Board would find helpful/useful that the Board of Health can compile and present to the Select Board for each
meeting.

Updated public Health Information (as of 4/30/20):
• 256 Confirmed Cases in Town
Town/School/Community:
• All Town Offices, recreation fields &courts (tennis/basketball) continue to be closed with the
exception of the Police Station (which remains open to the public). As the Board is aware,the
Governor announced the state of emergency would be extended from May 4 to May 18. The
Governor also established a public/private task force to provide recommendations on how/when
the state should begin to re-open non-essential businesses. They are expected to provide their
report on May 18 (same day the state of emergency has been extended to). I therefore expect the
state of emergency to continue beyond the May 18 date, but will be dependent on this report and
analysis.
• All of our Police/Firefighters that were out due to either exposure or positive tests from COVID-19
have returned to work.
• On May 1 there is a drive-thru COVID-19 testing site in Lexington operated by PhysiciansOne
(Waltham),which has coordinated with our Health Department, Fire Department, Police
Department and Public Information Officer. The site will be at the Lexington Elks Lodge and is
expected to provide services to approximately 250 people that will be pre-registered,they received
more pre-registrants than expected and extended the testing for 2 hours and will test 300.
• Town Staff are continuing to work remotely, responding to emails, processing payments as well as
accounts payable, payroll and all required permitting is continuing. I have created an internal
Return to Work Task Force which consists of 1 staff member from each building+2 members of our
Millennial Work Group (to challenge us)that will be working with the Health Department and Senior
Management Team and will be meeting weekly starting next week. Additionally, we've established
policies dealing with vacation carry-over for essential employees&Senior Management Team
members that are unable to utilize any vacation time during the state of emergency and requiring
that all other employees begin using some of their accrued vacation.
• Town Meeting—We are continuing to prepare for a virtual Town Meeting which we anticipate will
be scheduled sometime in early June. Presentations completed on those items that have been
identified as appropriate,which will be posted online through LexMedia on Youtube so that Town
Meeting members will have an opportunity to review those presentations without bogging down a
virtual Town Meeting with a large number of presentations that could otherwise have been
completed beforehand. Joe Pato has drafted a User's Guide for the online users for the remote
Town Meeting. We have also generated a Q&A site that Town Meeting members and members of
the public can submit questions. HD5024 is sitting at the Committee on Municipalities and Regional
Governments and hasn't moved forward in the past week which underscores the importance of the
Special Town Meeting Article to validate actions taken by a remote Town Meeting.
• Other Boards and Committees have started meeting virtually, but we are still trying to limit the
meetings to those that are necessary.
• We continue to have a regular, conference call every M-Th morning at 8 AM with the Senior
Management Team and Health Officials to review the change in the number of local cases and
discuss actions the Town is taking and to discuss any issues or concerns of various departments.
• We held the third "all employee" zoom conference call in which all employees were invited to
attend. We've had approximately 75 staff members joining and they've been very positive. This
week's topic that I asked the staff(at the end of the last call and through two emails)was to
consider those things about their remote working life and simply staying at home that are better so
that we can begin to consider how we might incorporate some of these ideas in our new, normal
work environment.
• The Board of Health is expected to issue a mask advisory on Friday morning at 11:30 as well as
regulations regarding public housing. An update will be provided at next Monday's Select Board
meeting.

Introduction
Massachusetts law,particularly G.L. cc. 164 and 166, comprehensively regulates utilities with
the aim of ensuring the uniform and efficient provision of utilities. The statutes delegate only
limited matters to municipalities, leaving most decisions regarding the need and general layout
for utility lines to either the state Department of Public Utilities ("DPU") or the utilities
themselves. See Boston Gas Co. v. City of Newton, 425 Mass. 697, 699 (1997)
One of the topics that is entrusted to municipalities is regulating the location of utility poles, as
detailed in G.L. c. 166, § 22, and the conditions under which utilities may bury underground
utilities under public ways pursuant to G.L c. 166, § 25. Section 22 provides that a company
wishing to construct utility poles and lines "upon, along,under, or across" a public way must
petition the Select Board, which in turn should hold a duly noticed public hearing. The Select
Board may issue a Grant of Location specifying details like the location and material of poles
and the number and height of lines. The Select Board may later issue orders increasing the
number of lines permitted on a pole,but a company need not seek the Select Board's permission
for ordinary repairs and replacements or to make connections from transmission lines along
public ways to individual houses. Section 22 also permits towns to include conditions in Grants
of Location. In addition, G.L. 164, § 25 allows the Board to adopt"reasonable regulations"
concerning the erection of electric lines or the digging of underground conduits.
Utility lines that serve multiple municipalities may be subject to local regulation under Sections
22 and 25. However, if the line will extend into another neighboring municipality, any
municipal condition will not take effect until such condition, or the local regulation authorizing
it, is approved by DPU. G.L. c. 166, § 27. Further, if a municipality denies a Grant of Location
associated with a line that will cross through multiple municipalities, the applicant may appeal to
DPU to override that denial. G.L. c. 166, § 28. In addition, the Supreme Judicial Court has
opined that a utility may be able to seek review by the Superior Court of a denial of a Grant of
Location for a line that is limited to one municipality, even where DPU might lack jurisdiction.
Boston Edison Co. v. Board of Selectmen of Concord, 355 Mass. 79, 87 (1968).
With these general rules in mind, the following is a guide to issues the Select Board may address,
and ones it should avoid, in Grant of Location hearings:
Issues Town Can Address in Grants of Location
• Aesthetic Concerns/Bundled Wires: Although Chapter 166 statute does not directly address
aesthetic concerns, including the bundling of wires on a pole, towns have some ability to
regulate aesthetics by regulating the height of poles, the number of lines that can attach to
them, and materials of which the poles are made However, any conditions the Select Board
imposes would be subject to the general policies in the statute to promote the uniform and
efficient provision of electric service.
• Adequacy of renderings and engineering plans: The Town can insist on accurate and
complete plans that allow the Town Engineer and Inspector of Wires to review the proposed
locations of lines and the construction work involved.
• Provisions for review of constructed work and construction practices by qualified town staff
or consultants. Fees for such review should be limited to what is reasonably necessary.
• Standard construction conditions imposed on other activity in town: Limitations on
hours/dates of work, traffic management, health and safety protocols, and access to
emergency contacts for the Town and affected residents.
• Insurance requirements to protect Town property.
• Preservation of public and private property, and restoration of damaged property.
• Town accommodations: For example, the Town may address particular requirements for
laydown areas or removal and replacement of town facilities such as parking meters.
• Assignability of Grant of Location: Retain rights to review assignments of a project to
another entity for quality control and assumption of obligations in a Grant of Location.
However, the Town should not attempt to dictate what contractors an applicant uses.
• Consistency of the proposed project with zoning, wetlands, and other applicable
requirements: The Board may want to receive assurances that all permits have been applied
for and obtained, but decisions regarding zoning or wetlands should be handled by the
Town's land use officials and boards with the appropriate jurisdiction.
• Removal of unused poles for safety reasons (but see note re: double poles below).
• Coordination with other projects along the same right of way.
Issues the Board Typically Should NOT Address in a Grant of Location
• Financial benefits to the utility of an application.
• Need for the utility service (e.g., climate change impacts,redundancy of service).
• Corporate integrity or reputation of the applicant.
• Concerns associated with utilities other than the applicants', e.g., the Board cannot require a
utility to keep a trench open until another utility has had an opportunity to inspect it.
• Double poles (erecting a pole next to an old or defective pole without taping down the old
pole): The Legislature has directed utilities to "complete the transfer of wires, all repairs,
and the removal of the existing pole from the site within 90 days from the date of installation
of the new pole." G.L. c. 164, § 34B. However, the statute provides for no penalties if this
deadline is missed, and towns cannot fine utilities that fail to meet these deadlines. Boston
Edison v. Town of Bedford, 444 Mass. 775 (2005).
• Radiofrequency/electromagnetic emissions from utilities: These issues are largely regulated
at the federal level and further local regulation is preempted.
• Requests for"mitigation"not tied to the project: Most utility projects are funded by
ratepayers, meaning applicants are likely to object to requests to fund town projects or
services other than those needed as a direct result of the applicants' project.

SUMMARY:
Attached please find a Department of Local Services (DLS) bulletin clarifying certain aspects of Chapter 53 of
the Acts of 2020. At the Select Board's meeting on April 13, 2020, staff recommended (and the Board
approved) extending certain payment dates and waiving certain interest costs for late payments as per the
statute. This DLS bulletin(see Section 5) clarifies that the water and sewer interest costs were not intended to
be included in the statute, EXCEPT when they had been unpaid and added to the property tax bill. Otherwise,
the clarification indicates the Town may choose to waive the interest and fees. It was staff s intention to include
water/sewer, and we believe that was the Select Board's intention from the previous vote. However, given this
clarification, we are recommending the Board take a second vote confirming the original intent as allowed by
Town bylaws.
Section 107-4 of the Town's bylaws sate "All municipal charges and bills shall be due and payable within 30
days from the date of issue. Municipal charges and bills not paid on time shall thereafter bear interest on the
unpaid balance at the rate of 14%per annum. The Board of Selectmen shall have the authority to abate any
such interest charges, in whole or in part."
Approving the motion below will allow the Treasurer to waive interest on water and sewer bills issued after
March 10, 2020 which are paid by June 20, 2020, consistent with the vote already taken for property and excise
tax bills. Water and sewer bills paid after June 30, 2020 will accrue interest at 14%per annum.
SUGGESTED MOTION:
Move to abate any interest charges that are incurred on water and sewer bills issued after March 10, 2020 and
paid by June 30, 2020.
FOLLOW-UP:
Town staff is preparing to generate semi-annual water and sewer bills in the coming week. The bills will have a
due date 30 days from the date of the bill, however interest charges will be waived as indicated above.

5. To what bills/chargesr than the propertytax does the optionto waive

bills not added to the tax bill or other local utility billsr charges?
The first sentence of section i11 contains the local option to waive payment of
interest and other penalty and it applies to "any excise, tax, betterment assessment
or apportionment thereof, water rate or annual sewer use or other charge added to a
tax for any payments with a due date on or after March 10, 2020 and made after its
respective due date but before June 30, 2020. (Emphasis added.)
This local option applies to the motor vehicle excise and the property tax. In addition,
it applies t "betterment assessment or apportionment thereof, water rate or annual
sewer use or other charge added to a tax." This phrase is found in the 11"
paragraph of ,L, c. 5 , 57 . Section 57C provides that;if the "tax, betterment;
assessment or apportionment thereof, water rate or annual sewer use or other
charge added to such tax" is not timely paid, it shall accrue;interest at the rate o
1 % from the due date. The use by the legislature of this same phrase in section 11:
indicates its intent that the section 11 waiver apply only to these charges (betterment
assessment or apportionment thereof, water rate or annual sewer use or other
charge) after they are added to the property tax bill.
For each of the above charges, interest is imposed by statute and a city/town would
have no authority to waive interest without legislation, For motor vehicle excises,
C .L. ca 0 requires 12% interest if unpaid within 30 days. For unpaid property
taxes, betterment assessment or apportionment thereof, water rate or annual sewer
use or other charge added to a tax, Q.L. c. 59a 7 and 57C require 1 % interest.+
The section 11 option allows',a city/town to waive the statutory interest for these
charges.
A city or town may also waive its locally imposed interest or penalty on local fees or
charges; however, the waiver is not done through section 11. Legislative authority is
ordinarily not required to adjust or waive locally imposed due dates or interest
charges. If a city or town wishes to pursue the adjustment of locally imposed due
dates or interest charges on its local water, trash or other charges (notlready
added to a property tax bill), it should consult its local counsel for advice on the
procedure.;
6. Does the city/town need to fin a "demonstrated inability to pay to adopt
the waiver of interest and other penalty contained in the first sentence o
section 11?
o—As a result of the legislative history and the wording of section 11, it is our
opinion that the "demonstrated inability to pay" applies only to the termination of
essential services provision contained in the second sentence of section 11. It does
not apply to the first sentence of section 11 which contains the waiver of interest and
other penalty option.
7. Can a city/town exercise the option in the first sentence of section 11 to waive
interest/penalties and choose the bills to which it will apply? For example, can
a city/town choose not to adopt the local option interest waiver for motor
vehicle excise bills, but exercise it for the rest of the listed charges ®- "tax,
betterment assessment or apportionment thereof, water rate or annual sewer
use or other charge added to a tax"7
Yes - We think that the use of the word "any" in the legislation permits a city/town to
choose from among the listed bills.
8. If a city/town exercises the waiver option under section 11, can a city/town
exclude certain categories of taxpayers from thewaiver? For example, can i
exclude personal property taxpayers, or allow the option only for elderly
taxpayers?
It is unclear that the legislation allows this. As a result, we advise that local counsel
be consulted if considering this approach.
9. If a city/ town exercises the option to waive interest, what is the last day for a
taxpayer to pay the bill and qualifyfor the waiver of interest?
June 29, 2020. The relevant language in the legislation is "made after its respective
due date but before June 30,2020." If the bill is paid on June 30, 2020 or after, it is
paid too late for the waiver to apply. Interest will run from the date the bill is due to
June 30, 2020 (or the date after June 30, 2020 that it is paid). For example, if a
property tax bill's due date was extended to June 1, 2020 and it is paid on June 30,
2020, interest will run from the due date of June 1, 2020 to June 30, 2020. If the bill
is paid July 15, 2020, interest will run from June 1, 2020 to July 15, 2020. If,
however, the bill is paid on June 29, 2020, interest will be waived.

Jim,
I have reviewed the information concerning the water bills for 19 Robinson Road. There are many
factors that led to the large water bill including an underestimating meter and a false assessment of the
meter overestimating use. In order to correct this situation and determine what is truly owed I went
back to the last point in time when the bill payments were up to date which was December 2015.
There are 8 water/sewer bills (table attached) that are Outstanding and if we can collect payment for
those bills (totaling $1,593.72)then I recorm-nend abating the balance of$55,385.27 (includes interest).
This will bring her current and as long as she continues to pay for the water bills moving forward (we
are currently reading meters now so she should be getting a new invoice in the next month) we should
be okay.

MOTION: That the Town hear and act on the report of the Community Preservation Committee on the
FY2021 Community Preservation budget and,pursuant to the recommendations of the

received by the Town upon the sale of any bonds or notes approved by this vote, less
any such premium applied to the payment of the costs of issuance of such bonds or
notes,may be applied to the payment of costs approved by this vote in accordance with
Chapter 44, Section 20 of the General Laws, thereby reducing the amount authorized to
be borrowed to pay such costs by a like amount.

received and the CORI check for the applicant has been performed to renew(1) Limousine License for MN
Black Car, LLC.
SUGGESTED MOTION:
Motion to approve the application and issue one(1)renewed Limousine License to MN Black Car, LLC, 425
Woburn Street.

SUMMARY:
Lexington Day of Decency
Correction, -No Formal Request was submitted to the Select Board Office in 2020. This was mistakenly put
on the agenda from an old request list.
National Police Week and Peace Officers Memorial Dav
The Board is being asked to sign a proclamation for National Police Week and Peace Officers Day. National
Police Week is being celebrated this year from May 10 - 16, 2020 and encourages all citizens to join in recognizing
law enforcement officers. Peace Officers Memorial Day is celebrated May 15, 2020 in honor of law enforcement
officers who have made the ultimate sacrifice in service to their community or have become disabled in the
performance of duty.
This request includes lowering the Battle Green flag on May 15, 2020,
National Public Works Week
The Board is being asked to sign a proclamation for National Public Works Week. National Public Works
Week is being celebrated this year from May 17 -23, 2020 and encourages all citizens to join in recognizing the
employees of the Lexington Department of Public Works for their hard work and dedication to the Town.
Correction
Day of Decency Proclamation removed from agenda
Correction- This was mistakenly put on the agenda from an 2019 request list. The Board did not act on this i
2019 as there was not sufficient information to support. No requests have been submitted to Select Board
Office in 2020 for such proclamation.

PROCLAMATION
Whereas: the Congress and President of the United States have designated May 15th as Peace Officers' Memorial Day, and
the week in which May 15th falls,May 10 to 16,2020,as National Police Week;and
Whereas: it is important that all citizens know and understand the duties, responsibilities, hazards and sacrifices of law
enforcement agencies and that law enforcement personnel recognize their duty to serve the people by safeguarding
life and property,by protecting them against violence and disorder,and by protecting the innocent against deception
and the weak against oppression; and
Whereas: the 50 officers of the Town of Lexington, Massachusetts Police Department play an essential role in safeguarding
the rights and freedoms of the citizens of Lexington and in fiscal year 2018, the officers responded to 13,092 calls
for service;and
Whereas: since the first recorded death in 1791,more than 20,000 law enforcement officers in the United States have made the
ultimate sacrifice and have been killed in the line of duty including Lexington Police Officer James J.Hodgdon, III
who died on November 4, 1967 at the age of 23 following an automobile accident; and
Whereas: Lexington Police Officer James J.Hodgdon,III name is engraved both on the wall of the National Law Enforcement
Officers Memorial in Washington,D.C.,and on the Town of Lexington,Massachusetts Police Department Memorial
Monument; and
Whereas: the men and women of the Town of Lexington,Massachusetts Police Department provide a vital a public service.
NOW, THEREFORE, WE, THE SELECT BOARD of the Town of Lexington,Massachusetts do hereby proclaim the week of May
10 to 16,2020 as
NationaCPoCice -Week
in the Town of Lexington,Massachusetts and encourage all citizens to join us in recognizing law enforcement officers,past and
present, who,by their faithful and loyal devotion to their responsibilities, have rendered a dedicated service to their community
and,in so doing,have established for themselves an enviable and enduring reputation for preserving the rights and security of all
citizens.
BE IT FURTHER PROCLAIMED that we call upon all citizens of the Town of Lexington,Massachusetts to observe
Wednesday,May 15,2020 as
Peace Officers MemoriaCDay
and authorize the American Flag on the Lexington Battle Green to be lowered to half-staff as directed by the President of the
United States for the day in honor of those law enforcement officers who,through their courageous deeds,have made the
ultimate sacrifice in service to their community or have become disabled in the performance of duty,and let us recognize and
pay respect to the survivors of our fallen heroes.

Whereas: the services of the Public Works Department in Lexington are an integral part of
the everyday lives of all of its citizens; and
Whereas: the support of the citizens of Lexington is vital to the efficient operation of public
works systems and programs such as water, sewers, streets and highways,public
buildings, and solid waste collection and disposal; and
Whereas: the health, safety and comfort of the citizens of Lexington greatly depends on its
public works services; and
Whereas: the quality and effectiveness of these facilities, as well as their planning, design,
and construction, is vitally dependent upon the efforts and skill of public works
employees; and
Whereas: the efficiency of the qualified and dedicated employees in the public works
department is materially influenced by the knowledge that their work is
appreciated.
NOW, THEREFORE, WE, THE SELECT BOARD of the Town of Lexington, Massachusetts, do
hereby proclaim the week of May 17 to 23, 2020 as
National Public Works Week
in the Town of Lexington and call upon all citizens to join us in recognizing the employees of the
