HomeMy WebLinkAbout2009-02-10-NAC-min NOISE ADVISORY COMMITTEE MINUTES 10 February 2009 Meeting A duly posted meeting of the Noise Advisory Committee (NAC), held in the Legion Room, Cary Hall, was called to order at 7:30 PM by Chairman Tony Galaitsis with members Martha Wood, Robert Earsy, Jack Maloney, Steve Kropper and Julian Bussgang present. Also attending was Susan Yanofsky from the Town Manager’s Office. Ms. Yanofsky reported concerns from center businesses about the time changes the NAC is going to propose to 2009 Town Meeting through Article 33. Specifically, she cited expected hardships for Great Harvest, Vinnie Testa’s, CVS, and the Muzzey Street Lot. The committee thanked Ms. Yanofsky for her input. She left the meeting at 7:50 PM. There was a discussion about the levels of noise complaints to date. The general sentiment was that there were not many complaints to the Board of Health (BOH) or to the Police Department. Mr. Galaitsis reported that he presented Article 33 to the BOH during their 2/9/09 meeting. He said that most BOH comments were against the proposed changes and summarized them as follows: ??The BOH director was concerned that a 7:00 AM start of trash collection would push Lexington to the bottom of the pick up queue, and would cause trucks to arrive in Lexington loaded with refuse from other towns, which would result in an unhealthy situation. ??A BOH member opposed any delay in the morning start up times, but would favor an extra 1-hour earlier shut down time in the evening. ??Another BOH member considered the proposed 8:00 AM start time unfair to domestic users, given that commercial services would still start earlier. ??Another member considered the current 7:00 AM as an acceptable start time for any activity, and was against a move to 8:00 AM Under these circumstances, the NAC reconsidered its position on the article. After a motion made by Mr. Kropper and seconded by Mr. Maloney, the NAC voted unanimously to go to Town Meeting with a recommendation for an indefinite postponement of Article 33.
