The petitioner submitted the following information with the application: Nature and
Justification, Plot Plan, Elevations, Floor Plans, and Photographs. Also received was
a letter of support from an abutter, dated August 6, 2018.
Prior to the meeting, the petitions and supporting data were reviewed by the Building
Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the
Planning Director, the Historic District Commission Clerk, Historical Commission,
Economic Development, and the Zoning Administrator. Comments were received
from the Engineering Department, and Zoning Administrator.
The petitioner is requesting a SPECIAL PERMIT in accordance with the Zoning By-
Law (Chapter 135 of the Code of Lexington) sections 135-9.4 and 135-8.4.2 to allow
modification to a non-conforming structure.
The Chair opened the hearing at 7:03 pm.

The applicants are proposing to renovate the front entry. The brick stairs were built in
1954 and are about 1 ft into the setback, making them non-conforming. They are
unable to use the stairs because of safety reasons and have to come in thru the
garage. The proposed setback will be 27.3 ft instead of the required 30 ft. The actual
distance to Benjamin Road is over 40 ft. Mr. Klimkiewicz stated most of the houses
around them have been knocked down and re-built. What they are asking for is small
project in comparison.

On a motion made and seconded, the Board voted to close the hearing at 7:10 pm.

voted 5-0 to grant a SPECIAL PERMIT in accordance with the Zoning By-Law

waiver of the requirement of a certified plot plan.

Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the
Planning Director, the Historic District Commission Clerk, Historical Commission,
Economic Development, and the Zoning Administrator. Comments were received
from the Historic Districts Commission, Economic Development, and Zoning
Administrator.

5.2.10 to allow a second wall sign.

Presenter: Hazel Wood Hopkins, National Sign Corp
Ms. Hopkins presented the petition and stated that she met with the Historic Districts
Commission (HDC) last Thursday, who approved the sign and did not think the blue
fascia on the sign was an issue. They are proposing to add the logo for Webster
Investments to the sign and move the Webster Bank sign to the right. The purpose
would be to help the bank identify the bank's investment service, as they have a
separate office from the bank.
A Board Member, Mr. Williams, stated that he thinks the additional signage is overkill
and is not necessary. Mr. Williams also asked why the brick is covered (the red fascia
has been there for years and has never been altered. She doesn't know if there is
damage underneath). Mr. Williams asked how long the total sign is (about 27 ft
altogether).
A Board Member Associate, Ms. Masterman, asked if Webster Investment and
Webster Bank are 2 legally separate businesses (their legal name is Webster Bank,
but Webster Investments has an independent staff from the bank). Ms. Masterman
thinks the sign is a little overkill and asked if the name could be combined and
shortened (no).

On a motion made and seconded, the Board voted to close the hearing at 7:23pm.
On a motion by Jeanne K. Krieger, and seconded by Nyles N. Barnert, the Board
voted 5-0 to waive the requirement of a certified plot plan.
On a motion by Nyles N. Barnert, and seconded by Jeanne K. Krieger, the Board
voted 4-1 (David G. Williams in opposition) to grant a SPECIAL PERMIT in
accordance with the Zoning By-Law (Chapter 135 of the Code of Lexington) sections
135-9.4 and 135-5.2.8 and 5.2.10 to allow a second wall sign.

On a motion by Jeanne K. Krieger, and seconded by Nyles N. Barnert, the Board
voted 3-0 (2 abstained), to approve the minutes of July 26, 2018.
