HomeMy WebLinkAbout2653 Release for relocation of Waltham Street, Mary Basher to Town of Lexington, April 18, 1912TOWN OF LEXINGTON, MASSACHUSETTS, RELEASE FOR RELOCATION OF WALTHAM STREET. --- WHEREAS, by a decree of the Commissioners of the County of Middlesex, for the relocating of Waltham Street within the Town of Lexington, dated May 4th, 1907, certain lands were taken abutting upon said Waltham Street as it existed before said relocation, and certain damages were awarded to the owners of such abutting lands taken NOW, THEREFORE, I Mary Basher hereby certify that I am entitled under the terms of said decree to the sum of five ($5.00) dollars as damages sustained by reason of said relocating and in con- sideration of the payment to me by the Town of Lexington of said sum of five ($5.00) dollars, the receipt whereof is hereby acknowledged, I do hereby release and forever discharge and agree to indemnify and save harmless the said Town of Lexington and said County of Middlesex from any and all claim or liability whatsoever for or by reason of any damage, loss, injury or cost whatsoever, which heretofore has been or which hereafter may be suffered by me or by those claiming through or under me on account or in consequence of the relocating and widening of said Waltham Street in said town under said decree. AND I, Emma McNear being the holder of a mortgage covering land included in said relocation, do hereby disclaim any claim or demand whatsoever for damages by reason of the taking of said land, or the re- locating of said street, and authorize the payment to the said Mary Basher of said amount allowed as damages.
