The applicants asked to obtain a certificate of occupancy prior to receiving a certificate of compliance. There are several outstanding issues concerning the project such as getting the approval of the Commission for an increase in impervious surface area. The applicant has a bond on the property that covers the costs of the remaining work to be completed. The applicants have filed for a request to amend the order of conditions which will be presented at the March 23, 2020 meeting. The Commission determined that the certificate of occupancy can be released. Request for Insignificant Plan Change: 16 Summer Street DEP 201-996 BL 953 —expand paved driveway surfaces outside 100-foot Ms. Samuels recused herself from the discussion of 16 Summer Street. Ms. Shelly Henderson, homeowner, presented before the Commission four parts of a proposed plan change. Proposed plan changes "A", "B" and "C"were proposing to expand paved driveway surfaces outside the 100 foot buffer zone. The Commission deemed the driveway expansion to be outside of their jurisdiction. Ms. Henderson additionally proposed plan change, "D", to trench for utilities within the 100 foot buffer zone. There was insufficient information for the Commission to evaluate the proposed change. 2 On a motion by Ms. Dohan and seconded by Ms. Ladd, the Commission voted 4-0 to confirm that the proposed plan changes "A", "B" and "C", to expand the driveway are outside the Commission's jurisdiction. The proposed trench will be discussed at a later date when there is sufficient information. Discuss Lincoln Street Wildlife Crossing Proposal by the Citizens for Lexington Conservation. Ms. Dohan recused herselffrom the discussion of the wildlife crossing proposal. Ms. Pamela Lyons and Mr. Joel Friedlander, representing the Citizens for Lexington Conservation ("CLC"), presented before the Commission. CLC is seeking the support of the Conservation Commission to do something to reduce wildlife mortality, one option of which would be to install wildlife crossing signage at Lincoln Street where the roadway meets the Cambridge Reservoir. The Commission supported installing signage as the most cost effective option. The Commission encouraged the CLC to contact the City of Cambridge for their potential support. On a motion by Ms. Ladd and seconded by Mr. Beuttell, the Commission voted 4-0 to support the Citizens for Lexington Conservation's efforts to install wildlife crossing signage on Lincoln Street. 7:00 pm New Public Meetings/Hearings ViewPoint Cloud Permit 4CDOA-20-6 RDA, Parker Meadow (0 Revere Street) Applicant: Town of Lexington Conservation Dept. Project: Conduct exploratory soil borings needed for preparing final ADA trail design Documentation Submitted: - Plans, "Attachment D: Boring Location Plan & Access Route Map - Revisions 3/9/2020", prepared by GCG Associates and Kyle Zick Landscape Architecture, Inc., dated 3/9/2020 - Project Narrative, "Boring Request for Parker Meadow",prepared by Kyle Zick, dated 2/18/2020 - MassDEP RDA Application, prepared by Kyle Zick Landscape Architecture, Inc., prepared for Town of Lexington, dated February 18, 2020 Ms. Tracy Hudak, representing Kyle Zick Landscape Architecture, Inc. (consultants for the Lexington Conservation Dept.),presented before the Commission. The applicant is proposing to conduct soil tests at four different locations in Parker Meadow in order to test the load bearing capacity. This is to prepare for the installation of boardwalks. The soil testing will be done with small machinery which will dig a four (4) inch+/- in diameter hole twenty (20) feet down into the ground. The soil samples will be tested in an offsite location. The holes will be filled in with a soil/sand mixture. Three of the four testing locations will utilize existing trails to access the sites while the fourth location will require machinery to traverse off-trail. Wetland matting will be installed to prevent damage from the machinery. 3 Concerns of the Commission: - One of the soil testing locations is relatively far from the proposed boardwalk location. Will this soil test be an accurate portrayal of the soil for the boardwalk location? - Will any environmental damage caused by machinery be restored? Response of the Applicant: - The soil testing location is down gradient from the proposed boardwalk location and is a part of the same wetland resource location. They believe that this testing location will produce very similar results as the original location would have given. - No damage is expected but any damage that occurs will be fixed. A condition will be added to preliminarily determine the exact location for wetland matting to ensure that no damage will occur as a result of the machinery. On a motion by Mr. Beuttell and seconded by Ms. Samuels, the Commission voted 5-0 to issue a negative determination with conditions. The applicant is proposing to raze and rebuild a single family dwelling within the 100 foot buffer zone. The proposed dwelling is further from the wetlands than the existing dwelling. There are two subsurface infiltration systems proposed as well as a rain garden which will capture driveway runoff through a 6 inch pipe. One tree is proposed to be removed. The proposed dwelling will be outside of the 50 foot no structure buffer zone. The applicant is not proposing to convert lawn area to restored wetlands. The applicant would like to demarcate the bordering vegetated wetland at the edge of lawn. Concerns of the Commission: - The Commission asked the applicant to propose wetland markers in a more appropriate location which would protect more of the wetland. 4 Response of the Applicant: - The applicant would like to install markers in between the official delineated wetland boundary and the edge of the lawn. They will consider additional options to propose. The applicant is proposing to raze and rebuild a single family dwelling outside of the 100 foot buffer zone. Within the 100 foot buffer zone, the applicant is proposing to remove an above- ground swimming pool and restore the existing lawn. Debris and materials from an existing garden area within the 25 foot buffer zone will be removed by hand. The trees proposed to be removed outside of the buffer zone will comply with the town tree bylaw. Concerns of the Commission: - The proposed erosion control does not have to exactly follow the 25 foot buffer zone, it can be installed straight across the property as long as it protects the 25 foot buffer zone. - Removal of bittersweet abutting the property was encouraged. The owner would need to get approval from the Recreation Department. Request to Extend Order of Conditions: Old Reservoir (501 Marrett Road) DEP 201-437 BL 393 (by 1 year from 4/13/2020 to 4/13/2021) On a motion by Ms. Samuels and seconded by Ms. Ladd, the Commission voted 5-0 to extend the order of conditions by 1 year. Position of the Commission on certain Articles before the 2020 Annual Town Meeting 7 On a motion by Mr. Beuttell and seconded by Ms. Samuels, the Commission voted unanimously to support Town Meeting Article 29: Declare Climate Emergency. On a motion by Mr. Beuttell and seconded by Ms. Samuels, the Commission voted unanimously to not support Town Meeting Article 33: Amend General Bylaw—Running Bamboo Control - due to disagreements over the article's wording and enforcement responsibilities. On a motion by Ms. Samuels and seconded by Mr. Beuttell, the Commission voted unanimously to support Town Meeting Article 35: Amend Zoning Bylaw—Distance from Basement, Slab or Crawl Space and Groundwater. Approve Minutes: 2-24-2020 On a motion by Ms. Samuels and seconded by Ms. Ladd, the Commission voted 5-0 to approve the meeting minutes from 2/24/2020 pending edits. Site Visit Schedule for 3-23-2020 Meeting The site visits will proceed as scheduled. On a motion by Ms. Ladd and seconded by Mr. Beuttell, the Commission voted 5-0 to adjourn the meeting. 8:28pm
