New Business/Pendine Matters
Request for Certificate of Compliance: 18 Constitution Road DEP 201-884 BL 843
Ms. Mullins reported that the permit was issued in 2013 and was extended until 2018. The
certificate of compliance was not ready to be issued.
Request for Certificate of Compliance: 29 Dawes Road DEP 201-1125 BL 1082
On a motion by Ms. Dohan and seconded by Mr. Beuttell, the Commission voted 7-0 to issue a
full certificate of compliance.
Renew permit for goat grazing at Chiesa Farm
On a motion by Ms. Ladd and seconded by Mr. Beuttell, the Commission 7-0 to renew the
permit to graze goats at Chiesa Farm for 2020.
Request for Plan Modification: 430 Concord Avenue DEP 201-938 BL 897 —gas service
relocation
Mr. Rich Kirby, Mr. Mike Capachietti and Mr. Jim Tranghese presented before the Commission.
The applicant is proposing to install an eight(8) foot tall fence at the base of the slope located
next to the parking lot. Additional plantings such as inkberry or bayberry shrubs are proposed to
be planted where initial plantings failed to establish. A plant restoration list has yet to be
submitted.
Abutters to the property, Ms. Jill Barnes and Ms. Sharon Hayes of 426 Concord Avenue
supported the installation of an eight(8) foot tall fence.
On a motion by Mr. Beuttell and seconded by Ms. Dohan, the Commission voted 7-0 to approve
the plan modification for the substitution of plantings, relocation of the gas line and installation
of a fence.
Approve Wright Farm Subcommittee Charge
On a motion by Ms. Ladd and seconded by Mr. Beuttell, the Commission voted 7-0 to approve
the Wright Farm Subcommittee Charge.
Approve Minutes: 12/16/2019, 1/6/2020
On a motion by Ms. Samuels and seconded by Ms. Dohan the Commission voted 7-0 to approve
the minutes pending edits for December 16, 2019.
On a motion by Ms. Samuels and seconded by Ms. Ladd the Commission voted 7-0 to approve
the minutes pending edits for January 6, 2020.
Site Visit Schedule for 2/10/2020 Meeting
Site visits will be conducted as scheduled.
Reports: Bike Advisory, Community Gardens, Community Preservation Committee, Greenway
Corridor Committee, Land Acquisition, Land Management, Land Steward Directors, and Tree
Committee
The Commission will meet on Monday, February 3rd to discuss proposed storm water and buffer
zone regulations.
Mr. Bitsko asked for an update regarding the tree nursery near the Lower Vine Brook.

Mr. Kevin Sheehan and Mr. Eric Olsen, wetland scientist with VHB presented before the
Commission. The application wishes to confirm the resource area delineation with the
Conservation Commission. Mr. Olsen stated that he made observations at the property in
September and again in November. The property has two wetlands with associated buffer zones.
Concerns of the Commission:
- The hydric soils on the property indicated that the protected resource areas appear to
extend farther than shown on the submitted plans.
Response of the Applicant:
- The applicant will coordinate with Ms. Mullins to re-evaluate the wetland delineation on
site.
On a motion by Ms. Dohan and seconded by Mr. Beuttell, the Commission voted 7-0 to continue
the meeting until February 101h, 2020 at the applicant's request.

Request for Determination of Applicability, Eldred Road
Applicant: Lexington Department of Public Works
Project: Replacement of 6" and 8"water main with associated activities

Ms. Marissa Liggiero and Mr. Dave Pavlik presented before the Commission. The applicant
proposes to replace a water main within the 100 foot buffer zone of a bordering vegetated
wetland. Erosion control will be installed along the entire length of the project. Dewatering will
occur if necessary. The project is set to begin at the end of April or early May and continue
through the summer.
Concerns of the Commission:
- Construction staging will be determined during the pre-construction meeting.
On a motion by Ms. Ladd and seconded by Mr. Beuttell, the Commission voted 7-0 to issue a
Negative Determination with conditions.

Mr. Tim Power and Mr. and Mrs. Bokun, homeowners, presented before the Commission. The
applicant is proposing to install two geothermic wells underneath their current driveway which is
outside of the 100 foot buffer zone. A portion of the associated pipe is proposed underground
within the 100 foot buffer zone. To complete the project they will be digging a 4x4' pit to install
the wells. The entire process should take 1-2 days to complete. The project has already been
approved through the Board of Health.
Concerns of the Commission:
- If the contractors find slurry what will happen?
Response of the Applicant:
- The project is a closed loop system.
- The applicant has prepared multiple contingency plans if they hit excessive water.
On a motion by Ms. Dohan and seconded by Mr. Langseth, the Commission voted 7-0 to issue a
negative determination with conditions.

applicant is going before the Zoning Board of Appeals for project approval.
Concerns of the Commission:
- Is the trench drain downgradient of the dwelling?
Response of the Applicant:
- The trench is downgradient.
On a motion by Ms. Dohan and seconded by Mr. Langseth, the Commission voted 7-0 to issue a
negative determination with conditions.

The applicant is proposing to construct a second story addition above an existing garage within
the 100 foot buffer zone as well as outside of the FEMA Flood Zone. There is no change in
impervious surface area. Stockpiling will occur in the garage, on the driveway or in the front
yard. There is no alteration to the grading/lawn proposed.
Concerns of the Commission:
- If any trees are to be removed.
Response of the Applicant:
- No trees are going to be removed.
On a motion by Ms. Ladd and seconded by Mr. Beuttell, the Commission voted 7-0 to issue a
negative determination with conditions.

Mr. Stephen Herzog, consultant with Wood, Inc. and Mr. Jackson Doughty, project engineer,
presented before the Commission. The applicant is proposing to install a solar carport over the
existing pervious pavement as well as rooftop solar panels. A concrete pad is proposed for the
placement of a battery storage area that is within the 100 foot buffer zone to a bordering
vegetated wetland.
Concerns of the Commission:
- How the concrete footings that secure the solar canopy affect the storm water
management system since it is an increase in impervious surface area.
- How the concrete pillars will be installed.
- Will soil be filled on top of the concrete footings?
- Engineering drainage calculations will need to be completed again because there is about
a net increase of 200 or more square feet of impervious surface area.
- How does this construction impact the tree count and if there are plans to plant additional
trees.
- Was the concrete pad included in the original notice of intent? The Commission asked
that photographs be taken of the concrete pad.
Concerns of the Abutters:
- Will the solar arrays direct light towards abutters? (Jeff Ruberti of 41 School Street and
Mary Donahue of 3 Crosby Road)
- Will the generator or battery cause any noise? (Mary Donahue of 3 Crosby Road)
Response of the Applicant:
- The concrete posts are 36 inches in diameter. There will be 26 posts.
- The concrete pillars will be poured before the pavement is installed. The concrete pillars
will project above ground for safety reasons.
- The applicant has prepared but not submitted a planting plan.
- The concrete pad was included in the original Notice of Intent. The applicant will submit
photographs and will upload the original notice of intent that includes the concrete pad.
- The solar arrays face inwards so there should not be any light reflecting onto abutting
properties nor will there be any noise.
On a motion by Mr. Beuttell and seconded by Mr. Langseth, the Commission voted 7-0 to
continue the hearing from January 27, 2020 until February 10, 2020 at the applicant's request.

presented before the Commission. The applicant is proposing to install a solar carport over the

Concerns of the Commission:
- How the concrete footings affect the storm water system.
- If any trees are going to be removed and replaced.
- Might the excavation of the footings impact contamination of the infiltration system?
Where the spoils go? How the area will be cleaned?
- Describe the trenching of the solar.
Concerns of the Abutters:
- Are there any health concerns? (Joseph Ramos of 15 Pelham Road)
- Are there any lights proposed underneath the solar arrays? (Karen Edmunds of 23 Pelham
Road)
- The size of the solar panel carport arrays, the angles of the solar arrays and fencing of the
solar panels. (Joseph Ramos of 15 Pelham Road)
Response of the Applicant:
- The applicant will respond to the engineering concerns and prepare a planting plan.
- The applicant can install a mat or tarp to collect the materials.
- The solar panels are over 4,000 square feet, will not reflect light and will not be
surrounded by fencing or any barriers.
- The conduit runs have already been pre-laid.
- There are lights proposed under the solar arrays which will automatically turn on and off
in accordance with the Town's light bylaw.
On a motion by Ms. Dohan and seconded by Ms. Samuels the Commission voted 7-0 to continue
the hearing from January 27, 2020 to February 10, 2020 at the applicant's request.
