ARTICLE 10 APPROPRIATE THE FY2021 COMMUNITY PRESERVATION
COMMITTEE OPERATING BUDGET AND CPA PROJECTS
MOTION: That the Town hear and act on the report of the Community Preservation Committee on the
FY2021 Community Preservation budget and,pursuant to the recommendations of the
Community Preservation Committee, take the following actions:
m) That$100,000 be appropriated for LexHAB - 116 Vine Street Design Funds, and to
meet this appropriation $75,000 be appropriated from the Community Housing Reserve
of the Community Preservation Fund and$25,000 be appropriated from the Historic
Resources Reserve of the Community Preservation Fund;

COMMITTEE OPERATING BUDGET AND CPA PROJECTS
MOTION: That the Town hear and act on the report of the Community Preservation Committee on the
FY2021 Community Preservation budget and,pursuant to the recommendations of the
Community Preservation Committee, take the following actions:
k) That$551,026 be appropriated for Parker Meadow Accessible Trail Construction, and
to meet this appropriation $551,026 be appropriated from the Unbudgeted Reserve of
the Community Preservation Fund

Select Board Positions
Article 10k: Parker Meadow Accessible Trail Construction
Article l0k requests funding to for the construction phase of the universal accessible trail
system at Parker Meadows.
Lexington has 1,392 acres of Conservation Land. Little of this land is accessible to
members of the public with disabilities.
Parker Meadow is an ideal Town-owned property for universally accessible upgrades
because it is located near the center of Town, easily accessible from the Minuteman
Bikeway, includes an existing parking area and trail system and possesses little in the
way of grade changes.
Design for this project was funded at the 2015 ATM. Between October and December
2019, two public forums and a public site walk were held to share design ideas and solicit
feedback from the public, along with direct feedback from and responses with interested
neighbors.
The proposed construction of a universally accessible passive recreational trail system
will allow Lexington to offer open space opportunities that possess barrier-free passive
recreational access to members of the public with physical, vision, auditory or other
limitations.
The Select Board unanimously support passage of Article l0k.

Select Board Position on proposed Article 19B Amendment
The Board is committed to increasing Lexington's affordable housing stock. Doing so requires
disciplined allocation of our financial resources so that we adequately maintain our existing units
and acquire or build new units.
There are limited sources of funding for affordable housing development. The two primary
sources are the Community Preservation Fund established by the CPA and the Affordable
Housing Capital Stabilization Fund.
Community Housing is one of the primary purposes of the CPA and has been the source of most
Town-funded affordable housing development for more than the past decade. The CPA, however,
limits how funds can be used for maintenance—funds can only be used for the acquisition,
creation, preservation, and support of community housing. Funding of rehabilitation—or normal
maintenance—is not allowed under the CPA. Nonetheless, appropriate maintenance is essential
to keep the number of viable units in our subsidized housing inventory(SHI).
The Affordable Housing Capital Stabilization Fund, on the other hand, was created with the
purpose of funding affordable/community housing construction, renovation, and associated land
acquisitions or easements, allowing this Stabilization Fund to serve multiple affordable housing
related purposes.
Applying the Brookhaven Affordable Housing payments to the Affordable Housing Capital
Stabilization Fund is an appropriate use of those payments. Conditions have changed since the
Town negotiated these payments.
1) The cost of creating new units has increased due to the change in rules for how LexHab
procures construction contracts—this requirement to follow municipal procurement
procedures is a significant additional cost adding about a third to the cost of a project. It
will now take years for the payments from the Brookhaven mitigation fund to accumulate
to the point of creating even one new unit.
2) It is still unclear if the Brookhaven units will be counted as new units in the Town's
housing denominator count. This won't be known until after the completion of the 2020
census and determination by DHCD.
3) LexHab has spent more of their funds in creation of units and has limited reserves to
execute maintenance.
It is important to devise a future funding model to sustain our affordable housing program. It is
unnecessary, however, to overly constrain the use of our current funds when CPA funds are
already constrained. The proposed amendment would unnecessarily constrain prudent
application of funds for our total affordable housing development strategy.
For these reasons the Select Board voted 5-0 to oppose passage of this proposed amendment to
warrant article 19B.

2020-1 Special Town Meeting
ARTICLE 1
MOTION: That the Town authorize the Select Board to petition the Massachusetts General Court for
legislation providing that notwithstanding the provisions of any general or special law or
by-law to the contrary, all acts and proceedings taken by the town at an annual or special
town meeting held by remote participation by electronic means between March 23 and
September 30, 2020, and all actions taken pursuant thereto, are ratified, validated and
confirmed to the same extent as if the said Annual or Special Town Meeting had been held
in full compliance with any applicable general or special law or by- law; and further to
authorize the Select Board to approve amendments to said act before its enactment by the
General Court that are within the scope of the general objectives of the petition.
