Pursuant to Governor Baker's March 12, 2020 Order Suspending Certain Provisions of
the Open Meeting Law, G.L. c. 30A, §18, and the Governor's March 15, 2020 and
subsequent Orders imposing strict limitation on the number of people that may gather in
one place, this meeting of the Lexington Conservation Commission will be conducted
via remote participation to the greatest extent possible. Specific information and the
general guidelines for remote participation by members of the public and/or parties with
a right and/or requirement to attend this meeting can be found below. No in-person
attendance of members of the public will be permitted, but every effort will be made to
ensure that the public can adequately access the proceedings in real time, via
technological means. In the event that we are unable to do so, despite best efforts, we
will post on the Town of Lexington website or through LexMedia an audio or video
recording, transcript, or other comprehensive record of proceedings as soon as possible
after the meeting.
This Conservation Commission meeting was held remotely via Zoom, an online meeting
platform. Public Participation via calling in or using your computer was encouraged.

It was brought to the attention of the Conservation Commission from the Planning Board that
607 Waltham Street may not be a building lot under zoning bylaw, due to available upland
square footage (Section 4.2.1 for developable site area: 4.2.3 Developable Site Area). The
applicant has agreed to a later issuance of the Order of Conditions until the zoning problem is
resolved. If a change is required, the Commission will ask the applicant to request the hearing be
reopened.

Mr. Beuttell has experience in this area and has agreed to join this working group. Mr. Hamilton

Hartwell Innovation Park Zoning Initiative Comments
The Conservation Commission will hold a meeting on January 11, 2021 to discuss and generate
comments for the Hartwell Innovation Park, Hartwell Ave Rezoning Initiative.

These minutes will be approved during the next meeting of the Conservation Commission.
Schedule site visits for 1/19/2021 meeting
The site visits will be scheduled for Saturday, January 16, 2021.

Mr. Langseth will be providing possible dates for a Stormwater working/learning session.
Mr. Bitsko was notified that there has been nefarious activity at Willards Woods, including
idling of trucks and cars, drug use, and a dog being poisoned by cannabis that was left on the
ground. Ms. Mullins has notified the police and the park ranger with the license plate and other
information.

Mr. Beuttell recused himself from the hearing as he is working on another project with the
Arlington Parks and Recreation Commission.
Mr. Bitsko also recused himself as he is working on a project with the Arlington Conservation
Commission.
Danielle Desilets, representative from Kyle Zick Landscape Architecture, presented before the
Commission and was joined by Joseph Connelly, Director of the Town of Arlington Parks and
Recreation Commission, Rebecca Weissman and Mickey Marcus, Environmental Consultants
with SWCA, and Denise Cameron and Bradley Mustain, Civil Engineers with Woodard and
Curran.
Questions from the Commission:
— How much of the system is in Lexington?
— It appears that the trail north of the beach is being relocated away from the Reservoir, is
this correct?
— Why can't the trail be moved perhaps 10 feet away to allow for re-vegetation of existing
areas and removal of invasive species? There are many areas where the trees are not an
issue.
Responses from the Applicant:
— None of the parking is in Lexington. Only part of the beach area and trail are in
Lexington
— The trail is shifting mostly on the Lexington side, a couple of feet upland to minimize the
impact to the existing trees. Want to shift the trail material away from the bank.
— There is a cost-balance because we are working with existing trails. Looking at that
where we can as much as possible.
Referring to plans L1.1 and L2.1, Ms. Desilets described that there are alternate pathways being
shown on the left side of the plans from the connection on Lowell Street. The goal is to have as
much of this trail accessible as possible. Ms. Desilets added that they are taking the connection
that shows towards the beach side and creating a connecting point between the existing trails,
and, although it will require regrading and removal of vegetation, it is mostly burning bush. It
will use a portion of the existing trail but make a connection closer to the beach area, and when
the beach is open, there will be an accessible connection up to Lowell Street.
Referencing the Lexington Engineering report, Mr. Mustain confirmed that they did follow the
existing conditions for the areas in Lexington. Mr. Hamilton suggests that it would benefit the
applicant to get together with the Engineering Department to clarify the items on the
memorandum.
Mr. Marcus asks that the Lexington Conservation Commission coordinate with the Town of
Arlington on the issuance of the Orders of Conditions, if and when approved. Mr. Marcus would
like the orders to match, so that there will be just one set of conditions for the Contractors to
work with. Ms. Mullins confirmed that she will work with the Town of Arlington to make this
happen.
Ms. Desilets will provide a highlighted plan to show where the trails are shifting.

Mr. Richard Kirby, Wetland Scientist with LEC Environmental, presented before the
Commission. This request for an amendment to the Order of Conditions is due to the buyer of the
house wanting more outside seating in the form of a wraparound porch on the front left corner of
the house. Project Engineer Frederick Russell redesigned the rear infiltration system to
accommodate the runoff from the additional impervious area, and did so by increasing the
amount of stone surrounding the unit.
Questions from the Commission:
— Is the dimensional change related to the infiltration system, essentially making it two feet
longer, reflected on the revised plan?
Responses of the Applicant:
— The bed was lengthened and the plan shows a 34 foot dimension that would have
previously been 32 feet.
Ms. Mullins brought to the attention of the Commission and Mr. Kirby that the distance from the
side yard to the porch, 11.5 feet, may be from the original plan. The application for an Amended
Order of Conditions does not go to the Zoning Board for review, so Ms. Mullins suggested that
the Commission not close the hearing until that is resolved and confirmed.
On a motion by Ms. Dohan and seconded by Ms. Ladd, the Commission voted 7-0 by roll call

Ms. Becky Weissman, SWCA Environmental, and James Clancy, Eversource, presented the
project to the Commission. Eversource is proposing to provide additional electrical supply from
the existing substation on Hartwell Avenue to the MIT Lincoln Laboratories. The conduit will be
installed by a variety of methods. From the entrance driveway to beyond the Minuteman bike
path, 665 linear feet will be installed by Horizontal Directional Drill (HDD), a trenchless method
used to avoid impacting certain environmental resources. Also, from this point to an existing
manhole, 878 linear feet will be installed by conventional open trenching. The majority of this
project is within existing roadway; however, a small portion connects to a manhole that is just
off the roadway, but still within the road layout. Eversource is using two manholes, one on Wood
Street and another located at the intersection with Maguire Road.
Questions from the Commission:
— Why take such a turn northward on Hartwell Avenue, to go right back southward?
— Are the drilling muds constrained within the entry/exit area as shown?
— Does the contingency plan include issues related to fuel spills?
— Will the excess material be hauled away?
— Are we concerned about wetlands west of Wood Street?
Responses from the Applicant:
— There are existing manholes on Hartwell Avenue that Eversource will need to
connect conduits to.
— Will discuss with the engineers and provide an answer at a later date.
— Yes, the HDD contingency plan says they will keep mud storage tanks on site.
— Typically Eversource will haul it off immediately to an appropriate location,
however will ask the Engineers.
— Did not identify wetlands close to Wood Street. The proposed work ends just off
of Wood Street, and any wetlands appear to be over 100 feet away.
Referencing the Memo provided by the Engineering Department,there are questions on the
construction schedule and they are concerned about a new water line that is not shown on the
plans. Also, the Engineering Department would like to be included in the coordination of work
as there are other projects going on in the area. Ms. Weisman responded saying that they will
discuss with the Engineering Department and also confirm the location of the water main as well.

Mr. Richard Kirby, Wetland Scientist with LEC Environmental, and Michael Capachietti,
Project Engineer, presented before the Commission. The applicant is proposing to raze and
rebuild a single family dwelling, portions of which are within the 100 foot buffer zone to
Bordering Vegetated Wetlands, and is proposing to install erosion control, stormwater
management, and wetland and buffer zone restoration.
Questions from the Commission:
— Why don't the Feno markers continue to the northern property boundary?
— Why don't the Feno markers continue to the property boundary to the west, along the 25
foot buffer zone?
Responses from the Applicant:
— Extended the Feno markers to the northern property boundary and stopped them at the
existing lawn edge. If the Commission would like to continue them along the existing
lawn edge to the southern property boundary the applicant could do that.
— Can do that as well, extend to the 25 foot no disturbance zone, however that could give
the owner the false impression that they could clear beyond that.
Mr. Bitsko, who was not present during the site visit, asked other members of the Commission
their opinion on the location of the Feno markers. Ms. Dohan responded that, if anything, it
would be to the south along the limit-of-work line, which isn't a requirement but it would make
more sense to protect the area. Ms. Mullins added that the Commission does have the ability to
require this because of the 50 percent rule. Mr. Kirby responded saying that they can add three
more.
Ms. Kathy Pan, abutter and property owner of 22 Ingleside Road, was present and had questions
for Mr. Kirby and the Commission. Ms. Pan asked what the purpose of the infiltration system
(PSIS) along the driveway was. Mr. Kirby responded that, with a new house, the Conservation
Commission requires the applicant to collect the rainwater that runs off the impervious area and
put it into the ground to imitate a more natural system through a series of pipes and treatment
trenches underground. Ms. Pan also asked if she will have more water flow on her side of the
property and Mr. Capachietti responded that his job is to make sure there is no additional runoff
to adjacent properties. He noted they cannot take credit for the existing surfaces. Lastly, Ms. Pan
asked if the removal of the tree on the northern part of the property will create more runoff, to
which Mr. Kirby responded that the existing tree is pretty much dead and that a lot more runoff
will be collected by the infiltration system.
Mr. Langseth mentioned that there is a line labeled "PTEC" on the site plan, and requests that
this be referenced on the legend as "Proposed Telephone Electric Cable".
Ms. Samuels would like to see something more substantial than the Feno markers, perhaps a wall
or stone, as it is tempting to keep the lawn a nice, rectangular area. Mr. Capachietti responded
that he did add additional grading as a 3:1 slope from the edge of the existing lawn, and a small
depression will overflow into the wetland. There won't be mowing in the area as it will be at a
lower elevation.

Mr. Richard Kirby, LEC Environmental and Al Gala, Project Engineer, presented to the
Commission the revised plans and stormwater report. Mr. Kirby stated that they added a 5 foot
crawl space (elevation 209.94) as opposed to a full foundation, and that a small area will need to
be created for the utilities in the basement. He also stated that the top of the peat is being used as
the estimated seasonal high groundwater table and that the infiltration system remains
unchanged. The size of the infiltration system in the front of the house has increased to
incorporate the runoff of the entire existing dwelling, porous pavers will be put in place of the
existing driveway, and mitigation efforts have increased rather substantially. Mr. Gala added that
all the impervious surfaces are proposed to be infiltrated, and they are trying to keep the drainage
system above the groundwater, especially in the rear.
Questions from the Commission:
— Referring to the retaining wall and replication area, is everything behind or North of the
retaining wall or is there some other delineation between the usable lawn and wetland
replication?
— Neighbors are concerned about flooding. Has there been any update on lowering the
elevation?
— Where is the wall?
Responses from the Applicant:
— The replication area comes within a couple feet of the retaining wall. There is a small
area of what could be lawn between the wall and the Feno markers.
— Going to remove the lawn area to lower the elevation. During the preconstruction
meeting, could dig holes to determine how far out the contractor can go.
— The wall is just above 212.7+ and goes along the side of the property. From the bottom of
the wall to the wetland line is 6 feet.
Mr. Hamilton, agreeing that the neighborhood has a lot of flooding, believes that asking for a
basement or asking for 5 feet of crawl space is too much. Mr. Kirby responded that the basement
is finished and the property owner does not have much of a flooding problem, and that the crawl
space would be higher than the existing basement. Mr. Hamilton responded that the back of the
house is more likely to be impacted by rising water as it is much closer to the wetlands.
Mr. Kirby stated that the addition is beyond the 25 foot zone and a foot above the elevation of
the wetland boundary. Ms. Ladd and Ms. Dohan both opposed, agreeing that the "no build zone"
is for the safety of the homeowner and health of the wetland.
Mr. Kirby asked the Commission if a 4 foot crawl space, two feet above the wetland elevation,
be agreeable?
Mr. Langseth stated that, as long as the basement does not extend into a zone that displaces
groundwater, he does not think it will have much of an impact on flooding, although the sump
pump does present a degree of uncertainty. He added that if the groundwater analysis is correct,
then putting the 5 foot crawl space won't participate in the groundwater system. His
understanding is that the structure above the ground is preventing infiltration and that it is being
addressed by the infiltration system.
Ms. Samuels asked about the foundation below the crawl space. Mr. Gala responded that they
don't have detail on the footing but it is still above any groundwater.
Mr. Hamilton said that he is interested in Mr. Langseth's perspective on the groundwater and
would lean more in favor of a shorter crawl space in the area that may or may not have high
groundwater at certain times of the year.
Members of the Commission raised concern about the conversation for the next project within
similar buffer zone boundaries. The Commission has declined proposals for projects of much
smaller scale that extend into the same buffer zone. Mr. Beuttell shared his opinion that it would
feel inconsistent to allow a big developer to build within the 25 foot"do not disturb" zone and
not to allow this project, considering the substantial mitigation proposed.
Mr. Kirby ended the discussion saying he will need to return to the applicant and have a
discussion on the crawl space and the location of the utilities.
On a motion by Mr. Beuttell and seconded by Mr. Langseth, the Commission voted 7-0 by roll
call vote to continue the hearing to the January 19, 2021 meeting at the applicant's request.
