Labor Relations and Personnel Management Having jumped into the middle of a major year for management of labor relations and personnel matters, you demonstrated a balanced and effective approach to multiple contract negotiations and worked to advance the Town’s compensation philosophy. Maintaining a strong focus on expectations, accountability, and performance will remain essential as the Town continues to invest in its workforce. The proposed manager, Yarissa Martinez, has submitted a current Alcohol Awareness Training Certificate and the required CORI check has been completed. The purpose of the compliance checks is to ensure that establishments who hold liquor licenses obey the laws pertaining to the sale/service of alcohol. 26 of the establishments were in compliance, 1 was found in violation. On December 16, 2025, the following establishment was found in violation of serving a minor during the compliance check. Upper Crust 41 Waltham Street Detective Hankins also informed the Upper Crust that the establishment should have a warning sign posted advising of the legal drinking age/that they ID patrons for the purchase of alcohol. Attached is a copy of the Select Board's Regulation regarding Alcoholic Beverages Enforcement. In accordance with this regulation, a written warning will be sent to each of the above establishments informing them of the actions that need to be taken regarding the liquor license violations found as a result of the December 2025 compliance checks conducted by the Lexington Police Department. The Board is being asked to approve the letter to be sent to this establishment. Lexington Police Officers advised the staff member of the incident that occurred at Upper Crust and that there would be a follow up from the Select Board to the incident. Additionally, they were informed that the establishment did not have the required warning sign posted advising of the legal drinking age or that they ID patron for the purchase of alcohol. Sale or delivery of alcohol to underage persons is a violation of Massachusetts General Laws and the Lexington Alcohol Licensing Board. See enclosed copy of the Alcoholic Beverages Enforcement Regulation. The following course of action will be taken upon violations occurring within 3 years: 1st offense – written warning placed in the licensing file and required training for personnel; 2nd offense – hearing before the Select Board to determine action, including suspension and revocation of license. Extenuating circumstances may necessitate more serious consequences on any violations. For your 1st offense you must have all bartenders, servers and managers trained/retrained using a recognized alcohol awareness training organization such as TIPS or SafeServe. You must provide the Select Board Office, by February 6, 2026, with a list of all the bartenders, servers and managers trained along, with a copy of the new training certificate(s) for each. If there is a second violation of any kind within 3 years, Upper Crust will be required to have a hearing before the Select Board to discuss the consequences. Additionally, the Upper Crust needs to contact the ABCC at (617)727-3040 to obtain the required signage. The poster must be displayed in a conspicuous place within the establishment, readily visible to the public. PURPOSE AND SCOPE The Board of Selectmen is duly authorized by statute to issue and to regulate alcoholic beverage licenses. As a result, the Board of Selectmen is the primary enforcement agency for compliance with ABCC, and town regulations governing alcohol. The Police Department also conducts compliance checks on all establishments that hold alcohol beverage licenses. The purpose of enforcement is not punitive, but for education and to ensure these regulations are consistently followed and applied. It is in the community’s best interest for all to understand the benefits of complying with the laws governing alcohol. II. APPLICATION 1. The licensee is responsible, whether present or not, for ensuring that no disorder, disturbance, or illegality takes place in or on a licensed premises. 2. Violations may include, but not be limited to, service to an underage person, sale or delivery to intoxicated persons, use of narcotics on the premises, gambling, failure to meet any of the terms of the regulations of the Board of Selectmen. 3. Periodically, the police conduct stings and checks at licensed locations for compliance. When checks take place, the police shall use the guidelines from the ABCC for compliance checks. 4. The following course of action will be taken upon violations occurring within 3 years: 1st offense – written warning placed in the licensing file and required training for personnel involved; 2nd offense – hearing before the Board of Selectmen to determine action including suspension and revocation of license. Circumstances may necessitate more serious consequences on any violations. 5. Violations of other rules and regulations will be brought to the attention of the Board of Selectmen who shall determine whether or not a hearing is necessary. In most cases, a hearing will be held to determine what, if any, action should be taken. 6. All violations and complaints received about licensed establishments shall be in writing and placed in the file of the licensee. 7. At the time of license renewal and/or changes to the license, the Board of Selectmen will be made aware of any violations or complaints in the last three years and may use that as a basis for action on the license renewal or change. 8. Upon notice of violations or complaints, the license holder shall provide to the Board of Selectmen evidence of steps taken to address the violation or of mitigating circumstances. Failure to respond could result in revocation or suspension of liquor license. Information provided to the Board shall be placed in the licensee’s file and may be considered as a basis for action on the license renewal or change. 9. The license holder has the right to appeal any decision of the Board of Selectmen within five (5) days of the decision to ABCC. III. BACKGROUND When violations occur to the rules and regulations regarding alcohol license, it is the Board of Selectmen who is ultimately responsible for enforcing the regulations in conjunction with the Police Department. This enforcement policy is intended to provide guidance to all licensees of their obligations and the consequences for not following applicable laws and regulations. IV. REFERENCE Adopted by the Board of Selectmen October 4, 2004. This regulation was amended by the Board of Selectmen on March 15, 2010. ITEMS FOR INDIVIDUAL CONSIDERATION 1. Public Hearing: FY2026 Water and Sewer Rates Carolyn Kosnoff, Assistant Town Manager Finance, presented the proposed Water and Wastewater rates for Fiscal Year 2026, along with supporting information. This item also serves as the public hearing on the Water and Wastewater rates for FY2026 ahead of the Board’s final vote which is expected on November 3, 2025. Mr. Lucente asked about potentially reviewing and adjusting the tiers to create more incentives. He would like to encourage lower usage of water. He would also like to examine the irrigation rate in order to promote less usage. He asked about potential senior or low-income relief programs through the current enterprise structure. Ms. Kosnoff explained that there is money in the current year’s budget for completing a water and sewer rate study which is intended to accomplish a potential adjustment of the tiers. Also, the Town is interested in moving to a quarterly billing system and the analysis would take this into account. A bid for the study will be put out early in the calendar year, with the hope of it being completed in the spring. Ms. Hai closed the public hearing at 11:36AM. Update: Lexington Housing Goals  Lexington Housing Partnership Board Priorities and Strategies  Lexington Affordable Housing Trust Proposed FY2026 Goals Ms. Hai stated that the Board will review and discuss the Town’s housing goals and priorities. Wendy Manz, Chair Lexington Housing Partnership Board (HPB), presented the HPB's current working document on Housing Priorities and Strategies, as part of its charge to advise the Select Board on developing a coherent housing policy and strategy for Lexington and in its efforts to coordinate the efforts of the Town’s various housing-related entities, as requested at the housing summit, to implement supporting strategies that advance affordable and diverse housing opportunities. Ms. Manz stated that the HPB identified six priority areas. The first is mixed use development in Lexington Center. The second is to continue to work to create smaller, less expensive types of housing throughout Town. The next is to increase the actual number of subsidized housing inventory units. The fourth item is to preserve more existing homes that are 2,000 s.f. or less. The fifth is to expand funding sources for subsidized housing. The last is to devote considerable attention to going into the community and building support for the idea of housing as a Town need and a Town project. Mr. Lucente encouraged the HPB to review a strategy that focuses on a couple of specific topics. Some of the timelines and targets may need to be considered. Mr. Pato stated that he would like to see a clear reference in the HPB’s materials to the housing development that is emerging in the private sector through the MBTA Communities Act. It is helpful in working with private sector development to try to make sure that the breadth of housing types creates opportunities for a wide demographic. Michael Schanbacher, Chair of the Planning Board, stated that the Planning Board has not yet discussed this report. At various times, the Board has discussed a few of the items in the report and have recommended some of them to Town Meeting. He invited the HPB to discuss these goals with the entire Planning Board at a future meeting to get any relevant feedback. Elaine Tung, Chair of the Lexington Affordable Housing Trust (AHT), presented the AHT's Proposed FY2026 Goals, detailing the Trust’s strategic objectives and planned actions for the upcoming fiscal year in support of the Town’s broader housing vision. The AHT respectfully requests Select Board approval of the AHT FY2026 Goals. This discussion is intended to align the Town’s housing-related boards and the Select Board on shared goals, priorities, and approaches for the coming year. Ms. Tung stated that a primary AHT goal is the creation of affordable housing. AHT will continue to actively support the 100% affordable housing development on Lowell Street. AHT is in negotiations with MBTA multifamily developers regarding the buy down of additional affordable units, as well as deeper affordability of units. The AHT strongly supports zoning changes for the construction of accessory dwelling units (ADUs) by-right to comply at a minimum with State law. The AHT will encourage housing partners to develop ADUs with permanent affordable housing restrictions. The AHT will continue to support LexHAB and Lexington Housing Authority development opportunities where appropriate and feasible. The AHT will continue to assess creative options to increase additional affordable housing opportunities. The AHT will work on developing a housing assistance program for tenants and/or homeowners and is considering a pilot tenant rental assistance program to help those lower income households that need financial assistance. A stable funding commitment from the Town is vital to support the efforts of the Lexington Housing Authority, LexHAB, and the AHT. The Trust will continue to seek outside funding sources, but funding needs to start at the Town level. Carrying a long-term funding commitment, along with data driven insight into the housing needs of current and future Lexingtonians, will help the Trust to optimize precious Trust and Town resources. Mr. Lucente stated that he would like to better understand the operational capacity that the Town realistically has in order to stay aligned under this goal. Mr. Pato stated that these are laudable goals and ones he would like the Town to pursue. It would be nice to include detailed projections of the goals. Measurable progress points are important, and it may be important to establish priorities amongst and within the goals. Mr. Sandeen stated that he is interested in goals that address concerns regarding the headwinds at the federal level, in terms of pushing people out of their homes. Ms. Hai asked about a coordinated plan with staff-driven opportunities and programming. She asked if some of the bullets and sub bullets may be more appropriately led by internal staff, with support from the AHT. She suggested that the funding going into direct service should be included in the plan. Ms. Tung stated that a strategic plan is needed in order to obtain data. Melinda Walker, 14 Larchmont Lane, stated that it is common practice in communities with housing trusts that the trusts invest in rental assistance programs separately from the Human Services departments in that town. Also, there are several towns that use CPC funding to set up rental assistance programs in collaboration with organizations such as the Regional Housing Services Office and other community development corporations. She asked that the Select Board see the adoption of the housing goals and strategies as an opportunity to show leadership in response to the growing houses housing crisis in the Commonwealth. Jay Luker, 26 Rindge Avenue, asked about the Housing Partnership Board’s memo’s relationship with Chapter 2 of the Comprehensive Plan. There may be many types of homeowners in Town who are having challenges staying in their homes, not just seniors or those on fixed incomes. Many of those people do not expect assistance from the Town in order to stay in their homes and he would like to make sure there are not different classes of homeowners who need help being created. Ms. Hai noted that there is a certification program through the AARP that trains and certifies builders to make specific accommodations. This was discussed potentially under the Housing Partnership Board goals, as opposed to direct assistance. Mr. Sandeen stated that the Select Board formed the AHT to enhance the Town's ability to address the Select Board's highest priority goal at the time, which was creating affordable housing. Creating new affordable housing certainly should be the primary goal of the AHT but he also recommends the Select Board recognize that changes at the federal level will have a severe impact on the ability of people to stay in their homes. He suggested that the Board approve the goal to allow the AHT to continue working on a pilot program that would address the gaps being seen to exist at the federal level. Mr. Lucente stated that this is the first time the Board has heard about the pilot program and the potential funding for it. He would like for a program developed under these goals to come back before the Board for review. Mr. Bartha stated that he would like to know more about the sequencing of the goals in order for staff to be appropriately involved. Bob Pressman, 33 Locust Avenue, stated that on May 11, 2026, it will have been 15 years since the Committee appointed by the Board put forth options for the Vine Street property. With Town Meeting having authorized an RFP, he hopes that the Select Board will see that there is an RFP and one which allows units commensurate with current need. Ms. Hai asked if the Board is in favor of supporting the goals as written to increase affordable housing opportunities, with high level strategies under it, including, assessing, securing, supporting, and assisting current and future Lexington residents, and maintaining housing. Along with exploring a pilot for a Housing Assistance Program. The Board agreed to approve the goals as stated at the high level and the large sub bullets, but not the minor sub bullets. Special Town Meeting - Presentation 2025-2 - Article 7: Accept General Laws, Chapter 59, Section 5, Clause 22L (Hero Act) Karen Tyler, Veterans Services District Director, reviewed the Hero Act legislation. It expands local options for tax relief for qualified disabled veterans. The Act introduced two new local options under Mass General Law. The request is for the adoption of Clause 22I, which would tie the exemption to ongoing inflation adjustments, the minimal fiscal impact on the Town, and consistency with COLA adjustments already in place for elderly exemptions. These roadways are Willard Circle, Stage Coach Road and Cart Path Lane. Willard Circle is a subdivision roadway that was recently constructed to town standards and inspected by the Engineering Division. It was previously approved a subdivision through the Planning Board. There is no betterment as it went through the subdivision process, the roadway was completed and acceptance was requested while the roadway is still up to town standards including the condition. Since there is no betterment requested, there is no fee charged to direct abutters and therefore no property liens. In this case the developer holds the rights (fee interest) in the right-of-way and those will be transferred to the town upon acceptance. Stage Coach Road and Cart Path Lane are subdivision roadways as well that were recently constructed to town standards and inspected by the Engineering Division. These are part of the Lexington Hills subdivision. It was previously approved a subdivision through the Planning Board. There is no betterment as it went through the subdivision process, roadways were completed and acceptance was requested while the roadways are still up to town standards including the condition. Since there is no betterment requested, there is no fee charged to direct abutters and therefore no property liens. In this case the developer did not retain the rights (fee interest) in the right-of-way and those rights are therefore transferred to the direct abutters. This fee interest will be transferred to the town upon acceptance. A few points of note; • The two practices noted above are common in the transfer of fee interest • Neither roadway needs a betterment and therefore we do not expect any concerns from direct abutters as they do not have a forthcoming fee or lien applied to their property. • Since there is no betterment, we do not anticipate no concerns or resistance. Therefore, we are proposing to streamline the pre town meeting SB meetings from three to two. For those familiar with the timeline, you will see those merged in items 3 of the street acceptance timeline (this was confirmed as statutorily compliant through town counsel). • Upon completion of street acceptance these roadways will be added to the MassDOT database that tracks miles of accepted roadway and positively impact our annual funding from the state. • The acceptance is abutter driven which is the preferred process for bringing roadways to acceptance. • No physical work is needed on the roadways • No funding is being requested from Town Meeting TIME SEQUENCE FOR FY27 STREET ACCEPTANCE 1. Axtell This memorandum summarizes the Board’s policy options—as discussed at the December 8 Select Board meeting—in preparation for setting the rate for the community housing surcharge on January 5, 2026, as required by Chapter 378 of the Acts of 2024, An Act Establishing a Surcharge on Specific Commercial Development Activities for the Purpose of Funding the Creation of Community Housing. The purpose of the legislation was to mitigate (through impact fees) the increased affordable housing demand in Lexington for employees of new businesses (as a result of new commercial development). The mitigation must establish a “rational nexus” between the public interest the mitigation seeks to address (e.g., housing demand) and the development seeking permits—in this case, new commercial development. The required Nexus Study (presented to the board on December 8, 2025) established the nexus between the projected demand for new affordable housing in Lexington that would likely arise from new commercial development in Lexington. Two key policy decisions for the board to make are: when to implement the surcharge and at what initial rate. Staff is recommending that the surcharge be implemented July 1, 2027, to allow adequate time (a) to develop and adopt a formal policy and (b) to communicate said policy to the development community, staff, and board/committees. Staff recommend that the board establish an initial rate of $4.50 per SF, which is at the lower end of what Mr. Seidman proposed as a reasonable range. This recommendation is based on three factors. 1. We are experiencing a significant slowdown in commercial development in Lexington, which is crucial to our fiscal stability, and any new fee, no matter the size, has the potential to delay recovery from the slowdown. 2. The commercial tax rate in Lexington (shifted the full 1.75) is higher than many of the neighbors we compete with for commercial development, and the fee under consideration isn’t the only added cost on commercial properties/projects in Lexington. 2 3. Related to the first two, our Economic Development team regularly hears from brokers and businesses that Lexington is viewed as a “high cost” jurisdiction, so it’s important we’re sensitive when considering increases the cost to do business here. Timing of surcharge: Upon the receipt of a building permit application for commercial development, the Building Commissioner will certify the area in excess of 30,000 SF of new commercial construction or addition (as specified in the legislation), and the Building Commissioner will calculate and levy the fee. Collection of Surcharge; Per Section 5 of the legislation, the surcharge must be paid in three equal installments: the first due prior to the issuance of the Certificate of Occupancy; the remaining two due on the first and second anniversaries of the first. The first installment must be paid prior to the issuance of a Certificate of Occupancy. It appears the petitioner who brought this forward originally modeled the collection language on Sommerville’s program; unfortunately, it is very difficult to collect fees once a C.O. is issued. The board may wish to consider filing an amendment in the future modeled on Boston’s program, which requires 50% of the fee to be paid when a building permit is issued and 50% prior to issuance of a C.O. In the meantime, staff has confirmed with counsel that a viable alternative (consistent with the legislation) would be to require the first payment and a payment bond for the second and third payments prior to issuance of a C.O. and encourage developers to pay in full at that time to avoid the carrying cost associated with a payment bond. Deposit to Trust: The surcharge fees collected will be deposited in the Affordable Housing Trust account, as specified in the legislation. Annual adjustment of rate: The surcharge shall be adjusted [up or down] each year as part of the annual Tax Classification hearing (in November) using the Consumer Price Index (CPI)* for the prior September to September period, to be effective each following July 1. Annual reporting: Town staff will report annually on the impact of the fees: specifically, 1) list of development projects subjected to the surcharge over the course of the prior year, 2) the community housing surcharge fees collected, and 3) activities supported by the Affordable Housing Trust during that 12-month period. Nexus study updates: As required by the legislation, the Nexus Study will be updated every five to seven years. As the surcharge revenue is being deposited in the Affordable Housing Trust, we recommend that the cost to prepare the periodic updates to the Nexus Study also be paid from the Affordable Housing Trust. 3 Advance notice: The Select Board intends a (minimum) 1-year advance notice period prior to the initial effective date for levying the community housing surcharge, during which the program will be announced to prepare the development community and Lexington’s commercial property owners of the new surcharge. Conclusion. This summary of the legislation, and the Board’s related December 16 decision points, should support the Board’s January 5 planned vote to set the dollar amount for the community housing surcharge. Once the board votes on the parameters of the program, staff will look forward to refining the policy and engaging with all impacted stakeholders to ensure a smooth and effective rollout. The HPB had had an opportunity to review the full report from Karl F. Seidman Consulting Services, as well as the slide presentation made by Mr. Seidman to the Select Board on December 8. After considering various alternative scenarios, the Board voted: 1. To convey to the Select Board its support for establishing linkage fees on commercial development in Lexington; 2. To recommend that a linkage fee rate of 10% ($9.21) per square foot be set; and 3. To recommend that the fee should be established and implemented as soon as possible, but in any case, no later than the beginning of the 2027 Fiscal Year (July 1, 2026). In reaching these conclusions, the HPB considered the pressing need for more, and more diverse, housing in Lexington, and the need for continuing funding sources for the Affordable Housing Trust, even while acknowledging that this potential income stream, while helpful, would not come near to closing the current funding gap. While several members favored a higher linkage fee (and one member favored a lower one), the consensus was that 10% was recommended by the consultant as having a minimal effect on the returns to commercial developers, and unlikely to discourage further commercial development in town. Noting that Watertown’s linkage fee was between 10 and 15%, the HPB chose a rate that would not stand out as higher than those of comparable towns. The HPB recognized that given the current overcapacity for office and lab space in Lexington, applications for commercial development in the next two to five years are likely to be few. However, the HPB felt that it is important to establish the linkage fee rate before demand for development rises again, to allow the fees to be “baked into the cake” of land prices so that developers can make more accurate calculations of costs and ultimate returns without unnecessary uncertainty on this issue. The HPB appreciates the opportunity to consider these issues and to offer its thinking to the Select Board prior to your vote on January 5, 2026. M E M O R A N D U M To: Select Board From: Elaine Tung, Chair Affordable Housing Trust Date: December 30, 2025 RE: Non-residential Development Surcharge for Affordable Housing The Affordable Housing Trust met on December 17, 2025 and discussed the Lexington Non- Residential Nexus Study dated October 7, 2025 by Karl F. Seidman Consulting Services/ConsultEcon, Inc. (the “Nexus Study”). By a vote of 5-0, the Trust recommends that the Select Board adopt the following in line with the recommendations made in the Nexus Study: 1) A housing contribution fee rate of $9.21 per square foot. The potential rent increase to commercial tenants as a result of this fee allows Lexington to retain its sizeable rent advantage over Boston and Cambridge locations. Page 46 of the Nexus Study states that fee levels below $13.81 would have a modest rent impact and could allow Lexington to remain a competitive location with other inner suburbs and MassPike/128 locations based on the Town’s other assets. Page 48 of the Nexus Study also notes that the $9.21 contribution rate reduces returns by less than 50 basis points which allows investors to maintain returns close to their target. 2) Set the housing contribution fee rate to take effect as of the date of the Select Board’s vote in January 2026. Timing the market is difficult and risks a lost opportunity. Developers need certainty for decision making and project viability. 3) Set the housing contribution fee rate implementation date to no later than July 1, 2026 in the event Town staff needs time to fully implement the housing contribution fee rate. The Affordable Housing Trust’s primary source of funds is from Community Preservation Act (“CPA”) funds. The Trust needs an ongoing, consistent, and reliable revenue stream in order to support the creation and preservation of affordable housing and to provide a greater diversity of housing choices in Lexington. The Trust appreciates the Select Board’s support and welcomes any additional funding sources besides CPA funds in order to accomplish these goals. Thank you for your consideration.
