HomeMy WebLinkAbout1980-10-02PLANNING BOARD MEETING IN EXECUTIVE SESSION October 2, 1980 Upon unanimous vote, the Lexington Planning Board met in executive session at 5:38 p.m., with members Wheaton, Nichols, Friedman, Sorensen, Sandy, and Planning Director Bowyer present, for discussion of a Board of Appeals decision overturning a ruling of the Building Commissioner in a case at 258 Marrett Road. The Board heard from Mrs. Wheaton and Mr. Bowyer on a meeting which they had held with Norman Cohen, Town Counsel. Under the provisions of the Town Manager Act, Mr. Cohen said the Planning Board may not enter into litigation without the approval of the Board of Selectmen and the Town Manager. The Board reviewed the final draft of a communication to the Board of Selectmen and Town Manager which outlined the reasons an appeal to the Courts is justi- fied and which requests that counsel be made available. This communication incorporates comments made by members on the draft discussed at the executive session meeting of September 29, 1980. Upon a motion by Mr. Sandy, seconded by Mr. Friedman, the Planning Board voted unanimously to transmit the communi- cation to the Board of Selectmen and the Town Manager and to request to meet with the Board of Selectmen, in executive session, on Monday evening, October 6, 1980. Nichols, Clerk i PLANNING BOARD MEETING October 2, 1980 The meeting of the Lexington Planning Board was called to order at 5:10 p.m. by the Chairman Mrs. Wheaton with members Sandy, Nichols, Friedman, Sorensen, and Planning Director Bowyer present. REZONING IN BURLINGTON Mr. Bowyer informed the members that a notice had been received of a public hearing this evening, October 2, 1980, on a proposal to rezone 17 acres of land in Burlington off Adams Street to an industry district. Several resi- dents of Lexington had called to obtain information about it. He had also heard that the Burlington Town Meeting would convene next Monday, October 6. Mrs. Wheaton will attend the public hearing and report at a subsequent Planning Board meeting. MILLBROOK VALLEY RELIEF SEWER The Board reviewed a letter to the Executive Office of Environmental Affairs, prepared by Mr. Friedman. On a motion by Mrs. Nichols, seconded by Mr. Sandy, it was voted unanimously to approve the letter as written and to furnish a copy to the Conservation Commission. APPLICATION TO BOARD OF APPEALS 177-181 Bedford Street, Knights of Columbus, Moore Homes, Inc.: The Board re- viewed, and amended, a supplementary recommendation to the Board of Appeals stating that if the condition in the Planning Board's recommendation of September 7, 1980, which would limit activities in the Knights of Columbus club house or function rooms during business hours, is not included in the Board of Appeals decision, the Planning Board recommends that the variances, both for the Knights of Columbus and Moore Homes Inc., should be denied. Upon a motion by Mr. Sandy, seconded by Mrs. Nichols, it voted unanimously to transmit the supplementary recommendation, as amended. PLANNING DIRECTOR'S REPORT 424 Bedford Street, Boston Properties Development: Mr. Bowyer noted that within the last two days, the Board had received a notification from the Executive Office of Environmental Affairs of an on-site meeting to be held Thursday, October 2, 1980 at 10:30 a.m. to obtain comments as to whether or not an Environmental Impact Report should be required. He reported that several Town officials, including Mrs. Frick of the Conservation Commission and Clifford Prentiss, Conservation/ Recreation Administrator had attended. Apparently the meeting was largely a rehash of the issues contained in the Planning Board's report to EDEA. It was agreed that Mrs. Wheaton would talk with Mrs. Frick to obtain a report on what had transpired at the meeting. Based on that conversation Mrs. Wheaton will report to the Board on whether the Planning Board should take any further action. Sale of the Adams School: Mr. Bowyer reported that an advertisement had been placed in the newspaper soliciting letters of interest from developers for the re -use of the Adams School property. He observed that there were a number of site development issues that could make the sale of the Adams School property more complicated than the sale of the Parker School property. He has requested a meeting of Page 2 10.2.80 the Town Manager's development committee (of certain department heads) to get a head start on these issues. At his suggestion, the Town is charging $15 for a packet of information about the Adams School. At 5:38 p.m., upon a motion by Mr. Sandy, seconded by Mr. Friedman, it was voted unanimously, by poll of the Board, to go into executive session for discussion of litigation, the disclosure of which could adversely affect the interests of the Town. It was agreed the Board would return to its open session only for the purposes of adjournment. Following discussion of matters which could be the subject of litigation against the Town, the Board returned to open session at 5:58 p.m. The meeting was adjourned at 5:59 p.m. Laura F.
