HomeMy WebLinkAbout1982-09-13PLANNING BOARD MINUTES MEETING OF SEPTEMBER 13, 1982 The meeting of the Lexington Planning Board, held in Room i called to order at 7:35 p.m. by the Chairman, Mrs. Smith, - Sandy, Sorensen, Uhrig and Planning Director Bowyer present, 135. APPROVAL OF MINUTES 351 G-15, Town Offices, was with members Nichols, on the motion of Mr. Sorensen, seconded by Mrs. Nichols, the minutes of the meeting _ of September 7, 1982, were approved as written by a vote of 4-0. Mr. Sandy abstained as he did not attend that meeting. SUBDIVISION OF LAND 136. Simonds Estates, off Grove Street: Extension of Time: On the motion of Mr. Sorensen, seconded by Mrs. Nichols, it was voted 4-0, with Mr. Sandy abstaining, to grant the request of Oscar Cormier, contained in a letter dated September 13, 1982, that the time for action on his application for approval of a definitive subdivision plan be extended until September 22, 1982. Mr. Sandy objected to such a short exten- sion of time because he thought it did not provide enough opportunity for neighbors to inspect the plans and for the Board to act on the Certificate of Action. Mr. Sorenen reported that he had personally delivered a copy of the drainage calcula- tions to Mr. Levine, an abutter, so that they may be reviewed by Mr. Levine's brother who i� a registered professional engineer. 137. Battleview, off Young Street: Reduction of Surety, Approval of Surety, Release of Lots: The Board reviewed a memorandum from Peter Chalpin, Assistant Town Engineer, dated September 2, 1982, indicating that additional work had been completed and rec- ommending the amount of surety be reduced by $5200 from the amount contained in his earlibr memo of August 30, 1982. On the motion of Mr. Sorensen, seconded by Mrs. Uhrig1, it was voted 3-0, with Mrs. Nichols and Mr. Sandy abstaining, to reduce the amount of surety on the Battleview Subdivision from $13,000 to $6980. Mr. Bowyer reported that a passbook, containing $6990 had been delivered to the Planning Board. On the motion of Mr. Sorensen, seconded by Mrs. Nichols, it was voted 4-0, with Mr. Sandy abstaining, to accept Form G-3, "Performance Bond Secured by PassBook" executed by Phillip C. Heidke, Heidke Realty Trust, and Paul J. Farrington, Lexington Savings Bank, and Lexington Savings Bank Passbook #1072763 as surety for the completion of the Blattleview Subdivision. Kitson Park, off Concord Avenue: Approval of Surety: On the motion of Mr. Sore sen, seconded by Mrs. Uhrig, it was voted unanimously to accept as surety a doc- umen dated August 9, 1982, executed by William H. Hamilton and Marilyn H. Hamilton, as t steel of Volunteer Associates Realty Trust, which indemnifies and holds harm- lessIthe Town of Lexington against any damages resulting from the action of the Town in a cepting and laying out Kitson Park Drive as a public way. A letter from Town Coun el, dated August 20, 1982, was submitted stating that the surety agreement sub- mitt6ld by Mr. and Mrs. Hamilton appeared to be in satisfactory form. The was reconvened at 9:33 p.m. ON CONSTRUCTION OF UNACCEPTED STREETS 139. �ing Street, Map 14, Lot 124, CUS 1982/2: The Board reviewed a staff analysis, dated eptember 10, 1982, on the condition of King Street. Mrs. Nichols and Mrs. Smith,1who had visited the locus, commented that King Street was very narrow and the intersection with Fern Street was poor with respect to sight distance. On the motion of Mr. Sorensen, seconded by Mrs. Nichols, it was voted unanimously that: the opinion of the Planning Board, King Street, which would provide access Lot 124 on Assessor's Map 14, is not of adequate grade or of adequate con- uction. The reasons are: 1) width is only 12-14 feet in places and two vehicles could not pass; ) the grade is 13% in part of the street; 3) there is no turnaround sufficient for large municipal vehicles and the street diffuses into several private driveways; and 4) the alignment of the street at its intersection with Fern Street is awkward and th sight distance at that intersection is poor, raising safety concerns about turning movements in the intersection. The fact that the street is paved and has six older houses on it already is a favorable consideration, but by itself, does not off- set th other factors which do not comply with the Planning Board's "Policy on Con- struct'on Standards for Unaccepted Street Relative to Building Lots." 140. Applications to the Board of Appeals The Board reviewed a staff analysis dated September 10, 1982, for cases to be heard by the Board of Appeals on September 16, 1982. It was agreed to make no recommenda- tion on the following case: 87 Marrett Road, Michael Jansen: variance, side yard 3 Abbott Road, Jane Forsyth: SP, use of a portion of a dwelling for office: On the motion of Mr. Sorensen, seconded by Mrs. Nichols, it was voted unanimously not to commen on the merits of the case but to indicate the Board is not in favor of granti g a special permit for a ten year period; the Board would be in favor of a two-fo r year period. 331 Cdncord Avenue, Louis Cannizzo: SP, conversion to two family house: Mr. Sandy commented that a condition should be added that the lot could not be subdivided further while being used as a two family house. On the motion of Mr. Sorensen, secon ed by Mr. Sandy, it was voted unanimously to recommend in favor of granting the speci 1 permit provided there is a condition that the lot shall not be reduced in size ile it is used as a two family dwelling under this special permit. 2 andl3 Forbes Road, Honeywell, Inc.: SP, temporary office trailers: William Dailey, attorney for Honeywell, was present. He assured the Board that Honeywell will offer to have a condition included in the special permit that would prevent Honeywell, Inc., from obtaining more than one temporary special permit for a twelve month per- iod. He explained that Honeywell, Inc., is working out plans to relocate some of the facilities and operations now on Forbes Road to Marlboro. That depends on a corpor- ate decision on financing the project. If the Marlboro facility is constructed, f 9 C Minutes of September 13, 1982 3 Honeywell may need between 14-18 months to effect the relocation. That would re- quire one temporary special permit for a twelve month period and another temporary special permit for a shorter period. If the corporate decision is made to not con- struct the Marlboro facility, then Honeywell will remove all the trailers from Forbes Road within the next twelve months and one temporary special permit for a twelve month period would be adequate. There was considerable discussion as to the amount of time that Honeywell should be allowed to remove the trailers. Board members expressed concern about traffic con- ditions in the area, the excessive amount of parking on the site, and coordination with the Conservation Commission on unauthorized expansion of the parking lot. A motion by Mr. Sorensen, seconded by Mr. Sandy, that the Board recommend in favor of granting the special permit request for a period of not more than six months, with language indicating a willingness to accommodate a longer time period if there is a specific commitment to another building, was not adopted by a vote of 2-3, with Mrs. Nichols, Mrs. Smith and Mrs. Uhrig opposed. On a motion by Mrs. Nichols, seconded by Mrs. Uhrig, it was voted 3-2 with Mr. Sandy and Mr. Sorensen opposed, to recommend in favor of granting a special permit for a one year period provided a condition was in- cluded, as Mr. Dailey had outlined, that Honeywell would obtain only one full twelve month special permit and another special permit for a shorter period of time if need- ed as part of a specific relocation plan, and that if no specific alternative con- struction plan were approved by Honeywell, Inc., then it would remove all trailers from the premises within the next twelve months. COMPREHENSIVE PLANNING, POLICIES ' 141. Minuteman Bikeway: The Board reviewed, and corrected, the draft of a letter dated September 13, 1982, relative to the effect of the railroad right-of-way and the Minuteman Bikeway on the development of single family homes adjacent to the right-of- way. On the motion of Mr. Sorensen, seconded by Mr. Sandy, it was voted unanimously to transmit the letter, as corrected, to the Board of Selectmen. The meeting was adjourned at 11:01 p.m. 1 'Judith J.
