PLANNING BOARD MEETING
June 2, 1980
The meeting of the Lexington Planning Board was called to order at 7:36 p.m.
by the Chairman Dr. Friedman with members Sandy, Nichols, Sorensen, Wheaton,
Planning Director Bowyer and Administrative Clerk Mrs. Snow present.
REPORTS BY MEMBERS, SUBCOMMITTEES
Dr. Friedman reported on his meeting with Michael Colangelo and Ed Darman
on preliminary plans for an office park on land near the Waltham line at
Waltham Street. It was agreed that area of Waltham Street, on both sides
of the street, should be evaluated using the Sensitive Areas Analysis
checklist and that the matter will be discussed at the June 9 meeting.
Mrs. Wheaton reported that in the process of renumbering and reordering the
ZoningBy-Law this year, a line in Section 9.6.4 a., National Flood
Insurance, was inadvertently omitted. According to Town Counsel, a zoning
amendment article will be necessary to reinstate the phrase in the By -Law.
APPROVAL OF MINUTES
Minutes of the Planning Board meeting on May 19, 1980, were corrected, and
then, on the motion of Mrs. Wheaton, seconded by Dr. Sandy, were approved
unanimously.
PLANNING DIRECTOR'S REPORT
Mr. Bowyer reported on a situation which has been brought to his attention
involving lot lines of Lots 6, 7 and 8 in the Willow Ridge subdivision.
Elliot Abrons, who lives in a house on Lot 7, Barrett Road, has produced
a recorded plot plan showing his lot line with a different configuration
than that shown on the approved subdivision plan. Mr. Bowyer, upon advice
of Town Counsel, has written to Mr. Tuttle, developer of Willow Ridge, that
the approved subdivision plan will not be released for recording until he
and Mr. Abrons resolve their differences, and clear evidence of the solu-
tion has been provided to the Town Counsel and to the Planning Board.
HUD 701 Comprehensive Planning Funds: As requested by the Town Manager,
Mr. Bowyer investigated submitting an application for 701 funds. It was
concluded that the amount of money to be realized was so small, it did not
justify the work involved to prepare the application.
Procedure for Recording Form A Plans: In the light of the recent alteration,
following endorsement, of a Form A plan, Mr. Bowyer suggested a new procedure
for recording of the originals. The applicantwould be required to record
the plan within a limited time,and to provide the Planning Board with a
certified copy, in reduced form, of the recorded plan. This..procedure would.
give assurance that the plan was recorded, but the Board questioned that no
changes could be made after endorsement. The Board asked Mr. Bowyer to inves-
tigate the possibility of mailing the originals to the Registry or sending
them by courier for recording, so that the endorsed plan is never in the
custody of the applicant.

LAND SUBDIVISION
Lincoln Hill, off Morgan and Jean Roads, Michael Saulich, applicant:
Mr. Sandy abstained from voting on this item because he is a member of
Temple Isaiah, an abutter.
The Board reviewed a draft Special Permit for Lincoln Hill subdivision.
The draft was amended, and upon a motion by Mrs. Wheaton, seconded by
Mrs. Nichols, was approved unanimously as amended. (Mr. Sandy abstained)
A draft Certificate of Action for Lincoln Hill subdivision was reviewed,
amended, and upon motion by Mrs. Nichols, seconded by Mr. Sorensen, it
was voted unanimously (with Mr. Sandy abstaining):
To approve, subject to terms and conditions of a covenant given under
the provisions of Section 81-U, Chapter 41 of the General Laws and
subject to further terms and conditions enumerated in the Certificate
of Action, dated June 2, 1980, the definitive subdivision plan entitled
"Lincoln Hill, Lexington, Mass.", dated November 20, 1979, revised
March 25, 1980, revised May 5, 1980, by Miller and Nylander, registered
professional engineers and surveyors, Michael and Evelyn Saulich,
applicant.
RECOMMENDATIONS TO THE BOARD OF APPEALS
' Boston Properties, 424 Bedford Street: A draft report on the application
for a Special Permit for the proposed office park development was reviewed.
The draft report, which recommended granting the Special Permit, will be
revised to reflect the unanimous Planning Board opposition to granting the
Special Permit unless the traffic problem can be resolved.
A draft report on the Boston Properties application for variances from
Section 9.8, Parking and Loading Regulations, was reviewed. It was voted
that a new draft report will be prepared which recommends against granting
of the variances. Mr. Friedman, Mrs. Wheaton, Mr. Sandy, and Mr. Sorensen
voted in favor of the new draft. Mrs. Nichols voted in opposition.
258 Marrett Road, Lynne M. and Robert F. Butts:
Mr. Bowyer distributed copies of a draft report on the petition of Robert F.
and Lynne M. Butts, for a variance from Section 7.1 and Table 2 to permit
construction of a single family dwelling at 258 Marrett Road. Deeds dated
1922, and 1967, and a plan dated January, 1980, were shown that demonstrate
that the lot in question had been combined with abutting land and later sold
as a separate lot. Building Commissioner Peter DiMatteo's March 25, 1980,
letter was read in part informing Mr. Butts that "Lot" 4 is not a buildable
lot and was not properly subdivided in 1967. The members agreed to oppose
the variance, to review the draft further and to furnish any desired changes
in language before June 4.
The petitions of Joseph and Adeline Fournier appealing the denial by the
' Building Commissioner of a building permit for construction at 21 Moreland
Avenue, was reviewed. Town Counsel's ruling that only one lot exists was
noted. It was agreed that recommendations would be prepared, for action

as a local matter with the

recommendation
on the variance.
APPLICATION FOR DETERMINATION OF SUBDIVISION APPROVAL
38 Moon Hill Rd., Form A80-10: The Board reviewed a plan submitted with
Application Form A80-10, showing separation of Lots 19-B and 19-C from
Lot 19-A at 38 Moreland Avenue. Upon a motion made by Mr. Sorensen and
seconded by Mr. Sandy, it was unanimously VOTED:
The plan entitled "Compiled Plan of Land in Lexington, Mass.", dated
May 14, 1980, by Miller & Nylander, submitted on May 20, 1980, with
Application Form A80-10, by Mary 0. Thompson, showing Lots 19A, 19B and
19C at Moon Hill Road requires no approval under the Subdivision Control
Law.
DETERMINATION OF JUNE MEETING SCHEDULE
Meetings in the month of June will be held on June 9, 16, and 23, 1980.
The meeting adjourned at 11:40 p.m.
