Mr. Rich Kirby presented before the Commission for raze and rebuild of a single family dwelling. The existing house is 93 feet from the wetland boundary. The proposed house is slightly larger than the existing dwelling but the project will be reducing impervious area by about 10%. Impervious area will be reduced in the buffer zone by 10%. An infiltration system is proposed in the southwest corner of the house where all stormwater runoff will be directed. A trench drain is located in the driveway. Mr. Langseth inquired about the possible directions of waterflow. Mr. Kirby stated that they will review the proposed Swale. An abutter, Mr. Der Avedisian, located at 481 Lowell Street, asked what happens when the stormwater management system fails. Mr. Der Avedisian stated that the neighboring properties which were recently developed all installed infiltration systems which failed over the first year of occupancy. The infiltration systems were removed over time. The current owners use sump pumps. The abutter stated that the property owners presented before a Lexington board or committee. The water at the surrounding addresses flow onto his driveway. Mr. Kirby stated that since this specific property had to present before the Conservation Commission, this specific infiltration system had to abide by the Town of Lexington stormwater standards which has been approved by the Town's engineering department. The Commission asked the Conservation Department to investigate the area. On a motion by Mr. Beuttell and seconded by Ms. Dohan, the Commission voted 5-0 to close the hearing. 7:16pm DEP 201-1131 BL 1088 NOI, 39 Sherburne Road Applicant: Leyne & Shannon, Inc. Project: Raze and Rebuild of a single family dwelling within the 100-foot Buffer Zone Documents Received: NOI application/plans/drainage (4-3-2019), Engineering Memo (4/11/2019) Mr. Brendan Leyne presented before the Commission. Mr. Leyne was before the Commission as a requirement to file a new notice of intent for the changes during construction at 39 Sherburne Road. The new notice of intent is based on the final as-built plot plan. Mr. Leyne stated that as a result of the changes a larger infiltration system was installed. Chairman Hamilton reminded the applicant that if a future owner wishes to add another or different sump pump, they will need to come before the Commission. This should be explicitly stated in the Order of Conditions because the infiltration system cannot handle a larger sump pump than the existing one. On a motion by Mr. Langseth and seconded by Mr. Beuttell, the Commission voted 5-0 to close the hearing. 7:25pm DEP 201-1130 BL 1087 NOI, 140 Marrett Road Applicant: The Manuel Baptise Estate Project: Removal of fill within the 100 foot buffer zone and 200 foot riverfront area Documents Received: NOI application/plans/stream stats (4-3-2019) Mr. Rich Kirby presented before the Commission. Ms. Marion O'Shaughessy, the property owner was in attendance. Mr. Kirby stated that over the last few years the home owner and her relatives have been storing and dumping fill onto the property, specifically on the rear lot of 140 Marrett Road. 140 Marrett Road directly abuts wetlands which are delineated along the property lines. The lot additionally comes within the 200 foot riverfront area. The two resource area delineations encapsulate most of the rear lot of 140 Marrett Road. Mr. Kirby stated that the applicant is proposing to remove all fill and debris that has collected on the property over time with the remaining exposed areas to be restored. The restoration project will use conservation wildlife mix and New England wildflower mix. Closer to the wetland they will plant New England Wetland seed mix in addition to erosion control seed mix. Blueberry bushes are proposed to be planted on the wetland border. Mr. Beuttell inquired whether FENO markers should be placed. Mr. Kirby agreed that some sort of monument may be a good idea however the property was recently surveyed. The Commission discussed the possibility of installing 6 or so boulders along the 25 foot no disturb zone. Chairman Hamilton asked that after the wetlands are cleared of the dumped soil that the wetland be re-delineated in the area where the fill was in or adjacent to the wetland. On a motion by Mr. Langseth and seconded by Mr. Beuttell, the Commission voted 5-0 to close the hearing. Continued Public Hearings DEP 201-1120 BL 1076 NOI, 244 Wood Street Applicant: MIT Lincoln Labs Project: Proposed electrical building modifications within the 100 foot buffer zone Previous Hearings: 1-7-2019, 1-28-2019, 2-11-2019, 2-25-2019, 3-11-2019, 3-25-2019, 4-8- 2019 *Request to continue to Monday, 4/29/19 at 7:00 PM On a motion made by Mr. Wolk and seconded by Ms. Dohan, the Commission voted 5-0 to continue the hearing until April 29, 2019. DEP 4 201-XXXX BL NOI, 758 Marrett Road Applicant: Minuteman Vocational High School Project: Construction of athletic complex with synthetic tuft athletic fields within the 100-foot Buffer Zone Previous Meeting: 2-25-2019, 3-25-2019, 4-8-2019 *Request to continue to Monday, 4/29/19 at 7:00 PM On a motion made by Mr. Wolk and seconded by Mr. Beuttell, the Commission voted 5-0 to continue the hearing until April 29, 2019.
