HomeMy WebLinkAbout2018-11-14 BOS-min November 14, 2018 Page 1 of 3 SELECTMEN'S MEETING Wednesday, November 14, 2018 A meeting of the Lexington Board of Selectmen was convened at 6:35 p.m. on Wednesday, November 14, 2018 in the Selectmen's Meeting Room of the Town Office Building. Present were Selectmen Ms. Barry, Chair; Mr. Pato; Ms. Ciccolo; Mr. Lucente; and Ms. Hai as well as Mr. Malloy, Town Manager; Ms. Axtell, Assistant Town Manager; and Ms. Siebert, Recording Secretary. Selectmen Concerns and Liaison Reports Ms. Hai reported that the Opening Reception for a new show of 3-D works at the Munroe Center for the Arts will take place this Saturday, November 17, 2018 from 3-7 p.m. The exhibit will also be open Monday-Friday, 9:00 a.m.-5:00 p.m. Also, the Munroe Center's Winter Session begins January 7, 2019; registration opens this week. Finally, tickets for the Lexington School of Ballet and Dance Holiday Show are now on sale. Information is available on the Munroe Center for the Arts website. Town Manager Report In relation to Article 10 Amend Zoning Bylaw-55 & 56 Watertown Street, Mr. Malloy presented proposed amendments to the Memorandum of Understanding with National Development. The Article failed to pass Special Town Meeting the night but a Town Meeting member has requested reconsideration of the Article, expected to come to the floor during this evening's session. Ms. Hai recused herself from the discussion as she is a member of the Belmont Country Club, seller of the property. The proposed amendments include: • Section 3 will be divided into Section A and Section B. In Section A, National Development proposes to increase by 3 the number of affordable units; Section B would provide 6 moderate income units that will be offered to eligible applicants at 67% of the market rate unit. • Section 4 would increase the amount of the one-time payment to the Town for emergency response services from $150,000 to $250,000. • Section 5 would be amended so that the developer would engage a third-party sustainability audit to evaluate all aspects of the building and building systems, including the feasibility of using alternative energy sources and solar readiness. Sustainable Lexington would be involved in the reviewing the consultant's audit findings. All other aspects of the MOU would remain the same. 2018 STM-1 Articles - Positions/Discussion November 14, 2018 Page 2 of 3 The Selectmen reviewed the positions and presenters for STM-1 articles. The resulting chart is appended to these minutes. Ms. Barry said the Board needs to discuss two items at this point: the notice of reconsideration that was served following the failure of Article 10 and the amendments to the MOU with National Development that Mr. Malloy just enumerated. Ms. Hai again recused herself from the discussion. About reconsideration: The Board received input from Town Moderator Deborah Brown and Town Counsel Mina Makarios, after which it was determined that enough had changed within the amendments to the MOU to justify a request to reconsider of Article 10. Mr. Pressman, 22 Locust Avenue, believes the changes to the MOU as described by Mr. Malloy respond directly to objections expressed about Article 10 on the previous night. Those objections pertained to sustainability; funds for emergency services, and affordability. He believes the information is both new and compelling. About the amendments to the MOU: The four participating Selectmen all supported the amended MOU. Procedural deliberations took place for the night's Special Town Meeting session. If the Planning Board decides not to move reconsideration, Ms. Barry will move the matter for the Board of Selectmen.
