HomeMy WebLinkAbout2275.1-3 Three documents concerning a claim resulting from the death of a horse belonging to William J. Currier, 1851Know all men, that William J. Currier of Lexington in the County of Middlesex and Commonwealth of Massachusetts, and the Inhabitants of said Lexington by their agents Simon W. Robinson, Galen Allen, & Joseph Howe Selectmen of said town of Lexington, duly authorised to act in this behalf by a Vote of said town passed at a meeting held for that purpose legally named & duly assembled on the seventh day of April A.D. 1851, have agreed to submit the demand, a statement whereof is hereto annexed to the determination of Samuel Chandler, John F. Skinner & William Chandler, the award of whom being made and reported within five months from this day to the Court of Common Pleas for the County of Middlesex, the Judgement thereon shall be final; and if either of the parties shall neglect to appear before the Arbitrators, after due notice given them of the time and place appointed for hearing the parties, the arbitrators may proceed in his absence. Currier vs the town of Lexington that the fees of the referees shall be charged to the town - the witnesses to be paid by each party Lexington Augt 8. 1851 Wm. J. Currier Sm. W. Robinson, Galen Allen and Joseph Howe personally appeared and acknowledge the foregoing instrument by them signed to be their free act & did Before me William Chandler Justice Peace The undersigned asks of the inhabitants of the Town of Lexington to pay him the sum of two hundred and twelve dollars for damages sustained owing to a defect in the highways in February last, (17 day) Wm J Currier July 1/51 Augt 1st. 1851 Middlesex ss August 20th 1851 The referees in the case within named having given due notice to the parties named in the foregoing agreement of submis- sion, met them at the Lexington House in said town [missing] Lexington Sept 23 1851 This certifies that we the undersigned have agreed and do hereby agree that in the case of Dr. William J Currier vs the town of Lexington for the loss of a horse referred to Saml Chandler Esq. August 20th 1851 The Referees in the case within named having given the notice to the parties named in the foregoing agreement of submission, met them at the Lexington House in said town of Lexington on friday the second day of August instant, and having heard the allegations and proofs adduced by the parties in said case, and duly considered the same, do award, that the said William J. Currier recover against the said Inhabitants of the town of Lexington the sum of one hundred and seventy dollars, as his damages sustained as aforesaid, and that the costs of Reference be taxed as per. agreement of the parties hereto annexed, the costs of Court to be taxed by the Court.
