HomeMy WebLinkAbout1962-03-05-BOS-min G1 SEL`CREN'S '�,ETING March 5, 1962 A regular meeting of toe Board of Selectmen was held in the Selectmen' s Room, Town Office Building, March 5, 1962, at 7:30 P.M. Chairman Morey, Messrs . Ferguson, Richards and Cole were present . Mr . S*aples, Executive Assistant, and Miss Murray, Executive Clerk, and Mn . Carroll, Superintendent of Public Works, were also present . Mr . James J. Carroll, Town Clerk, met with the Board for the drawing of three jurors . The following individuals Were drawn for jury duty; George C . Gates, Jurors 17 Wheeler Road; Raymond H. Atwood, 17 Fairlawn Lane ; Forrest K. Marcy, 167 Cedar Street . Mr . Carroll retired at 7:45 P.M. Mr . Carroll presented a plan showing proposed street numbers on Emerson Road. He stated that one section of the road has been constructed in the Burnham Farms area . The Grove Sfreet subdivision, for which building permits Numbering have been issued, is another section and there is the Emerson Roac Maloney subdivision on Maple Street He said there should be a numbering system on Emerson Road from Route 2 to the Grove Street subdivision and he has started 1 at Route 2 going to 370 at Grove Street . He exrlained that this will necessitate changing some street numbers in the Burnham Farm section and will pose some problem as to whether or not letters should be used to designate the various sections . Upon motion duly made and seconded, it was voted to use street block numbers, Mr. Carroll to notify those people whose present street numbers will be changed. Mr. Carroll mentioned a previous discussion rela- tive to lighting Worthen Road, and the annual charge was $3100 a year with underground connected concrete Lighting posts He felt that the cost to light just one street Worthen Roac was excessive and. contacted the Boston Edison relative to the possibility of butting the underground posts every three hundred feet instead of every 150 feet . This would reduce the cost to about $1500. Upon motion duly made and seconded, it was voted to authorize Mr. Carroll to make arrangements for the installation of 11,000 lumen lamps three hundred feet apart . ry�ry� ptirsi Notice was received from the MDC with a statement indicating the amount of water sold all municipalities and the revenue -^eceived during the previous calendar year. Letter was received from the Division of Waterways giving notice that a hearing will be held on Thursday, March 15, 1962, at 10:30 A .M. , 100 Nashua Street, for =Hearing all parties interested in petitions for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, etc. Upon motion duly made and seconded, it was voted to petition the Department of Public Works to deepen and widen Kiln Brook from the northwest side of Route 128 to the Shawsheen River in Bedford, approximately Kiln Brook 4500 feet. The cost is estimated to be X60,000 .00. Mr . Carroll suggested that a copy of thenotice of the hearing be sent to Mr. John W. Kastler, Plant Manager, Itek Corporation. Letter was received from Mr. John A. Beilizia relative to draining Tophet Swamp below the Pine Meadows Country Club. It was agreed to advise Mr . Bellizia that the Board executed a petition to the Department of Public Works requesting the deepening and widening of Kiln Brook from Beilizia the northwest side of Route 128 to the Shawsheen River Drainage in Bedford; approximately 4500 feet, and also to send him a copy of the notice of the hearing to be held at the Division of Waterways on March 15, 1962. Letter was received from Mr. Richard Herzog stating Whipple Hill that vandals have destroyed the bench on top of Whipple Hill . It was agreed to acknowledge the letter and tell Mr. Herzog that appropriate action will be taken when the weather permits . Letter was received fronMr. Mitchell Spiris relative Sidewalk to plowing side wa ks on Bloomfield Street . plowing Upon motion dimly made and seconded, it was voted to authorize Mr. Caroll to have the sidewalk on one side of Bloomfield Street plowed. Letter was received from A. Schofield Corporation, re- Questing permission to move a house from 404 BedfordStreet to the Bedford Town Line via Hartwell Avenue and Maguire Road . Mr . Carroll said that insofar as he war able to dete - mine , there would be no problem. } • • Upon motion duly made and seconded, it wa;: voted to grant the request subject to the usual conditions . Mr . Carroll retired 8 : 15 P.M. Letter was received from Mr. Thomas W. Kelly, 31 Fairbanks Road, relative to a law or building code requir- ing swimming pools to be fenced. Mr. Richards reported that the only thing available is a copy of a bill introduced in the 1960 and 1961 sessions of the legislature and both times no action was taken. He said what Mr . Kelly wants would have to be an amendment to the Building Code . The Chairman read a letter from the Middlesex County Commissioners explaining the increase in assess- ment for the maintenance , care and operation of the Sanatorium Middlesex County Sanatorium for the year 1961 . assessment Letter was received from the Lexington Arts and Crafts Society, Inc . , submitting two nominations for associate members to the Historic Districts Commission. Nominations No action to be taken until nominations are re- to Historic ceived from the Lexington Historical Society. Dist . Comm. A Certificate of Incorporation, on behalfof Peter C . Fritsch, 48 Turning Mill Road, et als, was signed Cert . of Inc by the Board, satisfactory character references having been received from the Chief of Police . Upon motion duly made and seconded, it was voted to grant a Taxi Driver ' s license to Melvin R. Peterson, 1105 Lexington Street, Waltham; satisfactory character Taxi license • reference having been received from the Chief of Police . Upon motion duly made and seconded, it was voted to abate the following 1957 ambulance bill= totaling $52 .00; #79, DeWolfe ; #90, DiNapole ; #264, Donovan and #280, Yeomans . Upon motion duly made and seconded, it was voted • Abatements to abate the following 1958 ambulance bills totaling 345.00 : #, 38, Patterson; #55, Markham; #67, McDonald; #72, Thornton; #89, James and #203, Chaisson. r Mr. Stevens arrived at the meeting at 8:45 P.M. The Chairman read a letter froriJoseph J. Volante , Dated March 5, 1962, demanding thatthe two legal questions raised in his letters dated February 17 to the Board of Appeals and Town Counsel be referred to the Town Counsel for rulings . He also asked for a definition of Section 14 (f) of the Zoning By-Law. It was egreed to advise Yr . Volante that the Selectmen have no authority over the procedures and the decisions of the Board of Appeals and if he is aggrieved by any decision of that Board, he bas statutory right of appeal; that it is not the function of the Board of Selectmen to interpret the Zoning By-Law.
