HomeMy WebLinkAbout1987-01-12PLANNING BOARD MINUTES MEETING OF JANUARY 12, 1987 The meeting of the Lexington Planning Board held in Room G-15, Town Office Build- ing, was called to order at 7:38 p.m, by the Chairman, Mrs. Uhrig, with members Cripps, Klauminzer, Sorensen, Wood, Planning Director Bowyer, Assistant Planner Rawski, and Secretary Peters present. 7. Approval of Minutes: The Board reviewed the minutes for the regular meeting and the Executive session meeting held January 5, 1987. On the motion of Mrs. Wood, seconded by Mr. Sorensen, it was voted 4-0-1 to approve the minutes as written. Mrs. Uhrig abstained since she was absent from the January 5th meeting. ******************* ADMINISTRATION OF LAND DEVELOPMENT REGULATIONS ************* SUBDIVISION OF LAND 8. Sunset Ridge subdivision: The Board reviewed a memorandum, dated January 5, 1987, from the Town Engineer estimating that surety could be reduced by $5,640 from $42,403 to $36,763. On the motion of Mr. Sorensen, seconded by Mrs. Klau- minzer, it was voted unanimously to reduce the surety to $36,763. 9. APPLICATIONS TO THE BOARD OF APPEALS Martha Wood gave an oral review of hearings to be heard by the Board of Appeals January 22, 1987: ' 51 Harding Road, Roman Legocki, Variance, rear yard setback: On the motion of Mr. Sorensen, seconded by Mr. Cripps, it was voted unanimously to recom- mend the variance be denied. The Board agreed allowing the building to be located within four feet of the rear property line would be too much of an intrusion into a required setback and place the building too close to the abutting property. The Board also felt that it could set the stage for another application in the future for a special permit to the Board of Appeals under subsection 6.3 for expansion of the dwelling upward within the new footprint. In addition, no hardship caused by the Zoning By -Law had been demonstrated; and other alternatives, not involving setback violations, should be explored to meet the family's needs. On the motion of Mrs. Wood, seconded by Mr. Sorensen, it was voted unanimously to to make no comment on the following applications also to be heard on January 22, 1987: 32 Muzzey Street, Michael Benes, Special Permit, to add a greenhouse, 22 Sherburne Road, Jeffrey & Daren Arbetter, Variance, rear yard setback and 9 Columbus Street, Stephen & Donna Cole, Variance, front yard setback. *********************** ARTICLES FOR 1987 TOWN MEETING ************************* 10. Comprehensive Commercial Revision: The Board agreed the commercial revision would be one article with several sections. The Board continued its review of the section entitled "Table I, Permitted Uses and Development Standards," using the draft dated 12/18/86. Minutes for January 12, 1987 Page 2 11. Condominium Conversion: The Board discussed the State Condominium Law and Condominium Conversion Law (Mass. GL Ch 183A and Ch 527 of 1983) and agreed it the state law provides sufficient protection for tenants and that it does not appear necessary for Lexington to adopt its own condominium conversion by-law. They agreed to work on a resolution for the Warrant that would call for the Town to take action to protect and assist tenants facing condominium conversion. Mrs. Klauminzer and Mrs. Flemings, of the Housing Advisory Committee, will prepare a draft resolution for the Board to review at their January 20 meeting. Mrs. Klauminzer reported the Housing Advisory Committee will be meeting on the 21st of January and will try to work up an inventory of rental housing to assist residents being displaced by condominium conversion. 12. Middlesex Mall: Mr. Bowyer reported the owners of the Mall will notify the Selectmen they have decided to withdraw the zoning article they had filed for the Town Meeting. 13. Planning Board, Subcommittees: a. Meeting and hearing schedule: The Board agreed to schedule a meeting with the Board of Appeals to discuss the Planning Board and citizen articles for Town Meeting, and to hold a hearing on February 11, 1987 for the three citizen articles and the Planning Board articles other than the Comprehen- sive Commercial Revision article, for which a public hearing would be held on January 15, 1987 and continued until February 23. The Board also sche- duled meetings for January 20, (in addition to the January 26 meeting already posted). The meeting adjourned at 11:06 p.m. 11 Martha Wood, Clerk
