PLANNING BOARD MEETING
March 5, 1977
The meeting of the Lexington Planning Board was called to order at 10a.m.
by the vice chairman Mr. Zabin with members Clarke, Friedman, Brown and
planning director Briggs in attendance.
Dr. Wadsworth, Board of Appeals chairman, joined the meeting at 10:20 a.m.
for discussion of Town Meeting Articles and special permits. It appears SPECIAL PER -
that an agreement may be reached between the B/A and the Planning Board in MIT GRANTING
that special permits for Zoning Sections 33 and 39 will be handled by AUTHORITY
the Planning Board and Sections 36 and 38 will be handled by the Board of
Appeals.
At a meeting of the Board of Appeals on March 10, decision on allowing PEKING GARDEN
re -petition regarding expansion of Peking Garden Restaurant will be con- RE -PETITION
sidered. Also on that agenda will be discussion of the Warrant Articles
and special permit granting. The Planning Board will have one or more
representatives at the meeting.
Dr. Wadsworth also indicated B/A concern about the "no use variance" pro-
posal. Whereas he agreed with the idea of elimination of use variances,
he felt this could lead to difficulties for certain types of businesses
because of limitations in Section 25 of the Zoning By-law. Problem situ-
ations could arise involving, for example, veterinary hospitals, takeout
food services, boarding of horses, telephone answering services or profes-
sional use of private homes. The Planning Board agreed that this could be
a problem and indicated a study committee would be formed to see if some-
thing could be prepared for next year's town meeting to adjust Section 25.
Suggestions from the B/A were requested.
Dr. Wadsworth and Mr. Brown left the meeting at 10:45 a.m.

USE VARIANCES
The Planning Board discussed Articles 76 (Section 36) and 77 (Section 38).ARTICLES 76
Several minor changes were made in Art.77. The Planning Director will (SEC. 36) &
prepare corrected versions of these two Articles. 77 (SEC. 38)
The meeting adjourned at 12:45 p.m.
