MINUTES OF MEETING HELD ON MAY 22, 1968
The Lexington Historic Districts Commission held a meeting on Wed-
nesday, May 22, 1968, in the Selectmen' s Room, Town Office Building.
Members present were Commissioners Wilbur M. Jaquith, Chairman, Philip B.
Parsons, Secretary, Ruth G. Bevan, George E. Graves and Max H. Straw and
Associate Commissioners George W. Emery and Donald B. White.
Hearing was held at 7:30 P.M. on the application of RHD Realty and
Development Co. for a Certificate of Appropriateness with respect to the
erection and display of a sign for the Battle Green Inn on the premises at
26-32 Waltham Street, which is within the Battle Green District. David W .
Pierce, Manager of the Inn and Harry Priest of Astro Signs appeared. Scale
drawings submitted to the Commission were not complete and the location of
the sign on the premises was not definite . The Chairman will check with the
Building Inspector with regard to the Sign By-Law on this sign and will ad-
vise the applicant. No other persons having appeared, the hearing was
adjourned at 8:35 P.M.
Commissioners Bevan and Straw retired from the meeting at this time .
The Chairman dictated to the Clerk the following paragraph for inclusion
in the Minutes:
on the applications filed by Howard W., Jane A. and Mary H.
Foley on December 29, 1967 on which a hearing was held on February
7, 1968 and which hearing was adjourned to allow submission of
additional data at a later date and the time for acting on the
applications was successively extended to June 1, 1968. the Chair-
man read copies to the Commission of letters sent by Attorney May
to Dr. Foley on March 7, 1968 and April 2L1., 1968, a letter to the
Chairman from Attorney May, dated April 24, 1968 and the Chairman' s
letter to Attorney May of May 9, 1968. In the letter the Chairman
informed the applicant that final action on the application would
be taken by the Commission at the May 22, 1968 meeting unless a
representative of the applicant was present at the meeting or the
application was withdrawn. No withdrawal of the application was
made before the meeting and no representative of the applicant ap-
peared at the meeting. Upon motion duly made and seconded, it was
unanimously VOTED that the applications of the Foley:: filed on
December 29, 1967 be denied for lack of prosecution of said applica-
tions and without prejudice to the filing of a new application at
a later date."
Commissioners Bevan and Straw returned to the meeting and plans for
the Shell Oil Company demolition and new building were reviewed by the
Commission in preparation for the hearing to be held on June 12, 1968.
At 9:30 P.M. William P. Kenealy of 7 Hancock Avenue appeared to in-
formally discuss with the Commission plans for the demolition of a porch
and the erection of an addition to the dwelling. A formal hearing on this
application is scheduled for 9:00 P.M. at the next meeting night which will

be on Wednesday, June 12, 1968, in the Selectme ' sy.!�� own 4glat Bldg.
The meeting was adjourned at 11:00 P.M. `�'

NOTICE OF DETERMINATION
Notice is hereby given that at a meeting of the Historic
Districts Commission held on Wednesday, May 22, 1968 the Commission
voted to deny the application of Howard W. Foley, Jane A. Foley and
Mary H. Foley for a Permit for demolition or removal of the barn at
5 Harrington Road, and their application for a Certificate of Appropu.
riateness to move said barn to • new site on said premises, to erect
an addition to said barn, and to erect a fence along proposed new
boundary lines for said premises for the lack of prosecution of said
applications and without prejudice to the filing of a new applica•
tion at a later date.
Participating in this decision were Commissioners Wilbur M.
Jaquith, Chairman, Philip B. Parsons, Secretary and George E. Graves
and Associate Commissioners George W. Emery and Donald B. White.
