A meeting of the Historic Districts Commission was held on Thursday,
December 26, 1974, at 8s15 P,M, in Room G15, Town Office Building, Lexing-
ton, Present were Commissioners Wilbur M. Jaquith, Chairman; Georgia H,
Williams, Secretary; Donald J, Shaw; S, Lawrence Whipple; and Associate Com-
missioner Oliver F, Hooper, Mr, Hooper was appointed to serve for Commis-
sioner Thomas J, Holzbog who was not present,
It was moved, seconded, and unanimously VOTED to issue a Certificate of
Appropriateness to Amalia G, 3amoylenko et als, Trustees of The Lexington
Mews Trust with respect to the erection and display of a directory sign for
the building at SO Muzzey Street, which is within the Battle Green District,
Participating in this decision were Commissioners Wilbur M. Jaquith, Georgia
H, Williams, Donald J, Shaw, S, Lawrence Whipple, and Associate Commissioner
Oliver F, Hooper,
It was moved, seconded, and unanimously VOTED to issue a Certificate of
Appropriateness to Lexmil Theatres, Inc, with respect to the erection and
display of a sign for the theatre at 10 Muzzey Street, which is within the
Battle Green District, Participating in this decision were Commissioners
Wilbur M, Jaquith, Georgia H, Williams, Donald J, Shaw, S, Lawrence Whipple,
and Associate Commissioner Oliver F, Hooper,
Mr, Jaquith submitted a bill from Barbara Gilson, Clerk, dated December
25r 1974 for $43.35 ($2.10 - postage; $7,50 - meeting; $33.75 - clerical ser-
vices), It was moved, seconded, and VOTED to approve payment of this bill,
Mr, Shaw moved that the Commission go into Executive Session to discuss
the litigation involving the Forg case, seconded by Mr, Hooper, and so VOTED,
Commissioner Thomas J. Holzbog arrived at this point and assumed his
seat,
Mr, Shaw moved that the Commission appeal the decision of Judge Donahue
in the case of Donald F, Forg et al vs, Wilbur M, Jaquith et al (Historic
Districts Commission of Lexington) in Equity Case No. 35391, seconded by
Mrs, Williams, and unanimously VOTED, Participating in this decision were
Commissioners Wilbur M. Jaquith, Georgia H, Williams, Thomas J. Holzbog,
Donald J, Shaw, and S, Lawrence Whipple.
Mr, Shaw moved that the Chairman request a meeting with the Selectmen
and Town Counsel to discuss the Forg case acid the furnishing of legal coun-
sel for an appeal, seconded by Mrs, Williams, and unanimously VOTED, Par-
ticipating in this vote were Commissioners Wilbur M, Jaquith, Georgia H,
Williams, Thomas J, Holzbog, Donald J, Shaw, and S, Lawrence Whipple,

Then followed a discussion concerning the insertion of a sum in the
Commission's budget for the next fiscal year for consulting fees to be ex-
pended in connection with applications resented to the Commission, Fol-
lowing discussion, it was decided that 1000,00 be included in the Commis-
sion's budget request for the next fiscal year.
Mr, Shaw left the meeting at this point and Associate Commissioner
Oliver F. Hooper was appointed to sit for him,
Mr, Whipple asked about allowing the Berglers to use snap-in muntins
in the renovation work approved for the dwelling at 22 Hancock Street and
the Chairman stated that snap-in muntins had been approved for dwellings in
the Hancock-Clarke District previously, Mr, Jaquith stated that the Certif-
icate issued to the Berglers contained a condition that the muntins could be
removed only for purposes of cleaning the windows.
Then followed a discussion on the foundation and grade of the Hancoek-
Clarke House at its relocated location at 36 Haneoek Street. It was stated
that one corner of the House was set back from Hancock Street only 10', Mr.
Holzbog stated that earth mound grading from the street tPOUld have to be
done in order to comply with the drawings submitted, It was stated that
houses of this type of architecture and period were set low on the ground
and that the only way this could be done would be to use earth fill to
raise the ground level,
The meeting was adjourned at 10x15 P. M, ~j
