HomeMy WebLinkAbout1984-07-09EXECUTIVE SESSION PLANNING BOARD MINUTES MEETING OF JULY 9, 1984 After a unanimous vote of the five members present, by poll of the Board, the Lex- ington Planning Board met in Executive Session in Estabrook Hall, Cary Memorial Hall, at 10:20 p.m. to discuss strategy with respect to potential litigation which, if discussed in Open Session, may have a detrimental effect on the position of the Town. Present were Chairman Smith and members Cripps, Flemings, Sorensen, Uhrig and Planning Director Bowyer. Mr. Bowyer explained that an application for a full building permit for 4-6 Sher- burne Road had been received. Previously the Building Commissioner had issued only a foundation permit because the plans for the house were incomplete relative to the building code. In discussion with Town Counsel, it appears there are some proced- ural questions relative to the request for enforcement -appeal which the Planning Board filed in May -June. Mr. Cohen believes that the Planning Board should drop the earlier appeal and submit a new appeal on the issuance of a new full building permit. The Board did not agree with that approach. A meeting is scheduled on July 11 to be attended by the Building Commissioner, Planning Director, Town Counsel and attorneys for the Herseys and Fine Homes Realty. Mr. Bowyer will attend the meeting but will not make any representation on behalf of the Planning Board. After some discussion of this most recent development, it was agreed to defer a decision until the Board could meet with Town Counsel to discuss his recent inter- pretations of the situation. The Executive Session was adjourned at 10:44 p.m. and the Board returned to Open Session. Judith J. UhClerk
