' The meeting of the Lexington Planning Board was called to order at 7:34 p.m.
by the Chairman Mrs. Wheaton with members Sandy, Nichols, Sorensen, Friedman,
Planning Director Bowyer and Administrative Clerk Mrs. Snow present.
APPROVAL OF MINUTES
The minutes of the Planning Board meeting of September 16, 1980, were amended
and upon a motion by Mrs. Nichols, seconded by Mr. Friedman,were unanimously
approved as amended.
APPLICATION TO THE BOARD OF SELECTMEN - PARKER SCHOOL
A draft of suggested conditions for the Special Permit to be recommended by
the Town Manager was reviewed by the Board. It was noted that conditions, as
listed in the Planning Board's September 9, 1980, report had been included
in the Town Manager's recommendations. Discussion followed on: time for
performance under the Special Permit, relationship of transfer of deed to
issuance of a building permit, and provision of a bond to ensure construction
within certain periods of time.
The Planning Board's draft supplementary report on the Parker School was
amended, and upon a motion by Mr. Sandy, seconded by Mrs. Nichols, was unani-
mously approved as amended.
Mrs. Wheaton will represent the Planning Board at the Board of Selectmen's
meeting at 9 p.m., for consideration of action on the Special Permit.
DETERMINATION OF PLANNING BOARD APPROVAL
Lot 5A Hancock Street, Form A80-19, Conservation Commission: The Board re-
viewed a plan showing land acquired by the Town for conservation under
Article 37, 1980 A.:T.M. Upon a motion by Mr. Sandy, seconded by Mrs. Nichols,
it was voted unanimously:
The plan entitled "Plan of Land in Lexington, Mass.", dated August 7,
1980, by Barnes Engineering Co., Inc., submitted on September 17, 1980,
with Application Form A80-19, by W. C. Prentiss, showing Lot 5A at
Hancock Street, does not require approval under the Subdivision Control
Law.
SUBDIVISION OF LAND
Ingleside, Ingleside Road: The Board considered the request of Emilio V. Spagnuolo
for extension of time for Planning Board action on the definitive plan, to
allow time for provision of documentation of all easements. Upon a motion by
Mr. Friedman, seconded by Mrs. Nichols, it was voted unanimously:
To extend to October 22, 1980, inclusive, the time on or before which
the Lexington Planning Board must act on the definitive subdivision
plan entitled "Ingleside" Amended Subdivision of Land in Lexington,
Mass., as requested by Kingston Builders Corporation, Emilio V. Spagnuolo,
applicant.

Town Counsel and the Planning Director will meet with the developer's
attorney, Stephen Russian, in the near future for resolution of the easement
situation.
APPLICATION TO BOARD OF APPEALS
The Board reviewed staff analyses and recommendations on petitions received
by the Board of Appeals as follows:
20 Wellington Lane Avenue, Ronald Campisi, Variance
Service area off Rte. 128, Howard Johnson Co., Special Permits
290 Bedford Street, Robert L. Vesprini, Variance
30 Ewell Avenue, M. Bernice Winsor, Variance and Special Permit
120 Worthen Road, Mary M. Hastings, Special Permit
30 Cottage Street, Bruce A. Jordan, Special Permit
3 Apollo Circle, James M. Burke, Special Permit
No recommendations will be made on the above mentioned applications.
544 Lowell Street, Lexington Gardens Inc., Peter Cavallaro: Upon a motion by
Mr. Sandy, seconded by Mrs. Nichols, it was voted unanimously to transmit the
report prepared by the staff as written. The report suggest conditions re-
garding hours of operation, truck deliveries, and internal road design.
388 Concord Avenue, George Forten, Special Permit: The Board agreed to oppose
the granting of a temporary permit for the use of a portion of the property for
the parking of motor vehicles for the reasons set forth in the staff memo-
randum. A final draft of the recommendation will be prepared for review at
the next Planning Board meeting.
CERTIFICATE OF ZONING COMPLIANCE:
2325 Massachusetts Avenue, Community Nursery School: The Board resumed dis-
cussion on the request of the Building Commissioner for Planning Board
recommendation on the issuance of a Certificate of Zoning Compliance. The
Chairman reported that she had not succeeded in contacting Town Counsel on
the question of possible violation of the Special Permit under which the
nursery operates if the lot is divided by endorsement of a Form A plan. It
was decided that the School should resubmit a Form A plan (Form A80-15 was
rejected on July 21, 1980). The Board will notify Community Nursery School
that a violation of conditions of the Special Permit issued by the Board of
Appeals in January, 1947, may be created and that the Special Permit should
be amended if the newly created lot is sold.
RESPONSE TO EXECUTIVE OFFICE OF ENVIRONMENTAL AFFAIRS:
424 Bedford Street, Boston Properties, Inc.: The Board reviewed a draft letter
to the Executive Office of Envirnomental Affairs regarding the Environmental
' Notification Form on Boston Properties development. The Board will request
that an EIR be prepared with attention to traffic problems which will be
created by the development. Upon a motion by Mr. Sandy, seconded by Mr. Friedman,
it was voted unanimously to approve the letter as amended by Mr. Sandy.

Millbrook Valley Relief Interceptor Sewer: A draft letter to the Executive
Office of Environmental Affairs, requesting adequate information to assess
the impact of the proposed sewer,was reviewed and upon a motion by Mr. Sorensen,
seconded by Mr. Sandy, was unanimously approved as written.
PLANNING DIRECTOR'S REPORT
Mr. Bowyer explained reasons and procedures for preparing a list of follow-
up actions of the staff, following each Planning Board meeting. The members
requested that they also be reminded, in some manner, of any responsibilities
or assignments.
Mr. Bowyer reported that the Department was essentially caught up with the
routine work, i.e, subdivisions, Board of Appeals cases. He stated that he
has three outstanding projects which will consume most of his time: CBD Study,
Unaccepted Streets Policy and the study of the Waltham Street area near
Waltham. He suggested the Board start in October on the schedule agreed to
earlier, i.e. two discussion meetings and two business meetings per month.
REPORTS BY MEMBERS
Mr. Sandy reminded the Board of his suggested Zoning By -Law amendment to
allow higher density, modestly sized housing units by Special Permit, and
that it should be scheduled for a discussion meeting.
' Mr. Sorensen requested that discussion of modification and updating of the
Subdivision Rules and Regulations be placed on the agenda of a discussion
meeting in the near future.
OCTOBER MEETING SCHEDULE
The Planning Board will hold meetings in the month of October as follows:
October 6, 14, 20 and 27, 1980.
