HomeMy WebLinkAbout1980-06-23PLANNING BOARD MEETING June 23, 1980 The meeting of the Lexington Planning Board was called to order at 7:35 p.m. by the Chairman Mrs. Wheaton with members Sandy, Nichols, Sorensen, Friedman, Planning Director Bowyer, and Administrative Clerk Mrs. Snow present. Mr. Friedman left the meeting at 9 p.m. to be present at the Board of Selectmen's discussion on mosquito control. APPROVAL OF MINUTES Minutes of the Planning Board meeting of June 16, 1980, were amended, and on a motion by Mr. Friedman, seconded by Mr. Sandy, were unanimously approved as amended. REPORTS BY MEMBERS Mrs. Nichols reported that the Planning Board and the Conservation Commission will be requested to review the scope of services of the contract for the drainage study of the Tophet Swamp area and tributaries_to be awarded to. Camp, presser and MacKee. LAND SUBDIVISION Willow Ridge at Barrett Road: Mr. Bowyer reported on his meeting on June 18, with Town Counsel Norman Cohen, the developer John Tuttle and his attorney, William Vincent to discuss a document prepared to resolve the question of location of lot lines at. Willow Ridge Subdivision. Both Mr. Cohen and Mr. Bowyer agreed that the document could not be readily understood and needed clarification. It was also noted that the Covenant, signed by the Board on May 19, 1980, was not representative of the factual situation regarding ownership of the land shown on the subdivision plan. A draft motion to rescind approval of the subdivision plan and to revoke the special permit were reviewed briefly but not acted upon. Upon a motion by Mr. Sandy, seconded by Mr. Friedman, it was unanimously voted to instruct the Planning Director to consult with Town Counsel regarding procedures for rescission of subdivision approval, Special Permit and Covenant for Willow Ridge subdivi- sion. If a public hearing is required, it should be scheduled for July 21, 1980. Battleview Subdivision at Young Street: Philip Heidke and his attorney, Burton Schafer were present to ask the view of the Board on a 3 -lot subdi- vision plan for the site of a previously submitted 4 -lot layout,which the Conservation Commission had disapproved. Mr. Heidke is appealing the Commission's Determination to DEQE. Mr. Bowyer reported that according to a preliminary staff review the lots seem adequate regarding layout and usable building area. Waivers will be sought on the radius of the cul-de- sac (110 ft. rather than 120 ft.) and the width of the road right-of-way (40 ft. rather than 50 ft.) Following withdrawal of the appeal to DEQE, and Determination by the Conservation Commission, definitive plans will be filed with the Planning Board. DETERMINATION OF SUBDIVISION APPROVAL 123 Marrett Road, Robert Cataldo, Form A80-13: The Board reviewed a plan which was rejected on June 16, 1980, as Application Form A80-12, and has now been resubmitted by Robert Cataldo with Application Form A80-13. It Page 2 6.23.80 was noted that the previously missing information, on setback dimensions of the building, had been determined by field survey and were now shown on the plan. However no revision date was shown. Upon a motion by Mr. Sandy, seconded by Mrs. Nichols, it was unanimously VOTED: The plan entitled "Plan of Land in Lexington, Mass.", dated June 9, 1980, revised June 20, 1980, by Joseph W. Moore Co., submitted with Application Form A80-13, on June 20, 1980, by Robert Cataldo, showing Lot C-4 and Lot C-5 at #123 Marrett Road, requires no approval under the Subdivision Control Law. It was also voted that the Planning Director be authorized to sign the plan on behalf of the Board following addition of the revision date. PLANNING DIRECTOR'S REPORT Mr. Bowyer reported to the Board on projects currently being carried out by the staff. Sensitive Areas Analysis: One of the major work items will be analysis of the Waltham Street area, south of Route 2, which was given first priority as a sensitive area. The in-depth study of this area will be completed to about 85% and will be used to determine the analytical process for the study of subsequent areas. Board of Selectmen's Goals and Objectives: The Goals and Objectives of the Board of Selectmen for the year 1980, were noted and were discussed briefly.
