Ms. Dohan arrived at this time. Issue Order of Conditions: 33 Hayden Ave, DEP 201-1141, BL 1098 The applicant followed up with the riprap detail that the Commission asked for. On a motion by Ms. Ladd and seconded by Mr. Beuttell, the Commission voted 6-0 to issue the order of conditions. Issue Order of Conditions: 244 Wood St, DEP 201-1120 Ms. Ladd abstained from voting for the filing for 244 Wood Street. On a motion by Mr. Beuttell and seconded by Mr. Wolk, the Commission voted 5-0 to issue the order of conditions under the State Act only. Request for Certificate of Compliance: 17 Oxbow Road DEP 201-1115 BL 1073 The Commission will discuss at a later time. Request for Certificate of Compliance: Penny Lane Lot 7 DEP 201-1058 (partial) On a motion by Ms. Ladd and seconded by Mr. Wolk, the Commission voted 6-0 to issue a partial certificate of compliance pending a site visit by Ms. Mullins. Request for Certificate of Compliance: 6 Milk Street DEP 201-1039 BL 996 On a motion by Mr. Wolk and seconded by Ms. Ladd, the Commission voted 6-0 to issue the certificate of compliance pending a site visit by Ms. Mullins. Request for Certificate of Compliance: Clarke Middle School (17 Stedman Road) DEP 201- 1014, BL 971 The Commission will discuss at a later time. Request for Certificate of Compliance: Diamond Middle School (99 Hancock Street) DEP 201-1013, BL 970 The Commission will discuss at a later time. Request for Certificate of Compliance: Bowman Elementary School (9 Philip Road) DEP 201-1027, BL 985 The Commission will discuss at a later time. 4 Lake Street Restoration Follow Up Mr. Andrew Chan and Ms. Erica Downing presented before the Commission. Ms. Ladd stated that the current landscaping looks good and that the applicant's vegetation management should continue. Acting Chairman Langseth agreed. The Commission clarified that the vegetation management plan was not linked to the Order of Conditions issued in January of 2019. The Commission suggested amending the Order of Conditions to include the vegetation management. On a motion by Mr. Beuttell and seconded by Mr. Wolk, the Commission voted 5-0 to confirm that the applicants are complying with the vegetation management. Approve Meeting Minutes: 4-11-2019, 6-24-2019 The meeting minutes will be discussed at a later date. Review site visit scheduled for July 20, 2019 (meetingon n July 22, 2019) —include 6 Moon Hill Road A survey will be sent out to the Commission to see if an alternative date would be a better option. Reports Chairman Langseth will be attending the Selectboard's Goalsetting meeting on behalf of the Lexington Conservation Commission. 7:00 pm New Public Meetings/Hearings DET 19-23 RDA, 110 Hartwell Avenue Applicant: Boston Gas Company d/b/a National Grid Project: Gas line installation Ms. Gina Vesti on behalf of Boston Gas Company. The Boston Gas Company will be installing a 600 foot linear gas line. The work involves excavating a two foot wide by three foot trench. All disturbed areas will be restored like in kind. Part of the project is exempt from regulations which is the portion of the gas line which is considered a minor project. There will be approx. 143 square feet of temporary impacts to Bordering Land Subject to Flooding and 802 square feet of temporary impacts to the Bordering Vegetated Wetland. Mr. Langseth, Ms. Dohan and Ms. Ladd had visited the site. Mr. Bitsko appreciated the photographic log which showed the gas lines. Mr. Bitsko asked if the trenches would be open overnight. Ms. Vesti stated that no there will be no overnight work. The trench will be opened and closed daily over the course of the project. Mr. Bitsko stated that the Commission will be asking for compost silt sacks. Ms. Mullins and Ms. Vesti clarified that the exempt portion of the project is not exempt under the town bylaw. On a motion by Ms. Ladd and seconded by Mr. Beuttell, the Commission voted 5-0 to issue a negative determination with conditions. Continued Public Meetings/Hearings DEP 4 201-1126 BL 1083 NOI, 6 Blinn Road Applicant: Lauren Dillon Project: Proposed raze and rebuild of a single family dwelling Request for continuance until August 19, 2019 at the applicant's request. On a motion by Mr. Wolk and seconded by Mr. Bitsko,the Commission voted 5-0 to continue the hearing for 6 Blinn Road until August 19, 2019 at the applicant's request. DEP 201-1136 BL 1093 NOI, 5 Brook wood Road Applicant: Marc Saint Louis Project: Construction of a rear addition and front covered porch to an existing single family dwelling Mr. Marc Saint Louis presented before the Commission. Chairman Langseth read the engineering comments into the record. On a motion by Mr. Wolk and seconded by Ms. Ladd, the Commission voted 5-0 to close the hearing. Issue Order of Conditions: 5 Brookwood Rd, DEP 201-1136, BL 1093 (pending final favorable engineering comments and closing of hearing tonight On a motion by Mr. Wolk and seconded by Mr. Beuttell, the Commission voted 5-0 to issue the order of conditions. DEP 201-1039 BL 1096 NOI, 7 Kirtland Street Applicant: United States Army Corps of Engineers Project: New parking lot construction Mr. Ladd recused herself. Scott Sheehan presented before the Commission. Mr. Sheehan read a letter that was submitted to the Conservation Commission before the meeting. The letter reiterated that the Lexington Conservation Commission has limited jurisdiction over the conservation filing and laid out several options for moving forward. The Commission discussed the options laid out by Mr. Sheehan about how to best handle permitting the project procedurally. The Commission determined that the best option procedurally was to issue the order of conditions under the state act and not the Lexington town bylaws. Mr. Sheehan requested to withdraw the notice of intent application under the Lexington Town Bylaw while keeping the application filed under the State Act. On a motion by Mr. Beuttell and seconded by Mr. Wolk, the Commission voted 4-0 to close the hearing. DEP 201-968 BL 926 Amendment to an Order of Conditions, Rangeway Extension and SFH Lot Applicant: Suzanne Raymond Project: Construction of a roadway, retaining wall and single family dwelling Request for continuance until July 22, 2019 at the applicant's request. On a motion by Mr. Wolk and seconded by Mr. Beuttell, the Commission voted 5-0 to continue the hearing until July 22, 2019 at the applicant's request. DEP 201-1137 BL 1094 NOI, 127 North Street Applicant: Ying Chen and Katherine Van Stry o/b/o Bull Realty, LLC Project: Raze and rebuild of a single family dwelling On a motion by Mr. Beuttell Ms. Dohan, the Commission voted 5-0 to continue the hearing until July 22, 2019 at the applicant's request. DEP 201-XXXX BL XXXX NOI, 758 Marrett Road Applicant: Minuteman Vocational High School Project: Construction of synthetic tuft athletic fields Request for continuance until July 22, 2019 at the applicant's request. On a motion by Ms. Ladd and seconded by Mr. Beuttell, the Commission voted 5-0 to continue the hearing until July 22, 2019 at the applicant's request. On a motion by Mr. Ladd and seconded by Mr. Beuttell, the Commission voted 5-0 to adjourn the meeting.
