Pursuant to Governor Baker's March 12, 2020 Order Suspending Certain Provisions of
the Open Meeting Law, G.L. c. 30A, §18, and the Governor's March 15, 2020 and
subsequent Orders imposing strict limitation on the number of people that may gather in
one place, this meeting of the Lexington Conservation Commission will be conducted
via remote participation to the greatest extent possible. No in-person attendance of
members of the public will be permitted, but every effort will be made to ensure that the
public can adequately access the proceedings in real time, via technological means. In
the event that we are unable to do so, despite best efforts, we will post on the Town of
Lexington website or through LexMedia an audio or video recording, transcript, or other
comprehensive record of proceedings as soon as possible after the meeting.
This Conservation Commission meeting was held remotely via Zoom, an online meeting
platform. Public Participation via calling in or using your computer was encouraged.

Request for Enforcement Action at 180 East Emerson Rd by abutter Mr. and Mrs. Chen, 184

Attorney Susan Bernstein and Mr. Kyle Burchard, PE,presented to members of the Commission
on behalf of Mr. and Mrs. Chen, property owners of 184 East Emerson Road. Mr. Burchard
presented the discrepancies he found between the approved Amendment to the Order of
Conditions and the submitted as-built including: difference in spot shots and existing grade
contours, various areas of increased grade in the backyard where the infiltration system is placed
and around the side yard of 184 East Emerson Road, and an additional rise on the front side of
the house. Attorney Bernstein is concerned that the changes made to 180 East Emerson Road
have caused significant flooding and pooling of water on her client's property.
Ms. Mullins informed Attorney Bernstein and Mr. Burchard that the Order of Conditions has not
expired because of the tolled Order, and that she is organizing a site visit with the property
owners of 180 East Emerson Road and will reconvene when more information is available from
the Certificate of Compliance request and site visit.

Insignificant Plan Change/Conservation Plan Modification: 18 Winthrop Road, ViewPoint Cloud

Mr. Bill Erickson, Project Architect,presented before the Commission the request to shift the
location of the rear addition as required per the Board of Appeals process. This request includes
a reduction in the overall impervious surface area and a minimal increase (4.1 feet) in the
distance from the deck to the wetland buffer zone.
Mr. Michael Juliano, Project Engineer, confirmed for the Commission that the infiltration system
will remain at the same elevation as well as remain the same size, even though there is a
reduction in impervious surface.
On a motion by Ms. Dohan and seconded by Ms. Ladd, the Commission voted 7-0 by roll call
vote to approve the Insignificant Plan Change request.

Ms. Mullins informed the Commission that the site is not completely stabilized. No motion was

Ms. Samuels recused herself due to involvement with the property. The representative is
requesting a Partial Certificate of Compliance. Ms. Mullins informed the Commission that the
raingarden is not in compliance because a few hundred feet is not stabilized. The rain garden is
part of the stormwater management system and not compliant, and there was no motion to issue
the Partial Certificate of Compliance at this time.

Mr. Jack Sullivan, PE with Sullivan Engineering Group, presented before the Commission. The
property owner is seeking to demolish a portion of the existing house and construct a new
addition off the rear of the house, including steps within the 100 foot buffer zone. Mr. Sullivan
added that the closest point from the Bordering Vegetated Wetland to the overhang and gutters is
approximately 56 feet and no trees are being removed. Roof runoff will be managed by 4 inch
drains to a Cultec recharge system.
Questions and Comments from the Commission:
— The elevation is lower in the backyard than where the wetland flags are. Do you have the
wetland delineation data sheet as requested?
— There is a small tree that will be removed and not shown on the plan. It is a small cedar
shrub not more than 4 inches but is present.
— Would like to see Feno markers.
— Should there be restoration as part of the lawn in the 25 foot buffer zone?
Responses from the Representative:
— The data sheet is being prepared by Norse Environmental Services and should be
complete by mid-week.
— Did not talk to the property owner about additional restoration but can discuss.
Ms. Ladd stated that the delineation is inside an area where the trees are and Ms. Samuels asked
if there is an area that could be restored instead. Mr. Sullivan responded there would still be
enough lawn and could put a mix of plants and shrubs on the plan to show at the next meeting.
Mr. Hamilton stated that it is wetlands soil whether or not it is part of the lawn, and he would
like to review the data sheet from Norse Environmental Services to confirm where the soil
samples were taken from.
The Engineering report states that"more than two feet of separation was not provided between
ESHGWT and the bottom of the infiltration chambers". Ms. Mullins clarified that typically it is
supposed to be 4 feet and could go down to 2 feet, and that the Town Engineer will likely require
mounding if it does not meet the separation requirements.
On a motion by Mr. Beuttell and seconded by Ms. Ladd, the Commission voted 7-0 by roll call
vote to continue the hearing to the April 12, 2021 meeting at the applicant's request.

Mr. Matthew Weisman, Lexington Engineering and Mr. Eric A. Kelley, Environmental Partners
Group, presented before the Commission. Mr. Varoujan Hagopian, GEI Consultants, also
assisted in answering questions from the Commission.
Questions from the Commission:
— What is the riprap material made of?
— Does the vegetated wall system function even if no vegetation is established?
— What is the reason for the fence?
— How critical is the design of the bottom of the wall and is there a risk of the wall getting
undercut due to high velocities?
Response from the Representatives:
— The rip rap is composed of a layer of stone underlain by synthetic fabric. The reason for
using synthetic fabric is because in a heavy storm, the flow velocity in the channel will be
very fast and once it exceeds 5-6 feet per second, the synthetic material is needed to
avoid erosion. It is also a UV stabilized material that should last for over 40 years without
falling apart and will look more natural once stabilized in the future.
— The wall will be robust even without vegetation, however, the vegetation is for aesthetics.
Vegetation is not critical to the long term outcome of the wall.
— The fence will be installed as security for the homeowner and will be roughly 4-6 feet tall
on the center. The PVC piping should not affect the tie back system and the wall and
fence will be constructed simultaneously to avoid the grid becoming torn or distressed.
— The filter fabric comes underneath the wall similar to the flashing on a building.

It was requested that the dead tree to be removed be placed in the wetland area to jumpstart the
decomposition process. Mr. Hagopian agreed that the dead tree can be used as species habitat in
the wetlands area.
It was noted that a planting selection was not provided for the wall and members of the
Commission requested that it be provided at the next meeting. The Commission also requests
examples of successful flex walls in similar situations. A DEP number has not been provided for
Kiln Brook culvert daylighting.
On a motion by Ms. Ladd and seconded by Mr. Beuttell, the Commission voted 7-0 by roll call
vote to close the hearing of the Constitution Road Right of Way (CNOI-21-10).

Mr. Richard Kirby, Wetland Scientist with LEC Environmental, presented before the
Commission the request for demolition and reconstruction of a deck within the 100 foot buffer
zone and removal of a brick paver patio. Mr. Kirby stated that there will be an overall reduction
in impervious areas within the buffer zone and LEC has prepared a restoration planting plan to
restore existing lawn area as wetland. This restoration will occur along the southwest corner of
the property and Feno markers will delineate the new lawn area.
Mr. Beuttell mentioned the possibility of shifting the restoration zone and Mr. Kirby responded
that there is an irrigation junction box within the restoration area. In the future if the irrigation
system needs to be replaced then it could be relocated out of the restoration area says Mr. Kirby.
Mr. Hamilton requested the addition of a condition that the deck may not be replaced at a future
time by an addition.
On a motion by Ms. Samuels and seconded by Mr. Beuttell, the Commission voted 7-0 by roll
call vote to close the hearing.

Kristan Farr, Wetland Scientist with Hancock Associates presented before the Commission. Ms.
Farr, on behalf of the property owner, Eman Morgan, is proposing an addition to the existing
single family dwelling and two drywells, only one of which is within the 100 foot buffer zone.
Ms. Farr also noted that there is a large berm between the Bordering Vegetated Wetland and the
proposed addition.
Ms. Ladd stated that she believes there is a deed restriction on the back of the property and that
the plan should show that for the future. Ms. Mullins, agreeing with Ms. Ladd, added that the
Conservation Restriction was incorporated when the original subdivision was created.
The Engineering report states that the stormwater analysis does not demonstrate compliance with
the Performance Standard 5(2) of the Lexington Wetlands Protection Code.
On a motion by Mr. Langseth and seconded by Ms. Samuels, the Commission voted 7-0 by roll

Mr. Thomas Hughes, Hughes Environmental Consulting, and Mr. Steve Sawyer, Project
Engineer, presented before the Commission. Mr. Hughes stated that after performing test pits,
they did not hit seasonal high groundwater and therefore have plenty of clearance. The project
team also performed an identification of Norway maples in the mitigation area and can confirm
there is one Norway and possibly three Reds but they are too young to identify.
Mr. Hughes stated that the raingarden near the driveway may receive more sunlight than
originally thought and would like to request a condition to revisit the plant species. The pipe size
for the rain garden was increased from 6 inches to 8 inches.
Mr. Sawyer clarified the location of the Feno markers as it was not made clear on the plans.
Comments and Questions from the Commission:
— Are there any ground cover plants in the area of restoration?
Responses from the Representative:
— Had not thought of groundcover but could include a seed mix for the restoration area. The
intent for the herbaceous restoration area would be to make the area as tight to the ground
as possible to minimize invasives and to put plantings or pollinator seeds down.
On a motion by Mr. Beuttell and seconded by Mr. Langseth, the Commission voted 7-0 by roll
call vote to continue the hearing to the April 12, 2021 meeting at the applicant's request.

On a motion by Mr. Langseth and seconded by Ms. Ladd, the Commission voted 7-0 by roll call
vote to approve a deed to the Property from Holly Kicklighter (a/k/a Holly Smit Kicklighter) and
Susan Watts, as tenants in common, to the Town of Lexington acting by and through its
Conservation Commission, substantially in the form presented to the Conservation Commission
at its March 29, 2021 meeting, with final changes to be made by the Town Manager in his
reasonable discretion in consultation with town counsel.

Mr. Hamilton informed members of the Commission that Ms. Joyce Miller would like to put
benches in Conservation areas in appropriate places chosen by the Commission.
Ms. Samuels provided an update on the HIP landscaping documents and mentioned that the
working group will be sending a draft to developers and landscapers for their feedback.
Ms. Mullins provided an update on the Idylwilde Community Gardens and the Pollinator
Planting Kits for sale.
On a motion by Ms. Dohan and seconded by Ms. Ladd, the Commission voted 7-0 by roll call
vote to adjourn the meeting at 9:24 PM.
