MINUTES OF ADJOURNED MEETING HELD ON JUNE 26, 1968
The Lexington Historic Districts Commission held an adjourned
meeting on Wednesday, June 26, 1968, in the Selectmen' s Room, Town
Office Building. Members present were Commissioners Wilbur M. Jaquith,
Chairman, Philip B. Parsons, Secretary, Ruth G. Bevan, George E. Graves
and Max H. Straw.
Adjourned hearing was held at 7:45 P.M. to act on the applications
of Shell Oil Company. Upon motion duly made and seconded, it was un-
animously VOTED to issue a Permit for Demolition or Removal to Shell Oil
Company for the demolition or removal of its existing retail automobile
service station building and related facilities, including gas pumps,
lighting facilities and paving, the fences along its northwesterly and
northeasterly boundary lines and the fence and concrete wall between the
existing pump islands and the street on the premises at 1095 Massachusetts
Avenue, which is within the East Village District.
After discussion and study of a draft drawn up by the Chairman, upon
motion duly made and seconded, it was unanimously VOTED to issue a Certi-
ficate of Appropriateness to Shell Oil Company with respect to the erec-
tion of a new retail automobile service station building and related
facilities and fences on the aforementioned premises .
After further discussion on the application of Shell Oil Company for
a Certificate of Appropriatenesswith respect to the erection and display
of two signs for the new retail automobile service station building re-
ferred to above, the Commission upon motion duly made and seconded, VOTED
unanimously to issue a Certificate to the applicant . The Chairman advised
the Commission members that with respect to a standing sign for the service
station, a letter had been received extending the time for action by the
Commission to October 15, 1968.
Adjourned hearing was held at 10:00 P.M. on the application of Robert
O. Tillinghast with respect to the restoration and alteration of the
existing dwelling at 465 Massachusetts Avenue, which is within the East
Village District. Mr. Tillinghast appeared and presented to the Commis-
sion paint color samples, a brochure picturing combination aluminum storm
and screen windows and samples of brick for the chimney. Upon motion duly
made and seconded, it was unanimously VOTED to issue a Certificate of
Appropriateness to the applicant with respect to restoration and altera-
tion of the existing dwelling as noted above . Mr. Tillinghast presented
confirmatory plans to the Commission as were previously requested. The
adjourned hearing was adjourned at 11: 00 P .M.
The Chairman read to the Commission a copy of a letter sent by
Robert Lyon, Manager of Colonial Restorations, Inc ., to the owner of Pepe ' s,
a pizza shop, located at the corner of Independence Avenue and Massachu-
setts Avenue . Mr. Lyon advised the owner that his inside sign advetise-
ments could be improved and that any outside signs would be within the
requirements of the Historic Districts Act.
The next meeting night is scheduled for Wednesday, July 10, 1968,
to consider the application of Ellen H. G. Bryantforfencing.
The meeting was adjourned at 12:05 A.M.

PERMIT FOR DEMOLITION OR REMOVAL
This Permit is issued pursuant to Chapter t4.7 of the Acts of
1956, as amended, to Shell Oil Company for the demolition or removal
of its existing retail automobile service station building and re-
lated facilities, including gas pumps, lighting facilities and paving,
the fences along its northwesterly and northeasterly boundary lines
and the fence and concrete wall between the existing pump islands and
the street on the premises at 1095 Massachusetts Avenue, which is
within the East Village District .
This Permit is issued subject to the following conditions which
shall apply if the Permit is acted upon:
1. That the new retail automobile service station
building and related facilities for which
Certificate of Appropriateness No. 68 C-21 is
being issued by the Commission concurrently
with the issuance of this Permit shall be
completed within one year of the demolition or
removal, or within such additional time as the
Commission shall approve in writing
2. That reasonable care shall be exercised during
the demolition or removal process to preserve
all evergreen trees in the planting area along
the northwesterly boundary line shown on Drawing
No. 1 entitled "Elevation & Plot Plan of Service
Station Maple St. and Mass. Ave . Lexington, Mass." ,
dated June 11, 1968 by C . Harry Erickson, Architect,
submitted to the Commission at the hearing on
June 12, 1968.

CERTIFICATE OF APPROPRIATENESS
This certificate is issued pursuant to Chapter 447, Acts of Massachusetts, 1956, as amended, to
Shell Oil Company
with respect to the erection of a new retail automobile
service station building and related
facilities and fences
as noted below, at 1095 Massachusetts Avenue
which is within the East Village District
The service station building is to be located as shown on drawing
No. 1 bearing the legend "Elevation & Plot Plan of Service Station
Maple St. and Mass . Ave. Lexington, Mass ." of a set of five scale
drawings entitled "Shell Oil Company Eastern Marketing Region" ,
dated June 11, 1968, by C . Harry Erickson Architect submitted to the
Commission at the hearing on June 12, 1968. The related facilities,
excluding signs, consist of a single pump island, paved area, metal
caps for underground tanks, and five poles with lights for illumina-
tion of driveways and paved area, and are to be located as shown on
said drawing No . 1. There is to be a continuous fence along the
northwesterly and northeasterly boundary lines of the property, ex-
cept in the rear of the building, with adjoining planting areas in
front of the fencing, a planting area in front of the pump island and
a planting area between the two Maple Street driveways, said fencing
and planting areas to be located as shown on said drawing No. 1.
The general style, layout and details of the design, and the dimensions
of the service station building appear on or may be scaled from the
aforesaid five drawings . All face brick and asphalt shingles are to
match as nearly as possible the sample of Concord Brick and Moire
Black shingles submitted to the Commission at the hearing. All window
sash and doors , including the overhead doors on the southeasterly

elevation, are to be of wood and are to have permanent wood muntins,
except that the two doors for the lavatories are to be solid wood.
The aluminum siding on the northwest and southeast elevations is to
be of the clapboard type and the louvers in these elevations are to be
of wood. All woodwork and aluminum downspouts are to be painted white
and the wrought iron weathervane is to be painted black. The other
building materials are to be as noted on the aforementioned drawings .
The pump island is to have four gas pumps, an oil cabinet and two twin
lights . The general style, layout and details of the design and the
dimensions of the pumps and cabinet appear on or may be scaled from a
scale drawing entitled "Proposed Lexington Pump Island" submitted to
the Commission at the hearing. All land area of the lot not covered
by the service station building, the pump island, the planting areas
and caps for the underground tanks shall be paved with black asphalt
except that the pump area designated "Conc . Mat" on said drawing No. 1,
the two tank fill pads approximately 1i ' square and the border curbing
around the planting areas shall be of concrete .
The fencing along the northwesterly and northeasterly boundary lines of
the property is to be "Walpole" split cedar solid fencing with post
and rails facing the street and is to be left to weather in its natural
state. The fence shall be 4 ' in height except as follows :
1. Commencing at a point on the northeasterly boundary
line of the lot 12' northwesterly from the north-
westerly side line of the new sidewalk abutting
Maple Street, the fencing shall be sloped from its
E}' height to a height of 2' at said sidewalk line .
2. Commencing at a point on the northwesterly boundary
line of the lot approximately 15' easterly from the
stone bound located 11.39 ' northeasterly from the
concrete bound at the northeasterly side line of the
new sidewalk abutting Massachusetts Avenue, the fencing
shall be sloped from its 4t height to a height of 2 '
at said sidewalk line .
The erection of this fencing is subject to the condition that there
shall be maintained permanent evergreen screening for the fencing in
the two planting areas on each side of the service station building.
The evergreen landscaping shall be of sufficient quantity to *-minimize
the view of the fencing from Massachusetts Avenue and Maple Street but
need not provide a solid evergreen screen. The planting plan for such

screening, showing type, size and location of evergreens to be planted,
shall be submitted to the Commission for approval prior to installa-
tion of the planting. The other two planting areas shall be main-
tained with permanent plantings having a height when full grown of not
more than 2 1/2' ; the plantings to be selected by the owner.

There are to be five single lantern type/fixtures for the driveways
and two twin lantern type light fixtures for the pump island. All
light fixtures are to be of the Colonial American style, design and
dimensions described in' a brochure submitted to the Commission at the
hearing. The vertical distance between the bottom of the light fix-
tures and the ground is to be not more than 14' for the driveway lights
and 10' for the pump island lights . The fixtures for the four primary
driveway lights ( those at each corner of the lot and the two in the
planting area in front of the pump island) are to be mounted on brac-
kets, having scrolls at bottom, attached to poles and extending out
over the driveway 72" from the poles to the center of the light fix-
tures . The fixture for the driveway light in the planting area between
the two t!aple Street driveways is to be mounted directly on top of the
supporting pole . The fixtures for the twin pump island lights are to
be mounted on double 36" brackets, having scrolls at bottom, attached
to the top of supporting poles. The style, design and dimensions of
the brackets, post top mounting, and poles are to be as shown in the
aforementioned brochure and Pump Island drawing. The fixture lenses
may be of either white translucent or clear prismatic acrylic plastic .
All light fixtures excluding the lenses and all brackets, scrolls,
post mountings and poles are to be painted black. The lanterns are to
have white mercury vapor lamps of not more than 400 watts intensity.
The installation of the lighting facilities authorized by this Certi-
ficate is subject to the condition that the Commission may, at any
time within two years from the date of issuance of this Certificate or
within one year from the date of issuance of an occupancy permit for
the service station building whichever is later, review the status of
the lighting facilities, and, if the Commission determines them to be
inappropriate for purposes of the Historic Districts Act, Chapter 447
of the Acts of 1956, as amended, may amend the provisions of this
Certificate pertaining to the lighting facilities so that such facili-
ties will be appropriate, and, in the event of such amendment, the
lighting facilities shall be changed to comply with the amendment.
Wall lights for the entrances to the lavatories may be installed pro-
vided that the style, type and location of the fixtures are approved
by the Commission prior to installation.

At the hearing there was submitted to the Commission copies of the
proposed plot plan, dated 2/8/68, drawn by E. J. Gallagher and the
three undated drawings, numbered D-68144, D-68145, and D-6814.6,
drawn by Herb Siegler submitted by the applicant to the Board of
Appeals and referred to by the Board in its decision dated May 7,
1968. The Gallagher plot plan and the Siegler drawings are substan-
tially the same but not identical with the aforementioned plot plan
and drawings prepared by Mr. Erickson and accordingly all architec-
tural features referred to in this Certificate as appearing on drawings
submitted to the Commission shall be deemed to be those features
appearing on Mr. Erickson' s drawings .
It is the intention of the Commission that all conditions set forth in
this Certificate shall be "binding upon the applicant, the owner of
the property and his successors in title" within the meaning of
Section 9 of Chapter 447 of the Acts of 1956, as mended. The issuance
of this Certificate does not constitute evidence of compliance with
the Building By-Law or any other By-Law of the Town of Lexington.

Erickson, Architect and is tq bear the leend:
"SHELL"
The dimensions, style, layout and type of lettering appear on or may be
scaled from the aforesaid drawing. The letters are to be of black
plastic, approximately 3/8" thick, fastened flush to the white facia
board. The sign may be lighted by horizontal single tube flourescent
lights of medium light intensity recessed in the canopy.
The second sign is to be located above the service area doors on the
southeast elevation of the building as shown on the aforesaid drawing
No. 5 and is to bear the legend: --
' "Service Is Our Business"
. The dimensions, style, layout and type of lettering appear on or may be
scaled from the aforesaid drawing. The letters are to be of black
plastic approximately 3/8" thick, fastened flush to the white facia
board. The sign may be lighted by horizontal single tube flourescent
lighting of medium light intensity concealed in the coping above the
service area doors.

span of not more than four clapboards may be installed
in the peak of the gable of the westerly elevation of
the dwelling. •
