Lexington Board of Health Meeting, December 9, 2009 at 7:00 p.m.

Heiger-Bernays called to order at 7:00 p.m.
The Board reviewed the minutes of November 18, 2009. Perlmutter motioned to accept
the minutes with corrections. MacKenzie seconded. All approved.
Environmental Health Report
Dabins – Cody advised the Board why Dabins is before them this evening. Maureen Lee
has been hired by Dabins as a food consultant. Lee informed the Board that during an
inspection conducted on 11/27/09 there were a few critical violations relative to the Sushi
bar. Lee will be going over training with the Sushi Chef again completely. According to
Lee, cleaning and handling practices, hand washing at appropriate times had improved.
Lee’s contract will expire on 12/31/09 but Lee will appear at the January 2010 meeting.
MacKenzie motioned that when Lee conducts the next inspection, if there are any critical
violations within the Sushi prep area, Cody will be notified by Lee and Sushi prep will
cease until the next Board of Health meeting in January. Perlmutter seconded. All
approved.
Khushboo – Sunny Sarni of Khushboo appeared before the Board as a result of an
inspection conducted on November 7, 2009 and an order to correct letter. Lisa Berger
has been hired as their food consultant and will provide an update at the January 2010
meeting.
Wilson Farms – Cody advised the Board that this hearing will be revisited at the January
2010 meeting.
La Riveria – Yves Charles, owner of La Riveria, came before the Board to request a
variance to continue to use the 2 bay sink which is not allowed in Food Establishments
according to the 1999 Food Code. After a discussion, Perlmutter motioned as stated in 8-
103.10 of the State Sanitary Code for Food Establishments, the Board of Health has
decided to grant a variance from section 4-301.12 in reference to the use of a 2 bay sink.
Furthermore, La Riveria may use the 2 bay sink only for the washing and sanitizing of
full sheet pans which do not fit in the dishwasher. Should there be any deviation from the
use of this sink as evident by the inspection process, then this variance becomes null and
void and a three bay sink will be required to be installed. MacKenzie seconded. All
approved.
Changhai – Jason Guan, co-owner of Changhai, appeared before the Board because
during a recent inspection at this establishment there were 8 critical and 16 non-critical
violations. Cody advised the Board that Guan agreed to the following corrective actions:
1.The owner of Changhai must hire a food consultant to conduct three (3)
random and unannounced State Sanitary Code compliance food
inspections between January 1, 2010 and May 1, 2010
2.The food consultant must review the file folder with the Health Director
and Health Agent before the first inspection.
3.The food consultant must be hired on or before December 23, 2009. A
copy of the signed contract must be submitted to the Health Division.
4.The owner of Changhai must ensure that all staff completes the Person in
Charge, PIC, training with the Health Division by March 1, 2010.
5.The food consultant must develop a cleaning schedule for Changhai
6.The owner of Changhai and the food consultant must appear before the
Board of Health at each regularly scheduled meeting from February
through May or as otherwise required by the Board of Health
Heiger-Bernays motioned that the Lexington Board of Health considers these violations
are a serious matter and should it appear that the plan as outlined above, does not
improve your compliance record, then further administrative action, including suspension
of your food permit to operate will be considered by this Board. Perlmutter seconded.
All approved.
Housing Update
32 Fairbanks Road - A discussion took place concerning next steps to resolve this case.
MacKenzie motioned to adjourn. Perlmutter seconded. All approved.
