HomeMy WebLinkAbout1982-02-081 l SII 473 Minutes of Planning Board Meeting February 8, 1982 The meeting of the Lexington Planning Board, held in Room G-15, Town Offices, Was called to order at 7:35 p.m. by the Chairman, Mr. Sandy, with members ::ichols, Smith, Sorensen, Wheaton and Planning Director Bowyer present. 19. Approval of Minutes 7n the motion of Mrs. Wheaton, seconded by Mrs. Nichols, the minutes of the neeting of January 18, 1982,. were approved unanimously as written. The meeting was recessed at 7:44 p.m. so that the Board could meet jointly with the Board of Selectmen to discuss zoning policy relative to traffic improvements in the Bedford Street/Hartwell Avenue area. The meeting was reconvened at 8:17 p.m. 20. APPLICATIONS TO BOARD OF APPEALS The Board reviewed a staff analysis dated February 5. 1982 on cases to be heard by the Board of Appeals on February 25, 1982. On the motion of Mrs. Smith, seconded by Mrs. Wheaton, it was voted unanimously to, make no recommendation on the following cases: 35 Hartwell Avenue, Atex, Inc.: SP, sign 10 Pleasant Street, Wilson Farm, Inc.: SP, roadside stand The Board the discussed the case of 27-31 Waltham Street, Peking Gardens: S_, --__- restrictions. On the motion of Mrs. Wheaton, seconded by Firs. Nichols, it was voted unanimously to recommend that the limitations in the present special permit not be removed until such time as the Town can evaluate: 1) the effect of the new parking program on parking in Lexington center, and 2) the effect of the new Cory's restaurant on parking. It was agreed to include in the recommendation the data contained in the staff analysis.' SUBDIVISION OF LAND 21. Woodpark Estates: Request for Reduction of Surety: The Board reviewed a memorandum from Michael Hanlon, Town Engineer, dated December 17, 1981, indi- cating that all work has been completed, final as -built plans have been sub- mitted and the only remaining item is to insure that trees planted in the fall survive the winter. Mr. Bowyer noted that the amount of the surety could not be reduced below $9,150 which is 15% of the original amount. On the motion of Mr. Sorensen, seconded by Mrs. Wheaton, it was voted unanimously: That, in response to the request of Andrew J. Laney dated January 6, 19821, and after review of a memorandum from Michael J. Hanlon, Town Engineer, dated 12/17/81, the amount of surety for the Woodpark Estates Subdivision be reduced from $61,000 to $9,150. 2 Minutes of 2/8/82 4'71 ?=PORTS 22. Planning Director Mr. Bowyer asked the Board's interpretation as to what uses are per- mitted in a CD zoning district. The Board's preliminary conclusion was that only commercial or industrial uses are permitted. When the CD section of the By -Law was drafted, it did not appear that a mixture of commercial, housing and other non-commercial uses would be included in a CD district and no provision was made for them. Design Advisory Groups Mrs. Nichols reported that Don Olson was Q covering the hearings of February 41 John Crowe would attend the hear- ings of February 10, and Tony Cassendino the hearings of February 24. Q b. Firs. Nichols reported that the Board of Appeals had denied the request for a variance by Lexington Gardens to permit the sale of firewood be- cause it could find "no legal mechanism" to do so.
