection
Program as an approved trainer be hired by Khushboo to review your compliance history
with the Board of Health and create an action plan to keep you in compliance with the
Food Code. Mr. Cody, Health Director for the Lexington Health Division will provide
you with further details on the scope and objectives of this food consultant. You are
required to attend the December 9, 2009, Board of Health meeting to provide an update
with your progress with this matter. MacKenzie seconded. All approved.
Wilson Farms Hearing – Cody advised the Board that during a routine food inspection at
Wilson Farm by Stephanie Scogland, Food Consultant and Kathy Fox, Health Agent, 10
critical and 27 non-critical food code violations were found. On September 22, 2009, the
Health Division received a letter from Mr. Scott Wilson of Wilson Farm, Inc., describing
a list or work in progress. On October 14, 2009, at an unannounced food re-inspection, 7
critical and 9 non-critical food code violations were documented on site which included
repeat violations and new violations in the kitchen, meat room, general produce area and
the bakery.
As a result of these inspections, Scott Wilson was asked to appear before the Board along
with Ken Ford, David Bannister and Mark Servano who all have Servesafe certifications.
Mr. Wilson updated the Board on steps taken to be incompliance with the Food Code.
Wilson’s has hired a professional cleaning company for daily cleaning. According to Mr.
Wilson, Ken Ford had prepared a revised HACCP for the vacuum packed meats.
A consultant from the University of Massachusetts has been hired to train 3 employees to
be HACCP certified. Cody advised Mr. Wilson that the HACCP needs to be approved by
the Health Division. David Bannister is acting as the daily health inspector for each
department. Heiger-Bernays motioned to continue with the work being done and
depending on the results of the next unannounced inspection will determine what will
happen next. Also, Dr. Niachova from Univ. of Mass should get in touch with Mr. Cody.
MacKenzie seconded. All approved.
New Establishment/Plan Review – Sweet Thyme Bakery, Mr. Wai-Ip Chan, Owner
Mr. Cody advised the Board that Mr. Chan went through the food plan process and they
are up and running. Perlmutter motioned that the Lexington Board of Health
conditionally approves of the issuance of an annual permit to operate Sweet Thyme
Bakery at 1837 Massachusetts Avenue. MacKenzie seconded. All approved.
Housing Code Compliance Program Update
32 Fairbanks Update –. Mr. Reutter updated the Board regarding the cleanup at 32
Fairbanks. To date, Servepro removed and destroyed the contaminated piano. Homepro
removed the paneling and power washed the walls and floors. A new French drain was
installed with a new pump and battery backup by Charles Ronchetti. Homepro will be
doing the paneling. Perlmutter stated that Mr. Reutter is doing a fine job and perhaps he
can begin removing the clutter on the stairs and upstairs. MacKenzie asked the Reutters if
they are still working with the case worker who would be able to get some help for them.
Mr. Reutter informed the Board that he spoke with her that morning but they are under
contract with Servepro at this time. It was determined that the Reutters would not need to
appear before the Board until the January 2010 meeting.
MAPC Regionalization Update – Joseph J. Domelowicz, Jr. of Metropolitan Area
Planning Council appeared before the Board of Health to update them on the
Regionalization of Belmont, Arlington and Lexington. At this point, nothing is set in
stone at this point. A proposal to include structure for a regional health department
located in Arlington, it’s governance and budget will be delivered at the end of
December. MR. Domelowicz will meet with Carl Valente, Town Manager. The Board
asked for a systematic evaluation of what will be different and are the communities
willing to give up some important things. A discussion followed.
