Issue Order of Conditions: 140 Marrett Road DEP 201-1161 BL 1117 On a motion by Ms. Dohan and seconded by Mr. Beuttell, the Commission voted 6-0 to issue the order of conditions. Request for Certificate of Compliance: 11 Vinebrook Road DEP 1033 BL 991 The request will be heard at a later date. Request for Certificate of Compliance: 145 Grove Street DEP 201-962 BL 920 The request will be heard at a later date. Enforcement Update: 39 Woodpark Circle Mr. Chris Stratford, landscaper for the homeowner, presented before the Commission. An intermittent stream ran through the property in the form of a Swale feature and associated bridge which had been filled/removed. The homeowner had asked the landscaper to remove the bridge and fill in the Swale which he did. The Conservation Department was made aware of the activity and informed the homeowner of the violation. Mr. Stratford proposes to remove the loam and re- grade the yard to re-create a Swale. The banks will be reseeded with a wetland vegetation seed mix. The bridge will not be reconstructed. The Commission asked that monitoring take place. On a motion by Ms. Dohan and seconded by Mr. Langseth, the Commission voted 6-0 to approve the restoration plan. Appoint Conservation Commission member to the Community Preservation Committee to serve the remaining term of the 2-year appointment created by Dick Wolk's resignation; 06/19 to 06/2021 On a motion by Ms. Ladd and seconded by Mr. Beuttell, the Commission voted 6-0 to appoint Mr. Langseth to serve the remaining term of the 2-year appointment created by Mr. Wolk's resignation. Approve Meeting Minutes: 10/1/2019, 10/7/2019 and 10/21/2019 The meeting minutes for October 1, 2019 will be discussed at a later date. On a motion by Ms. Ladd and seconded by Ms. Dohan, the Commission voted 6-0 to approve the meeting minutes from October 7, 2019. On a motion by Ms. Dohan and seconded by Ms. Ladd, the Commission voted 6-0 to approve the meeting minutes from October 21, 2019. Review Site Visit Schedule The site visits will remain scheduled for Saturday, November 30-, 2019. Reports: Bike Advisory, Community Gardens, Community Preservation Committee, Greenway Corridor Committee, Land Acquisition, Land Management, Land Steward Directors, and Tree Committee Ms. Dohan stated that the Greenway Corridor Committee has been discussing a pathway between Concord Avenue and Waltham Street. The GCC wants to get an understanding of how to best pursue this project without burdening the Conservation Commission. Ms. Dohan suggested that the GCC draft a proposal to submit to the Commission. Chairman Hamilton noted that trail building was not listed as a priority by the Land Stewards. 7:00 pm New Public Meetings/Hearings DEP 201-1163 BL 1118 NOI, 91 Hartwell Avenue Applicant: John Cappellano Project: Construction of lab and office building, above ground parking garage and associated infrastructure Documentation Submitted: - MassDEP Notice of Intent Application with attachments - Project Plans entitled "Plans to Accompany the Notice of Intent Application", dated October 29, 2019 - Stormwater Report for 91 Hartwell Ave prepared by Nitsch Engineering, Inc., dated October 29, 2019 - "Notice of Intent Application"prepared by LEC Environmental Consultants, Inc., dated October 29, 2019 - Memo, From Paul Finger Associates, Re: Flood Plain Volume Calculations, dated November 14, 2019 - Plans entitled "91 Hartwell New Building Plans", prepared by Dimella Shaffer, dated November 14, 2019 Mr. Richard Kirby, wetland scientist with LEC Environmental, Mr. Eric Joseph of Paul Finger Associates and Mr. Josh Sorres,project engineer, presented before the Commission. The proposed project is a re-development of a commercial property. The project team has presented conceptual plans before the Commission in the past. Most of the property is in the 10 year floodplain. There are two jurisdictional wetlands on the property. A landscape island with wetland plants will be displaced with the proposed lab building to be replicated elsewhere on the property. A new 4,500 sq. foot lab space and office building is proposed to be constructed on concrete piers that elevate the building above the 100 year floodplain. A parking structure is proposed to provide at grade surface parking comprised of three stories. The primary entrance to the property will now be via Hartwell Place and the Hartwell Avenue entrance will be restricted to loading and emergency access activities. The wetland replication area measures 6,000 square feet which is more than 3:1. With the proposed project, the impervious surface within the 25 foot buffer zone will be reduced by 83%. Concerns of the Commission: --The landscaped stormwater island feature currently located in the parking area may be jurisdictional. --Setbacks. The Commission asked that the structures be removed from the 25 foot buffer zone. --The Stormwater Report shows that the 1 year volume of stormwater that is released from the site is larger than existing conditions. The Commission asked if this volume could be brought into compliance with the town bylaw. --Where employees will be parking during construction. --Potential for constructing a vegetated roof on the new building. --Constructing two large structures on the property given the challenging site. --If the walking bridge between properties would be maintained. --The applicant will still be violating the bylaws by constructing structures within the 50 foot buffer zone. --How this project will impact precedent for future development on Hartwell Avenue. --Need for the applicant to file with the Planning Board before they appear before the Commission again. Responses of the Applicant: Mr. Kirby stated that they treated the potential jurisdictional stormwater island as a wetland by replicating it 3:1 on the property. If the Commission determines the wetland is jurisdictional, Athe applicant will have to request a waiver from the bylaw because they cannot replicate the wetland on the property 2:1. Mr. Cappellano stated that the employees will be parking in neighboring properties. Mr. Joseph stated that they can look into incorporating a vegetated roof. Mr. Kirby stated that they are increasing the amount of open space on the property. Mr. Cappellano stated that they intend to keep the walking bridge. The applicant stated that they can move the building outside the 25 foot buffer zone. On a motion by Mr. Langseth and seconded by Mr. Beuttell, the Commission voted 6-0 to continue the hearing until December 16, 2019 at the applicant's request. 7:47pm DEP XBLX NOI, 6 Moon Hill Road Applicant: Linda Pagani Project: Drainage modifications to approved project Documentation Submitted: - MassDEP Notice of Intent Application with attachments - Plans entitled, "As-Built Plan"prepared by Columbia Design Group, LLC, dated May 28, 2019 - Plans entitled, "Drainage Areas" - Original Notice of Intent Submittal for 6 Moon Hill DEP 201-655 BL 613 - Letter, From Peter Gammie, P.E., Re: Drainage Discussion—Pervious driveway, dated November 16, 2019 - Spreadsheet, Pagani Plant List—as of 2019 - Memo, entitled, "Improvements of Original Conditions of Property" by Linda Pagani - Engineering Memo from Michael Sprague, Engineering Dept. dated November 18, 2019 - Planting Plan for Pagani Residence, dated November 2019 Ms. Linda Pagani, homeowner, presented before the Commission. The original approved project was to construct an addition and driveway as well as wetlands replication. The constructed driveway was constructed as impervious rather than pervious as was approved. Their project engineer, Mr. Peter Gammie, submitted a letter stating that the engineering should accommodate for the mistake since extra trench drains were installed as well as a gravel bed that was constructed deeper than approved in the Order of Conditions. The total impervious area on the project that was approved after construction was decreased to result in a zero net increase in impervious surface area. The wetland vegetation details were submitted. Concerns of the Commission: The Commission needs to receive a positive engineering memo. Responses of the Applicant: The applicant will work with their engineer, the town engineer, and Ms. Mullins to obtain a clean bill of health. On a motion by Ms. Ladd and seconded by Mr. Langseth, the Commission voted 6-0 to continue the hearing until December 2, 2019 at the applicant's request. 8:06pm DEP 201-1164 BL 1119 NOI, 5 Howard Munroe Place Applicant: Stanley Deutsch Project: Ecological restoration project Documentation Submitted: - MassDEP Notice of Intent Application with attachments - "Notice of Intent(NOI) Application"prepared by DeRosa Environmental Consulting, Inc., dated October 29, 2019 - Plan entitled "Back Yard Planting" dated October 10, 2019 Mr. Michael DeRosa of DeRosa Environmental and homeowner, Mr. Stanley Deutsch, presented before the Commission. Mr. DeRosa is proposing invasive species management. They will be removing the phragmites by cutting the standing material, burning it on site, then cutting it as new shoots come up. All other invasive species will be removed using the "whole plant removal" method. The site will be stabilized for the winter. In the spring they propose to conduct the plantings. The lawn which is located within the 50 foot buffer zone will be deemed a"low mow" area. The 25 foot buffer zone is proposed to be planted with shrubs, canopy and perennials. The maintenance of the property will be ongoing, longer than the standard 2 years. Concerns of the Commission: The Commission asked that all proposed cultivars be replaced with true native plants as a condition. Responses of the Applicant: The applicant will accommodate the Commission's requests. On a motion by Mr. Langseth and seconded by Mr. Beuttell, the Commission voted 6-0 to continue the hearing until December 2, 2019 at the applicant's request. 8:15pm DEP 201-1165 BL 1120 NOI, 25 Middleby Road Applicant: Ben Finnegan o/b/o Finnegan Development Project: Raze and rebuild of a single family dwelling Documentation Submitted: - MassDEP Notice of Intent Application with attachments - Stormwater Analysis & Calculations prepared by Meridian Associates, dated October 28, 2019 - "Notice of Intent Application and Wetland Resource Area Analysis"prepared by LEC Environmental Consultants, Inc., dated October 29, 2019 - Plans entitled "Permit Site Plan of Land"prepared by Meridian Associates, dated November 18, 2019 - Engineering Memo from Michael Sprague, Engineering Dept., dated November 8, 2019 Mr. Richard Kirby, wetland scientist with LEC Environmental, Mr. Mike Capachietti, project engineer and Mr. Ben Finnegan presented before the Commission. The applicant is proposing to demolish and rebuild a single family dwelling with portions of the dwelling within the 50 foot buffer zone. A stone wall is proposed to be rebuilt along the 25 foot buffer zone. Per the Commission's request the applicant has provided a table showing the changes in impervious surface area. Concerns of the Commission: The Commission asked that FENO markers be installed before the stone wall is re-constructed as a special condition. The Commission asked if the dwelling could be relocated to be further away from the resource areas. Responses of the Applicant: The applicant was not able to pull the dwelling further away from the wetland due to the grading of the lot. On a motion by Mr. Beuttell and seconded by Ms. Dohan the Commission voted 6-0 to close the hearing. 8:30pm Continued Public Meetings/Hearings DEP 201-1137 BL 1094 NOI Cont. Hearing, 127 North Street Applicant: Ying Chen and Katherine Van Stry o/b/o Bull Realty, LLC Project: Raze and rebuild of a single family dwelling On a motion by Ms. Ladd and seconded by Ms. Dohan, the Commission voted 6-0 to continue the hearing until January 271h, 2020 at the applicant's request. DEP 201-1162 Viewpoint Cloud Record 4: CNOI-19-17 NOI, 0 Hartwell Avenue (Hanscom Field) Applicant: Massport Project: Vegetation Management within wetland resource areas On a motion by Ms. Ladd and seconded by Ms. Dohan, the Commission voted 6-0 to continue the hearing until December 2, 2019 at the applicant's request. DEP 1154 BL 1109 NOI, 4 Tidd Circle Applicant: Maliha Karim Project: Landscaping and construction of a retaining wall at a single family dwelling On a motion by Ms. Dohan and seconded by Mr. Beuttell, the Commission voted 6-0 to continue the hearing until December 2, 2019 at the applicant's request. On a motion by Ms. Dohan and seconded by Ms. Ladd, the Commission voted 6-0 to adjourn the meeting.
