HomeMy WebLinkAbout1980-12-221 1 11 PLANNING BOARD MEETING December 22, 1980 The meeting of the Lexington Planning Board was called to order at 7:40 p.m. by the Chairman Mrs. Wheaton with members Friedman, Nichols, Sandy, Sorensen, Planning Director Bowyer and Assistant Planner Asen present. DETERMINATION OF PLANNING BOARD APPROVAL Land on Lowell Street, Form A80-25: Upon a motion by Mr. Sorensen, seconded y Mr. Friedman, it was voted unanimously to take from the table a revised plan, showing land fronting on Lowell Street, near Lillian Road. Upon a motion by Mr. Sorensen, seconded by Mrs. Nichols it was voted unanimously: The plan entitled "Plan of Land in Lexington, Mass.", dated December 8, 1980, prepared by Everett M. Brooks Company, civil engineers of Newtonville, Mass., certified by Charles Thompson, registered Land sur- veyor, with application Form A80-25, by Haskell Reed, applicant, does not require approval under the Subdivision Control Law. Land off Allen Street Form A80-27: The Board discussed a plan for the proposed conservation acquisition to the Town from Trinity Covenant Church, off Allen Street. Upon a motion by Mr. Sandy, seconded by Mr. Friedman it was voted un- animously to: Authorize the Planning Director to sign Form A80-27 showing land off of Allen Street, to be acquired for conservation purposes, providing the plan has notations on it indicating that none of the lots delineated are build- ing lots and that Clematis Road is not a legal street. Land on Marrett Road, Form A80-28: The Board reviewed a plan showing land front- ing on Marrett Road near Spring Street. Upon a motion by Mr. Sorensen, second- ed by Mrs. Nichols, it was voted unanimously. The plan entitled "Plan of Land in Lexington, Mass.", dated December 12,1980 prepared by John J. Sullivan, land surveyors of Arlington, Mass., certified by John J. Sullivan, registered land surveyor, with application Form A80-28, by Dean Curtin, applicant, does not require approval under the Subdivision Control Law. PUBLIC HEARING: PROPOSED AMENDMENTS TO THE RULES AND REGULATIONS GOVERNING THE SUBDIVISION OF LAND IN LEXINGTON, MASS. At 8:10 p.m., a public hearing on the proposed amendments to the Rules and Regulations Governing the Subdivision of Land in Lexington, Mass; was opened. The hearing was closed at 8:15 p.m. No one in the audience spoke in favor of, or opposition to, the proposed amendment. Upon a motion by Mr. Friedman, seconded by Mr. Sandy it was voted unanimously to insert the following sentence at the end of each of the proposed amendments. "The Planning Board may waive this filing fee if the applicant is a government agency." 12.22.80 page 2 Upon a motion by Mr. Friedman, seconded by Mr. Sandy it was voted unanimously to approve, as changed, the amendments to the Rules and Regulations Governing the Subdivision of Land in Lexington, Mass. as follows: 1. By inserting the following sentences at the end of the paragraph of Section 2.1 "Each Form A shall be accompanied by a filing fee, payable to the Town of Lexington, of $25 if the form is merely to confirm exist- ing lot boundaries or $50 if there.is-a change in lot lines. The Plan ing Board may waive this filing fee if the applicant is a government agency." 2. By striking out the last sentence of Section 3.2 and inserting in place thereof the following new sentences: "A definitive subdivision plan shall be accompanied by a filing fee, payable to the Town of Lexington, of $500 plus $25 for each lot. The Planning Board may waive this filing fee if the applicant is a government agency." 3. By striking out the sentence of Section 8.1(b) and inserting in place thereof the following new sentences: "A filing fee, payable to the Town of Lexington, of $500 plus $25 for each lot. The Planning Board may waive this filing fee if the applicant is a government agency." PROPOSED AMENDMENT TO THE PROCEDURAL RULES AND REGULATIONS FOR SPECIAL PERMITS UNDER SECTION 9.4 OF THE ZONING BY-LAW Upon a motion by Mr. Sandy, seconded by Mrs.Nichols it was voted unanimously to approve an amendment to the Planning Board's Procedural Rules and Regulations for Special Permits under Section 9.4 of the Zoning By -Law as follows: 1. By striking out the first two sentences of paragraph one and inserting in place thereof the following new sentences: "Each application shall be accompanied by a filing fee of $500 plus $25 per lot, and shall contain six copies of each required document. The $500 filing fee will be waived if the application is accompanied by a definitive subdivision plan. ARTICLES FOR 1981 ANNUAL TOWN MEETING The Board reviewed its proposed articles for the 1981 Annual Town Meeting. The Board agreed to submit 10 articles on the Warrant. SUBDIVISION OF LAND Colbourne Subdivision, Request for Release of Surety: The Board reviewed a memorandum from Michael J. Hanlon, Town Engineer, dated December 16, 1980, recommending not to release the final surety of $6,250, until as -built plans are submitted and approved. Upon a motion by Mrs. Wheaton, seconded by Mr. Friedman it was voted unanimously: To retain the final surety for Mountain Road, Colbourne Subdivision, until as -built plans are submitted and approved, as required under section 9.6 of the Rules and Regulations Governing the Subdivision of Land in Lexington, Mass. 1 1 The meeting adjourned at 10:50 p.m. Laura F.
