October 16, 1978
The meeting of the Lexington Planning Board was called to order at 7:31 p.m.
by the chairman Mr. Zabin with members Wheaton, Sandy, Friedman, Nichols,
planning director Briggs, and secretary Mrs. Snow present. Also in atten-
dance was Mike Rosenberg, Lexington Minute -Man.
The Board reviewed a plan submitted with Application Form A78-29, show-
ing division of the Temple Isaiah property at Lincoln St. and Morgan FORM A78-29
Rd. into two lots (see minutes of 9.18.78). Because it appeared that TEMPLE ISAIAH
signing of the plan as not requiring subdivision approval would imply SAULICH
legal frontage for all lots abutting Morgan Rd. which is not of ade-
quate grade and construction, it was decided.that notation declaring
Lot 1 to be unbuildable should be added to the plan. Upon a motion
duly made and seconded, it was VOTED:
The plan entitled "Plan of Land Owned by Temple Isaiah to be Subdi-
vided into Lots 1 and 2", dated October 10, 1978, by Charles Agrillo,
submitted with Application Form A78-29 by Michael Saulich on October 11,
1978, showing Lots 1 and 2 at Lincoln St., requires no approval under
the Subdivision Control Law.
Mr. Sandy abstained from voting because he is a member of Temple Isaiah.
The vote was conditional upon addition of a notation as follows: "Lot 1,
not having sufficient frontage on a road of adequate grade and construc-
tion, is not a buildable lot". The Planning Director was authorized to
' sign the plan following addition of the notation.
At 8:20 p.m., Public Hearing on the definitive subdivision plan sub- PUBLIC HEARING
mitted by Meadowland Assoc., Inc. was held. The hearing closed at MEADOWLANDS
9 P.M.
Stephen Russian, Esq. and Paul Castlemery, met with the Board for discus-
sion of bond amount for completion of work at Mountain Rd. subdivision,
approved in 1972. It was felt that two issues needed to be addressed MOUNTAIN RD.
regarding items in the work cost estimate provided by Asst. Town Engr. SUBDIVISION
Martin, dated February 21, 1978. Mr. Russian asked Planning Board BOND
waiver of requirement for installation of granite curb and granite
bounds on the south side of the right-of-way. He also requested re-
duction of the bond amount if the aforementioned work items are not re-
quired. Upon a motion duly made and seconded, it was unanimously voted
that the surety necessary to ensure completion of work at Mountain Road
subdivision be set at $12,000 instead of $13,000 as recommended by
Asst. Town Engineer William J. Martin. Installation of radius granite
curbing (item #7 in Mr. Martin's Feb. 21, 1978 memo, and granite bounds
(item #8) will be required only on the south side of the right-of-way.
Mr. Russian also represents the Morels, purchasers of the Brown land atMOREL/MAPLE ST.
Maple St. Mrs. Morel, who was present, contends that the purchase of
the property was made on the basis of 6 existing lots plus Maple Terrace
which is access to the existing house. They propose to create four
' lots from the six lots listed in a deed recorded in 1976. Question
arose as to whether the six lots referenced in the deed and shown on a
plan recorded in 1910 have been legally combined by description in the
deed as one parcel. A plan dated September 28, 1978, revised October 5,
1978 was shown, with two non -conforming lots on Maple St., one non-
conforming lot fronting on "Maple Terrace", and the lot containing the
existing house with"Maple Terrace" as access and frontage. The 1910
' plan and the Morel/Brown deed will be sent to Town Counsel who will be
asked for opinion as to whether the lots can be considered to have been
combined.
Letter dated September 22, 1978, from Joel H. Greenstein, requesting
release of surety on Kendall Gardens subdivision, was noted. Asst.
Town Engineer Martin's September 28 memo recommended final release
but Mr. Briggs reported that the developer has failed to complete the
required tree planting and that no provision for fire alarm system has
been made. Mr. Greenstein will be advised that bond release will be
deferred pending the planting of trees, and either installation of a
fire alarm system or request for a waiver of the requirement under
Section 7.9 of the Rules and Regulations.

Regarding the request of Spaulding & Slye for release of surety on DRUMMER BOY
Drummer Boy Green, it was agreed that final decision on installation BOND
of a traffic light at Winter and Bedford streets should be deferred
for one year. Asst. Town Engineer Martin's October 2, 1978, memo
listing incomplete work items in the amount of $710, was eeviewed.
Mr. Briggs gave an estimated cost for traffic light installation as
$30,000. Upon a motion duly made and seconded, it was voted that
surety for Phase I of Drummer Boy Green development be released ($7,000)
and that surety for Phase II be reduced from $160,000 to $50,000.
