Simonds ) Engineers Charles Brown ) Approved several bilis and drew orders for the same Made return to the State agreeable to Stat of 1863 Chap 218 of . the names, amount of bounties paid and' to whom, by whom, and plane where paid Authorized Charles Nunn Town Treasurer to borrow fifteen hundred dollars June 1st. 1863 The Commissioners on Cattle disease having taken possession -of the herds of Isaac Parker and B. W. Clark and isolated them (Mr Parker Apr llth. 1863 Mr Clarks May 5th,) .On the 16th of May they resigned their Commissions. and turned said hurds over to the charge of the selectmen On the 16th of May 1863. On the 1st of June we procured the professional service . of. 5 June 1st. 1863 Dr Morrell Wyman of Cambrdge to examine said herds He pronounced Certain ones in each herd diseased with the disease called Pleuro Pneumonia, and on the following day by virtue of the power vested in. us by Stat, of 1861 Chap 219 we ordered four tobe slaughtered Viz. One in the herd. of Isaac Parker and three in B. W. Clarks All o f vah-ich proved to be diseased At various times from Tune 5th to June 26 we madetunsucsessfui efforts to have the newly appointed Commissioners on Cattle disease take Charge of Said herds At which last date we .received. a note from Dr Jabez Fisher Commissioner declining to act in the matter Tune 29th 1863 . Selectmen procured the professional service of Dr E. F. Thayer .of Newton..to Examine herds of Isaac Parker . and B..- W. Clark and he _pronounced. all of lir Clarks..and .afl .but. tva:.of BA±Parkets diseased with the disease Called P]Leuro- Pneumonia and on the fol- lowing day we ordered all that were condemned to be slaughtered They having been previously appraised according to•law June 5th. 1863 The Selectmen isolated the. stock on the poor farm beleiveing the desease Called Pleuro Pneumonia to -:exist among them Tune 29th. 1863 Selectmen met full board present examined books of Charles .Nunn Toren Treasurer and found his receipts and disbursement as follows He charges himself as having received balance from last years settlement Received of Clinton Vile.s '" . Be adjudged the _disease called Pleuro Pneumonia to exist in_ it and the selectmen, ordered one to' be slaughtered which proved to be badly deseased smd the remainder to be isolated, including one -pair of oxen in _: sante. barn belonging Messrs, Carroll & Narvall, Subsequently made Con- tract with ,r Beatty to keep his stock The grown cat tle - at $.75 per week a head n . Young n 37* 23 Feb 23rd 1864. One of the above described oxen was slaught- ered by order of Selectmen and found to be deseas with Pleura Pneumonia Feb 10th 1864 Selectmen believing:the.deseas Called Pleuro Pneumonia to exhist in the stock of John P. Reed this day isolated it and :-agreed with :him to keep the same 17 head of grown Cattle $.75 a head per week 2 Calves : 37* n Feb 13th. 1864 Selectmen. met :a the house of Tohn P. Reed for the purpose of overseeing the slaughtering of two Cattle of P.P.Reed adjudged deseased by Wt. T. Hall 'furl board present Drat sundry orders and Approved severall bills Oct 10th. 1864 Selectmen, agreeable to notice from the town of Woburn met .their Agent for the purpose of peram- bulating the town lines, at the house of Marshall Lock, from thence we proceeded to the Corner bound of Woburn, Lexington, & Burlington, it being about forty rods soft east from the House of said Locke from there we went in a southwesterly direction to a stone monu- ment situated on a knoll about two rods from Middlesex turnpike then we took a southerly direction to stone monument on road near the old Reed house then in a Southeasterly direction to Stone monument 19. situated in the log man woods about three rods from Easterly wall -of said land and about Eight rods north of a white oak tree 'situated in the wall, from thence in a southerly direction to a stone monument in the wall about thirty rods north of the House of H. Graham from thence southeasterly to Stone monument back of said Grahams barn from thence to stone Monument on the roadside, from thence in a southerly direction to stone monument North of barn of Sohn Winning from thence to the Corner bound situated in the wall south- easterly of barn of said Winning it being the Corner bound between Woburn Lexington & Winchester Webster Smith • Selectmen Wm Henry Smith 2d . of Hammon Reed Lexington Oct 24th 1864 Selectmen met at the Town Hall full board present Granted a warrant for the annual Nov. meeting. Balance uncollected Mar 6 1865 $815.11 And this ended the official business of the board of sale: ctmen for 1864 & 65 f . ` Lexington March 6th. 1865 At the Anual Town meeting this day for choice of Town -officers Hammon Reed, Alonzo Goddard,. and Eli Simonds, were chosen Selectmen, and having been sworn to the . faithfull discharge of thier duty, by A. W. Bryant Town clerk, met and organized by the choice of Hammon Reed as Chairman, Drew several orders, and decided to allow the Soldiers Aid Society to use the Town Hall fora social party, on condition of thier paying all neccessary expenses occasioned by them - March 7th. 1865 The Selectmen met at the Town Hall, and the full board, being present made the following appointments in accordance with the vote of the Town Oliver t1P Kendall to be Sexton =1111.W. Saville as Treasurer and Collector. also O. W. Kendalls bond as Constable - March 20th. 1865 Met at the Town Hall. All present Drew warrant for Town meeting April 3d Revised the list of Jurors. Decided to meet at the Town Hall on the Evening of the last Monday of each month during the year from 7,to 8, otclock P.M. Also not to let the Common to Tames Gould. Reappointed Horace B. Livermore and Childs of the School Committe agreeably to 27 notice, to fill a vacancy in. that. board occasioned by the declination of Mr Stowe - Jonas Catnmell was elected Directed Mr Kendall to repair the floor of the porch of .the Town -Hall - Arranged State Aid matters, and drew several orders • April 3d. 1865 Met - at the. .'down Hall, and it being Town -meeting submitted a list of Jurors which was accepted. Also submitted an estimate of the sums of money raised, and required. to be raised, to defray Town expenses the present year. Voted - In the matter of Widening the Concord road. That Mr. Simonds meet -the County • Commissioners at Concord on the 20th. inst., to oppose•the same. Voted - that Mr Reed see to the repairs of one of the gates at the.new burial -.ground and also about those at the Town Hall • Approved bills, and drew orders Present the whole board April 24th. 186.5 All of the Selectmen met at the Town Hall, Appointed •Joseph F. Simonds, (Merles Brown, - and William Haan Fire Engineers Decided that . Mr- Reed . should attend to appoint- -bag an agent to take the census. Let the land back of • the Town House to Mr Rand forthe year for $10,0Q;/ Approved bills and drew orders, - 29 April 29th. 1865 The Selectmen appointed Sylvanus W Smith to take the Census, agreeing to pay him fifty dollars' on the completion of the same to the satisfaction of the Secretary of the Commonwealth - F May 15th. 1865 The Selectmen met at the cemetery Hammon Reed Alonzo Goddard, and Eli Simonds present. M'sers Goddard and Simonds to see to obtaining pine trees and grading. Reed to fence next to Mrs Cutler Also settled with S. H. Goddard Liquor Agent, and found his receipts and expenditures as follows. Received from sales 367.63 Town order 45.87 $413.50 Cash paid for Liquor and expense of agency 413.50 Also settled with Leonard A Saville -Superin- tendent of the Town Scales and found over his receipts, as follois Recd. for weighing from last settlement to date Eighty seven dollars seventy eight cents One half of which agreeably to amntract was paid into the Town treasury -'$43.89. Granted a warrant for a Town meeting to be held May 29th. Authorized Leonard A Saville Treasurer to borrow Two Thousand dollars in anticipation of the taxes. of 1865 - Monday May 29th. 1865 The Selectmen were all present at the Town Hall. Settled Bill of Fire Engineers drew orders &c. Saturday December 6, 1870. The Selectmen met at the House of Billings Smith, Town Treasurer, to examine the, state, of the funds in his custody. Present Hudson & Whitcher. The State of the Treasury will be seen by the follow- ing.. aport . In conformity with the vote of the Town, the Selectmen called upon Billings Smith Esq. the Town Treasurer, and examined his books and accounts, and assertained the balance in .his hands on the first of June and the first of September respectively. The amount of money at each of those periods, being comparatively sm 11, it was not deemed necessary to make a detailed analysis of the receipts and disburs- ments of the Treasury. But at the end of the third quarter, when the taxes are mostly collected and the Treasury is overflowing, we deem it our duty to make thorough examination of the receipts and dis- bursm eats of the Treasury, the manner in which the books are kept; and the condition and availability of the balance in the Treasury, It has been the invariable custom for years, for the Treasurer,- under the di- rection of the. Selectmen to borrow money ,to meet the expenses of the Town, in anticipation of the collection of Taxes. The very authority to borrow for this purpose, implies that when the Taxes. are collected the notes are to be paid. This obvious provision has sometimes been disregarded, and notes thus limited in their duration have been suffered to remain outstanding when the Treasurer had ample means to -redeem them; and thus the Interest account has been 143 unnecessarily enhanced and the Town Debt increased without the authority, or even the knowledgeof our citizens. The present Board of Selectmen have taken the precaution, when giving permission to the Treasurer to borrow money to state on the - face of the note itself, the vote giving the authority, andthe character of the object for which the money was wanted; so that each note would show substantially whether the Than was temporarey or permanent. During the past season, the Treasury has been called upon to negotiate two classes of temporary loans - One class for the new Tom Hall in anticipation of a permanent loan, 145 - and the other class for the currant expenses of the Town in anticipation of the collection of taxes. On the first of April 1870, the Treasrer at the request of the Conntittee authorized to build the Town Hall, borrowed $2300 to pay for the site of said Hall, which sum was by the Committee July 1, 1870; also for said Committee- the sum of 4500, May 4, 1870 which was paid to the Treasurer by the Committee August 31, 1870. The Building Committee in negotiating a permanent loan for the Town Hall, found -that they "could obtain the money from the State on more favorable terms than it could be had elsewhere provided they would take it in certain sums at specified times. This broughtfunds into the hands of the Committee faster than they were necessary 'to meet their paymext.s; and as the town was in want of money at • the very time the Committee received their surplus from the State, and would need the loan till tha period`when the Com- mittee would need their funds, the Selectmen deemed it for. `.the interest of town that the money required to meet the current expenses,, should be obtained of the Building Committee, especially as it could be had on terms as favorable as it could be obtained else- where. Under this arr-angment the town has been supplied With whatever -funds were necessary- to meet its current expenses, and the Committee have been. releived 'from an -unnecessary surplus on their - hands. The last ' twu loans amounting to 43500 had not been paid on the first of December, but arrangments were made to pap them in a few days; and the. Committee in a short time will require the money to meet their payments, in making these arrangments the. Sele.ctraen have had the hearty co operation of the Treasurer, who has granted us every opportunity to see his books, and who has been equally desirous with ourselves to comply with the vote of the Town, and <to provide every security for the funds committed to his charge. There will however be -an increase of -this balance by further collections, and by the recept of the Corporation Tax from the State. and the State Aid refund by the State. We find the Books of the Treasurer carefully and correctly kept, a full list of the Notes, with their respective dates, and the period they .have to run, clearly stated: while his bank book and his cash on hand, showed that the funds df the town were safely kept, and were available at all times. "The omission to use the Check list at the election of Moderator, if foot of itself a fatal defect in the title of Respondents to the office of Selectmen, was at least an irregularity which the Town might properly correct at the .same Meeting. he adjournment was but a continuation of the same Meeting. The vote of the town to correct the informality, and to proceed in compliance with the requirments of the Statutes in that respect, had the effect to vacate, not only the election of the -Moderator, but of all the of fivers chosen on the same day. The Respondents, therefore, have not been duly elected as Selectmen." This Decision of the Supreme°Court not only ousted the Board chosen on the first day, but by 189 necessesary implication placed the Board chosen at the adjournment, when the check list .was used in the choice of Moderation and of all the officers, in power, The persons chosen Selectmen at the adjournment, were Charles Hudson, Loring S. Pierce: & R. W. Reed. On the Tenth of July Charles Hudson, & Loring S. Pierce met at the town Hall; but Mr Reed being absent, we being desirous of having all the members present at the organisation of the Board, transacted no other business than tocll upon the retiring Boards, and receive the trunk andpapers pertaining to the office of Select- men. Passed several Bills Lexington Nov. 21, 1872 Met the County Commissioners at the Town Hall, the whole Board in present. Viewed the premises of 11. H. Merriam with reference to a drain in his lot. Lexington,Nov. ,26, 1872 Met at the Town Hall. The whole Board present. Heard the Statement of Mr Merriam & Mr Simonds relative to the drain in Mr Merriam*s land. Statements sortie .what conflicting,. though in the main agreeing in this - that Mr Simonds as High- way Surveyer was applied to by Mr Tuttle to close up effectually the culvert, which conveyed the water from Mr Merriam's land. In an interview between Mr Merriam and Mr Simonds, the expense of turning the water from the old culvert to the neer was discussed, and 199 Mr- Simonds proposed to open the drain to the new culvert, if Mr Merriams would cover it, or take care of the drain after it was dug. This was so far assented by Mr Merriam. that Mr Simonds went on with Mr. Merriamts knowledge apparent assent and sunk the drain. This Mr Simonds did by the laborers paid by the town, believing that the cost of sinking this drain was no greater than would by necessary to close up the old culvert. Mr Simonds admits that he acted on his own responsibility and not under the direction or advice of the Selectmen. Has Mr Merriam any legal or even moral claim upon the town to cover the drain so dug by Simonds? The Selectmen also passed tie following vote. "The Selectaen having been' applied to for per- mission to erect lamp posts in the highway, have this day considered the subject, and decide that posts properly located would be no obstruction to public travel, and we hereby give permission to erect posts for lamps to light the highway, provided they are placed in the edge of the side walk in suitable ,localities." All present. The culpable neglect of the Commissioners in sending on their order, deprived the Selectmen of the mostfaverable seasmn to contract their road. / 7 When the Order and Plan were obtained., the Selectmen who were- empowered by the town to cause the road to be repaired by Contract or other wise, as they deemed most for the interest of the town, thought it exped- ient to offer the job to our own citizens, and if they would do it for. a reasonable sum to let them `have it, and so keep the money in town. We did not advertise for proposals, but spoke to all mom we supposed would be inclined to to undertake to con- struct the road, saying we.: were ready t o make a contract for the job, and asked them what they would do it for. . As we had not advertised for proposals, we felt at perfect liberty to make a contract with any one that made us a favorable offer, whether he was the lower bidder or not. We saw by the Order of the Commissioners, that they required a first class road, and, the question with us was' not who would do it cheapest,but who would do it best. We made.a careful examination of the line, and an -estimate of the cost, and .did not think it for the interest of the` town to attempt to have the work let but at aless sum, as that would either give us a poor road or injure the Con- tractor.. We remembered the repairs .on Pleasant and Watertown Streets, where the.Contractor underbid all others, and after he had in this manner divers others from the field, he reTused to take the job unless the price was increased. Several hundred dollars were added to the prices but even then after commencing work, he stoped and refused to complete the road unless an additional sum was paid, and he obtained another advance of $150. With such an example before us, we were not willing to contract with any one for a sum less than the work would cost, as we did not wish to have any contractor suffer, =the town be compelled to increase his pay or relet the job. When we com- pared -the propositions made, we found that one pro- posal was as low as 41925, and one at $2500, and one at* $3000•. Another proposal had been made at $2100, but was' with drawn. Having on a fuilview of the subject est mated.the cost at $2300, and believing that.no contractor could safely take the for less than that sum; we refused to.aceede to any of the proposals - on' the groumd that one was lower at the present price of labor, than any msn could make a good road for, and the other two were higher than was necessary to ensure a good road. 205 y After the proposition of 42500 was rejected, the party on the subsequent day, who had made this propo- sition offer to take the contract for 42200. The Selectmenbelieved that this was in fact was as low if not lower than a good road could be make for, and had some hesitancy- in contracting for that sum, lest the contractors finding they had a hard job should either slight or abanddn the work. But the Selectmen learned that the Contractors could use the town teams ata rate somewhat below the usual price, and thereby do the job for a less sum than they could under other circumstances; and could not fail to 'see that it would be better for the town to have their horses earning something', if it were only enough to pay their keeping, than to have them stand idly in their stalls, eating out their own worth before the town would have any occasion to further labor.' Besides, the party contracted with (Messes Locke, Bryant & Hobart) having ;the care and custody of the teams and being responsibil to the town for the 'proper care of the horses, • would be likely to use them more carefully than any third party would do. 206 On the whole the Selectmen believe that the arrang- went they havemade is for the interest of the town, and does no injury to any party. 'de believe that the party which offered to make the road for less than two thousand dollars, would have been a looser if he had taken the job, and made the road in a thorough manner. The ledge which must be encounter- ed at three points at least on the line, present formidable obstacles, and the experience our road builders havechad in removing that kind of rock shows that a large sum of money may be expended on a small space. The party making the low proposition may we believe congratulate himself,on his escape from a position which would have been embarrassing .to him. • We =believe that 4230O is as low as as any prudent man eould safely undertake the job, and in this estimate we are twochundred dollars less than the former board of Selectman (Simonds, tt1hi tcher , & 'Parker) who estimated the cost at 4250t), and caused that sum to be appropriated for that purpose. Person is, a Red Flag, that the public may know of the existence of the disease;• and at the sametime the family should isolate ° themselves as far as prac- ticable, so as not to spread the disease, Here to a great extentaies the danger. Where the disease actually exists, the family may arrange with some friend to approach the house daily, where orders can be given, and the needed sup- plies left near the House, where the family can get them without exposing any one. This arrangement, vauth a littIm care, can be carried out without danger to any party. II. -In case of death frori the Small Pox or Varioloid, the remains must'be interred without delay, and 'any public funeral or wake is absolutely forbidden. III. In all instances where the Small Pox or Varioloid has occured, whether it has proved fatal or not, the house must be perfectly cleansed and aired, fumigated or smoked, and the clothing and bedding in particular must be thoroughly cleansed and fumigated, and no member of the family should presume to mingle in society, or travel in public conveyances, until .their physician thinks it can be done with safety to the public. 17. Where families are poor, and cannot employ a physician, procure a nurse, or meet the expense of a burial, the Selectmen will supply the needed means. V. The practice of flocking to the sick chamber or house, during the sickness of the patient, or after his death, is highly dangerous in all contagious or infectious diseases, and is hereby forbidden. VI.' We would earnestly call the attention of the people to the fact that the law provides that vaccination and re -vaccination may be enforced once in five years. Common prudence requires that every precaution should be used to stay the ravages of this fatal disease. The following statistics show the wisdon of revaccination. ttIn the French army, where revaccination is _not practiced, - 23,469 deaths •from: the Smill Pox occured during the late campaign; itn the German army where re -vaccination is compulsory, but 263 deaths happened from this disease during the same period." The safety of the public requires that these restrictions should be rigidly observed. A compliance with these recommendations is urged, as it 'will do much towards checking the spread of this dangerous malady, and save the parties from the rigorous application of more stringent measures, which will be resorted to if the case requires it. Babcock Collector for the year 1872, and that there was committed to him for collection $42125.77 and that he has accounted for $41784.26. leaving a balance uncollected of $341.51, as seen in the ap- pended schedule They have also examined the books and accounts of L G. Babcock Treasurer for the year 1872-3, and find that he has received $60323.64, and has paid out $53,238.87, leaving in the Treasury $7083.77 as seen in the annexed -.list.. We also learn by said list, that the uncollected amount of $314,34. in the hands of the last Treasurer Geo. O. Davis one year ago, has been collected, and paid into the Treasury-. We find XIW the Treasurer books to be neatly and accurately kept, the Notes with the Interest promptly paid, and the balance on hand available at all times. The financial condition `of the town .is not partc- ularly discouraging.
