APPROVAL OF MINUTES called to order at 7:37 p.m. by the Nichols, Friedman, Planning and Planning Intern Asen The minutes of the meeting of July 21, 1980, were amended, and on a motion by Mr. Friedman, seconded by Mrs. Nichols, were unanimously approved as amended. RECOMMENDATIONS TO THE BOARD OF APPEALS, AUGUST 14 HEARINGS Potter Pond, Concord Avenue and Walnut Street, Boyd/Smith: A draft report on the petition for variances for garages with increased capacity and for re- duced distance between structures was reviewed. On a motion by Mrs. Nichols, seconded by Mr. Friedman, the recommendation was approved as written. 544 Lowell Street, Lexington Gardens, Inc., C. D. Hoogendoorn: A draft report on the application for a special permit to allow a wholesale operation at the existing greenhouses was reviewed. On a motion by Mr. Friedman, seconded by Mrs. Nichols, the recommendation was approved as written. 5_36 Massachusetts Avenue, James Shimansk , Special Permit - Swimming Pool; 35 Locust Avenue, Linda Wik, Variance (side yard)'for a Deck; 96 Bow Street, Edward Herman, Variance (frontyard) Addition to Non -conforming Dwelling: The Board reviewed a staff memorandum, dated July 29, 1980, and on a motion by Mr. Friedman, seconded by Mr. Sorensen, the Board agreed not to make a recommendation on the three cases. SUBDIVISION OF LAND Cambridge Farms, off Marrett Road, Determination of Amount of Surety: The Board reviewed a memorandum from the Town Engineer, dated July 23, 1980, providing a breakdown of the bond amount ($70,000) for construction at the Cambridge Farms subdivision. On a motion by Mr. Friedman, seconded by Mrs. Nichols, the Board voted unanimously to accept the value of $70,000 as surety for the Cambridge Farms subdivision. Ingleside Subdivision, Ingleside Road: At 8:02 p.m., a public hearing on subdi- vision approval and special permit for the definitive plan for Ingleside subdivision was opened. The hearing was closed at 8:31 p.m. The Board considered a request by Emilio V. Spagnuola, proponent of Ingleside subdivision, for extension of time for Planning Board action on the plan. Upon a motion by Mr. Friedman, seconded by Mrs. Nichols, it was unanimously VOTED: To extend to September 23, 1980, inclusive, the time on or before which the Lexington Planning Board must act on the definitive subdivision plan entitled "Ingleside" Amended Subdivision of Land in Lexington, Mass., as requested by Kingston Builders Corp., Emilio V. Spagnuola, applicant. 8.4.80 Kitson Park Estates Subdivision, off Concord Avenue: At 8:34 p.m., a public hearing on subdivision approval and special permit for Kitson Park Estates subdivision was opened. The hearing was closed at 9:50 p.m. The Board reviewed a request by William Hamilton, proponent of Kitson Park Estates subdivision, for extension of time for Planning Board action on the plan. Upon a motion by Mrs. Nichols, seconded by Mr. Friedman, it was unanimously VOTED: To extend to September 23, 1980, inclusive, the time on or before which the Lexington Planning Board must act on the definitive subdi- vision plan entitled "Kitson Park Estates in Lexington, Mass.", as requested by Volunteer Associates Realty Trust, William H. Hamilton, applicant. APPLICATION FOR DETERMINATION OF SUBDIVISION APPROVAL 177 Bedford Street, Knights of Columbus, Inc., Form A80-17: The Board re- viewed a plan submitted by Mark Moore, Jr., showing division of a parcel at 177 Bedford Street. A previous plan was rejected on July 21, 1980, under Application Form A80-16. Upon a motion by Mrs. Nichols, seconded by Mr. Friedman, the Board unanimously VOTED: To reject the plan submitted on July 30, 1980, with Application Form A80-17, by Mark Moore, Jr., President, Moore Homes, Inc., entitled "Subdivision ' Plan of Land in Lexington, Mass.", dated July 7, 1980, by Miller and Nylander, showing Parcels 2-A and 2-B at 177 Bedford Street. The plan is rejected for the following reasons: 1. The layout, as shown, increases the non -conformity of the parking area provided for the existing structure by separating some of the existing parking onto Parcel 2-B. 2. Part of the use of the existing structure is governed by a special permit dated July 25, 1961, which describes the structure as existing on a 2.22 acre parcel with 100' frontage. That use cannot continue in the structure on a smaller lot without amendment of the special permit by the Board of Appeals. PLANNING DIRECTOR'S REPORT Mr. Bowyer informed the Board of receipt of preliminary census figures for Lexington which/much lower than expected and may be inaccurate. The Planning staff will be working to assemble figures as a basis for an appeal of the federal count. Policy on Unaccepted Streets: In discussion of the draft policy, question arose as to procedures for improvement of paper streets. The Board is of the opinion that paper streets are similar to raw land and if a street is developed, it should be as a public way or as a new subdivision street. q,1ti�l� F Yil LirC.S Laura F.
