MEETING OF MAY 14, 1984
The meeting of the Lexington Planning Board, held in Room G-15, Town Offices, was
called to order at 7:36 p.m. by the Chairman, Mrs. Smith, with members Cripps and
Uhrig and Planning Director Bowyer present. Mr. Sorensen joined the meeting in
progress. Mrs. Flemings was absent.

SUBDIVISION OF LAND
122. Simonds Estates, off Grove Street: Revision of Surety, Acceptance of
Surety, Release of Lots: The Board was in receipt of a letter from Oscar Cormier
dated May 7, 1984, requesting an up-to-date estimate of the amount of surety
necessary to complete Phase II of this subdivision, and a memorandum from Francis
Fields, Town Engineer, dated May 10, 1984, estimating the total cost to complete
Phase II, the North Emerson Road section of the subdivision, as $28,300. On the
motion of Mrs. Uhrig, seconded by Mr. Cripps, it was voted unanimously (3-0) to
revise the amount of surety for Phase II, the North Emerson Road section, from
$40,500, as voted at the meeting of March 5, 1984, to $28,300.
On the motion of Mr. Cripps, seconded by Mrs. Uhrig, it was voted 3-0 to accept
Form G-3, "Performance Bond Secured by Bank Passbook," executed by Oscar Cormier
and Thomas J. Byrne, accompanied by an assignment, dated May 11, 1984, executed by
Oscar Cormier of passbook #22396 issued by the Everett Cooperative Bank, balance
$28,300, as surety for the completion of Phase II, North Emerson Road, of the
Simonds Estates subdivision.
Mr. Sorensen joined the meeting at this time.
On the motion of Mrs. Uhrig, seconded by Mr. Cripps, it was voted 4-0 that,
sufficient surety having been provided, to release lots #13, 14 and 15 as shown on
the Simonds Estates subdivision plan.
OPINION ON CONSTRUCTION OF UNACCEPTED STREETS
123. 150-152 Reed Street, Lot 72-349, CUS 1984/1: The Board reviewed a plan of
proposed improvements to Reed Street dated April 27, 1984, stamped by Francis
DiPietro, Registered Professional Engineer, and a staff analysis dated May 11,
1984. The Board was in receipt of a recommendation from the Town Engineer dated
May 9, 1984 indicating the proposed improvements were acceptable if the gravel
base were extended eighteen inches beyond the travelled way. No waivers were
requested. On the motion of Mr. Sorensen, seconded by Mr. Cripps, it was voted
4-0 that:
1. In the opinion of the Planning Board, Reed Street, insofar as it provides
frontage for Lot 349 as shown on Map 72, is not now of adequate construc-
tion. If the improvements identified on the "Plan and Profile Showing
Improvements to Reed Street - Lexington, Mass.," dated April 27, 1984,
prepared by Miller and Nylander Company, and bearing the stamp of Francis
D. DiPietro, Registered Professional Engineer, are made and a written
certification by Mr. DiPietro is submitted that the improvements, as shown
on the plan, have been completed, then Reed Street, insofar as it provides
frontage for Lot 349 on Map 72, will be considered to be of adequate grade
and construction.

2. The section of Reed Street shown on the plan shall be considered to be of
adequate grade and construction for a period of two years only from the
time of Mr. DiPietro's written certification that the improvements have
been made in conformity with the April 27, 1984 plan.
3. This opinion is limited to the construction of the street and should not
be interpreted as implying that the lot under consideration meets others
tests of the Zoning By -Law to qualify it as a building lot.
The meeting was adjourned at 8:03 p.m.
