Ave, Lexington, MA Commissioners Present: Phil Hamilton, Alex Dohan, Ruth Ladd, Kevin Beuttell Commissioners Absent: David Langseth, Duke Bitsko and Dick Wolk Others present: Karen Mullins, Conservation Administrator and Katie Luczai, Conservation Department Assistant 6:30pm Issue Order of Conditions: 11 Vinebrook Road DEP File No. 201-1113, BL 1071 Motion to issue the Extension to Order of Conditions made by Ms. Dohan and seconded by Mr. Beuttell. Vote: 4-0 in favor. Issue to Order of Conditions: 17 Oxbow Road DEP File No. 201-1115, BL 1073 Motion to issue the Extension to Order of Conditions made by Ms. Dohan and seconded by Mr. Beuttell. Vote: 4-0 in favor. Request for Insignificant Plan Change: 11 Vinebrook Road DEP File No. 201-1113, BL 1071 The applicant, Mr. Nick Pauling, requested that the proposed building be decreased in size which allows an increased setback from the rear of the property. Motion to approve the insignificant plan change made by Ms. Dohan and seconded by Mr. Beuttell. Vote: 4-0 in favor. Approve Meeting Minutes from Conservation Commission meeting dated September 17, 2018 Motion to approve the meeting minutes from the September 17, 2018 Conservation Commission were approved on a motion by Ms. Dohan and seconded by Mr. Beuttell. Vote: 4-0. Site Visits A site visit schedule for Saturday, November 17th will be arranged and distributed to the commission accordingly. 2 Reports Ms. Dohan and Ms. Mullins described the recent Charrette for future projects at Wright Farm. There was a large turnout of residents from the area, including many educators. Ms. Mullins reported that the draft buffer zone regulations created by the Conservation Commission had been sent out to the appropriate persons for comment. Ms. Mullins reported that the Conservation department will be presenting their request for fiscal year 2020 plans which will include a request for funds for Willard's Woods. Ms. Mullins reported that the upcoming 2019 Conservation Commission calendar will be discussed at the following Conservation Commission meeting on November 26, 2018. Applicant's Request to Continue Hearing regarding 91 Hartwell Ave DEP File No. 201-1112, BL 1069 Motion to continue the public hearing for 91 Hartwell Ave, DEP File No. 201-1112, BL 1069 by Ms. Ladd and seconded by Mr. Beuttell. Vote: 4-0 in favor. 7pm NEW PUBLIC MEETING DET 4 18-19 RDA, 676 Lowell Street Applicant: Chan Wang Kim Project: Raze and rebuild of deck in kind within the 200ft. riverfront area Mr. Joseph Castelli, contractor for Chan Wang Kim presented before the commission. Mr. Castelli described the proposed project for a new deck within the 200 ft. riverfront area. Mr. Castelli explained that they plan to construct a 12 ft. by 16 ft. deck which would require 3 footing holes. The deck would be about 160 feet from the property line. Mr. Castelli explained that there is currently no deck and that there has not been one for a few years. Mr. Beuttell asked how much room they would require around the dwelling for the construction project. Mr. Castelli stated that they will be utilizing the driveway to the deck. There are no trees or shrubbery that is within the working area. 2 3 Mr. Chan stated that there are two accessible doors on the rear of the house. Chairman Hamilton asked what will be underneath the deck. Mr. Castelli stated that there is only ground underneath the deck and it will remain that way. On a motion made by Mr. Beuttell and seconded by Ms. Dohan, the Commission voted 4-0 to issue a negative determination with conditions for construction. 7:03pm DET 4 18-20 RDA, 255 Marrett Road Applicant: Fredrick Marc Cenerizio Project: Grading and limit of work boundary within the 100ft. buffer zone related to the reconstruction of a single family dwelling Mr. David Sperduto presented before the Commission. Mr. Sperduto delineated the wetlands in and around 255 Marrett Road. Mr. Sperduto described the wetland vegetation on the northern part of the property. The applicant moved the proposed new single family dwelling by 0.4 feet so that it is outside of the 100 foot buffer zone. Mr. Sperduto explained that they are proposing a trench drain and grading of the property. There will be no need for a sump pump or perimeter drain. The limit of work has been expanded since the site visit was conducted in order to complete the proposed regrading. Chairman Hamilton entered the engineering comment into the record. Mr. Beuttell asked if the infiltration system is just designed to include the driveway. Mr. Sperduto confirmed that the infiltration system to include the driveway and the normal downspouts from the roof. Ms. Mullins clarified that only the driveway is within the jurisdiction of the Commission. Mr. Beuttell asked to see if it were possible to tie downspouts on the house into the system in order to take advantage of the proposed infiltration system. Mr. Sperduto stated that they are to maintain 6 inches of cover over the drain. On a motion made by Ms. Ladd and seconded by Mr. Beuttell, the Commission voted 4-0 to issue a negative determination with the condition that the possibility of connecting the roof to the infiltration system be explored. 3 4 7:16pm DET 4 18-21 RDA, 6 Carmel Circle Applicant: Dan Hertzel Project: Installation of 3 concrete piers to support an existing cantilevered section of the house within the 100ft. buffer zone Mr. Greg Antoniou of Out of the Woods Construction presented before the Commission. Mr. Antoniou described the proposed deck which will require installing 3 concrete piers to support the new deck. Mr. Beuttell asked if any trees or vegetation will be impacted by the construction. Mr. Antoniou reported that no trees or vegetation will be impacted by the construction. On a motion made by Mr. Beuttell and seconded by Ms. Ladd, the Commission voted 4-0 to issue a negative determination with the conditions for construction. DET# 18-22 RDA, 245 Bedford Street Applicant: Jing Zheng Project: Installation of a shed within the 200 ft. riverfront area Mr. Wen Jun Fu presented to the Commission. Mr. Fu stated that they are proposing installing an 8 x 6 ft. shed in the rear of the property. The shed will be directly in the rear of the dwelling and will require installing a concrete surface. On a motion made by Mr. Beuttell and seconded by Ms. Ladd, the Commission voted 4-0 to issue a negative determination with the conditions for construction. DEP File No. 201-1111, BL 1074 NOI, 4 Lake Street Applicant: Richard Chan Project: Installation of brick patio within the 100ft. Buffer Zone Mr. Andrew Chan and Ms. Erica Downs, homeowners of 4 Lake Street presented before the Commission. 4 5 Mr. Chan described the proposed alterations to the brick patio at the rear of his property. Mr. Chan stated that he plans to completely remove the brick and install spaces between the bricks in order to theoretically increase the impervious surface. According to Mr. Chan's calculations the spaces in between the bricks would be installed appropriately for the required infiltration rate. Chairman Hamilton and Mr. Chan discussed the need to continue to coordinate with the town's engineering department to ensure that the proposed installation would comply with engineering standards and practices. There was discussion about clarifying the two aspects of the conservation permit which include the conservation permit for the brick patio and the restoration plantings. It was decided that they will continue to be treated as separate issues. Attorney Cindy Sherman, presented before the Commission on behalf of the abutting property on 2243 Massachusetts Avenue. Ms. Sherman stated that her clients are very concerned about the brick patio. No notice had gone to the abutter due to outdated assessor's maps. Ms. Sherman explained that the retaining wall between the properties was breached due to the activities related to the construction of the brick patio. There was discussion regarding the construction activities. Mr. David Sperduto, wetland scientist, presented before the Commission on behalf of the abutting property on 2243 Massachusetts Avenue. Mr. Sperduto inquired about the restoration efforts at 4 Lake Street. Mr. Chan and Ms. Downs confirmed that they are waiting for review and comments on their proposed restoration and management plan by their wetland scientist. On a motion made and seconded the Commission voted in favor 4-0 to continue the public hearing to the Conservation Commission meeting on November 26th, 2018. 7:55pm DEP File No. 201-1111, BL 1069 NOI, 476 Marrett Road Applicant/Property Owner: Andrew Huang, Richard Kirby, Al Gala Project: Construction of a second-story addition/expansion of a single-family dwelling and driveway resurfacing within the 100ft. buffer zone *Issue Order of Conditions if hearing closes. Mr. Al Gala presented before the Commission. 5 6 Mr. Gala stated that there is degradation of the curbing of the property. On a motion made by Ms. Ladd and seconded by Mr. Beuttell, the Commission voted 4-0 to close the hearing. On a motion made by Ms. Ladd and seconded by Mr. Beuttell, the Commission voted 4-0 in favor to issue the Order of Conditions. 8:OOpm DEP File No. 201-1114, BL 1072 ANRAD, 70 Hancock Street Applicant: The Jillson Company c/o Jason Lavoie, Alex DiCrescentis and Charles Foster Project: Confirm wetland area delineation Mr. Alex DiCrescentis presented before the Commission. There was no new information. There were no questions or comments by the Commission. On a motion made by Ms. Dohan and seconded by Mr. Beuttell, the Commission voted 4-0 in favor to continue the hearing until November 26th, 2018, at the applicant's request. 8:04pm On a motion made and seconded, the Commission voted 4-0 to adjourn the public meeting.
