HomeMy WebLinkAbout1983-02-14PLANNING BOARD MINUTES MEETING OF FEBRUARY 14, 1983 The meeting of the Lexington Planning Board, held in Room G-15, Town Offices, was called to order at 7:03 p.m. by the Chairman, Mrs. Smith, with members Nichols, Sandy, Sorensen, Uhrig, and Planning Director Bowyer present. ARTICLES FOR SPECIAL TOWN MEETING 26. Article 2 -- Conversion of Muzzey School: Mr. Bowyer reported on a conversa- tion with Kirk Noyes, the designated developer for Muzzey, relative to four sug- gestions contained in the Planning Board's report. Point 1 -- Noyes said that not more than 30% of the dwelling units could be offered at the "pre -sold" price be- cause those are "give away" prices, below the basic financial structure of the proposal. Point 2 -- Noyes agrees that a preference should be offered to the applicants who meet the August, 1982, income guidelines. Point 3 -- Noyes agrees in concept with discouraging the deferral of purchases to avoid deed restrictions. The particulars on matters such as the time period and the percentage of the sales price that the Town would receive on unrestricted units, needs to be worked out; he thinks somewhere between 12 and 15 percent is reasonable. Point 4 -- Noyes sug- gests modifying the definition of "completion of construction" as the completion of all public interior space, all exterior site work and the issuance of the first occupancy permit. Mr. Sandy inquired what would happen if an income qualified person purchased a unit and then rented it to non -qualifying persons. Mrs. Smith thought there would be a ' provision in the condominium agreement to control rentals. On the motion of Mrs. Nichols, seconded by Mrs. Uhrig, it was voted 4-1, with Mr. Sandy opposed, to approve and sign the report and recommendation to the Town Meet- ing. Mr. Sandy explained that he voted against the recommendation because he does not think negotiations have gone far enough, too much is left to the Board of Selectmen, providing a maximum of 30% of the units at the "pre -sold" price was not acceptable, and the question of rental to non -income qualifying persons was still open. Gail Colwell, Chairman, and Ellie Klauminzer, member of the Housing Needs Advisory Committee were present. Mrs. Colwell reported that she had contacted all members of the committee except one and they had agreed to support the Planning Board report and were in favor of pursuing the four suggestions in further negotiations. The Board reviewed a memorandum, "Addition of LexHAB Concept to the Muzzey Article" from Chairman Smith, and an outline of a proposal for a Lexington Housing Assist- ance Board. Mrs. Smith explained that she wanted the Board to be aware that the LexHAB proposal would be included in the Muzzey article. Mr. Sorensen commented that there was too little information to take a position. Mrs. Nichols commented that while she favors the concept of a housing assistance board to aid in the de- livery of affordable housing, she doesn't know enough about the proposal to support it at this time. 1 1 1 Planning Board Minutes: 2/14/83 2 27, Article 3 -- Acceptance of Meadow Brook Avenue, Wellington Lane Avenue: On the motion of Mr. Sorensen, seconded by Mr. Sandy, it was voted unanimously to approve and sign a favorable recommendation that the Town accept the layout of Meadow Brook Avenue and Wellington Lane Avenue because they are desirable additions to the system of public streets in that neighborhood. The report also states that the Board believes that other streets have a higher priority than Meadow Brook Avenue and Wellington Lane Avenue. 28. APPLICATIONS TO BOARD OF APPEALS The Board reviewed a staff analysis, dated February 14, 1983, for cases to be heard by the Board of Appeals on February 24, 1983. On the motion of Mr. Sorensen, sec- onded by Mr. Sandy, it was voted unanimously to make no recommendation on the fol- lowing cases: 81-83 Hartwell Avenue, Dupree Associates: SP, free standing sign 131 Hartwell Avenue, DuPree Associates: SP, free standing sign On the motion of Mr. Sorensen, seconded by Mrs. Nichols, it was voted unanimously to make no recommendation on the following case: 26 Barberry Road, Norman L.
