Issue Extension to Order of Conditions: 44 Winthrop Road DEP4201-846, BL 804
Motion to issue the Extension to Order of Conditions made by Mr. Langseth and seconded by
Mr. Beuttell. Vote 6-0 in favor.
Request Certificate of Compliance: 39 Sherburne Road DEP 201-920, BL 4880
This will be discussed at the following meeting once updated drainage analysis is submitted.

Consideration to pay for outstanding taxes: 40 and 42 Ridge Road in connection to land donation
The Commission met previously with Mr. Burns, who is the current owner of the property. The
Commission discussed the outstanding taxes on the property which amount to around $25,000.
Chairman Hamilton explained that Mr. Burns has filed a Notice of Intent with the Conservation
Commission which is currently held up with the Zoning department.
The Commission decided that though the offer is appealing, at this moment they are unable to
further engage with this potential land donation.
Agriculture License Renewal 12/2018 to 12/2021: Waltham St Farms and Hayden Woods,
Dennis Busa
Motion to renew the Agricultural License from 12/2018 to 12/2021 by Ms. Dohan and seconded
by Mr. Beuttell.
Cotting School Conservation Restriction
The Commission confirmed that Meg of the Cotting School will submit a picnic area plan when
they are ready.
Site Visits
A site visit schedule for Saturday, November I Oh will be arranged and distributed to the
commission accordingly.
Planning Board Comments/Updates
No updates.
Meeting Minutes
Motion to approve the meeting minutes from the October 1, 2018 Conservation Commission
were approved on a motion by Ms. Dohan and seconded by Ms. Ladd. Vote 6-0.

were approved on a motion by Ms. Dohan and seconded by Ms. Ladd. Vote 6-0.

Project: Raze and rebuild a single family dwelling
Richard Kirby (LEC Environmental), Mike Capacetti and Bill Eycleshymer (Eycon

Mr. Hamilton entered the engineering report into the record.
Mr. Kirby stated that his client is proposing a raze and rebuild of a single family dwelling. They
have been working with Ms. Mullins and following her suggestions had modified the retaining
wall, limit of work and infiltration system.
Questions and comments from the Commission:
The commission questioned the proposed patio. Mr. Capacetti stated that the patio will be built
with pervious/porous pavers.
The commission questioned the retaining wall size. Mr. Capacetti stated that a boulder wall will
be constructed at a height of 3.5 feet tall.
The commission asked to confirm that no steps will be constructed. Mr. Capacetti confirmed
this.
Motion to close the hearing made by Mr. Beuttell and seconded by Ms. Dohan. Vote: 6-0 in
favor.

Project: Proposed demolition and reconstruction of a single family dwelling within the 100ft.

Mr. Hamilton entered the Engineering Report into the record.
Mr. Pauling explained that they have submitted revised plans and wetland data sheets per the
Commission's request. They have also added an additional series of stock shots, details to the
infiltration system and increased the structure set-back.
Mr. Pauling continued to explain that since their last meeting they have taken the rear of the
proposed house and moved it forward on the property by 3 inches. The filing is currently before
the Zoning Board of Appeals where it has been continued to the December 13'', 2018 meeting.
Chairman Hamilton confirmed that if the Zoning Board of Appeals denies the permit then they
will have to reappear at the Conservation Commission. However, this would be considered a
minor amendment to the plans.

Ms. Mullins mentioned that Mr. Kirby had reached out to MassDEP to confirm stormwater
management system definitions. It is now up to the Conservation Commission to determine
whether the property qualifies as a wetland.
Mr. Kirby stated that he will complete a written justification for his reasoning of use of the
property.
Motion to continue the hearing made by Ms. Ladd and seconded by Mr. Beuttell. Vote 6-0.

Mr. Hamilton entered the engineering report into the record.
Mr. Gala explained that there was a corrected 90 foot discrepancy from the application
submitted. Additionally, he provided revised storm water calculations that now extend from hour
0 to hour 24. There also had been interest in infiltrating more of the existing house so they
increased the infiltration system from 4 units to 10 units which will infiltrate 24 more square feet
of existing house.
Mr. Kirby added that this increases the high point of the gutters which will add the back half of
the house to the infiltration system.
Mr. Gala continued to explain that they made most of the driveway pervious, however the front
section would be impervious since it is the steepest. They also highlighted the snow storage areas
and added a stone apron.
Mr. Hamilton stated that this updated information will be sent to engineering and must get
approval from them before the hearing is closed.
