January 3, 1977
The meeting of the Lexington Planning Board was called to order at 7:37 p.m.
by the chairman Mr. MacKenzie with members Friedman, Clarke, Zabin, Brown,
planning director Briggs, and secretary Mrs. Snow present. Also in atten-
dance was Robert Bradley, D.A.C.
Minutes of December 6, 1976, were approved as amended.
Request by Teodore L. Freeman for establishment of amount of surety for
Bicentennial Farms, and Engineering Dept. letter recommending $45,000,
were noted. The Board requested Mr. Briggs to obtain an itemized list
of work items to be completed at the subdivision. Upon a motion duly
made and seconded, it was voted that the amount of $45,000, as recom-
mended by the Town Engineer, be set as surety for completion of con-
struction at Bicentennial Farms
It was agreed that the public hearing on Kendall Gardens definitive
subdivision plan will be scheduled for February 14, 1977, at 8 p.m.
Letter from George Smith, Director of Public Health, dated 12/20/76,
covering DPW review of the preliminary plan, was noted.

Plan submitted with Application Form A77-1 by Frederick J. Conroy, Esq. FORM A77-1

been deprived of its continuous frontage due to the construction of the
interchange. Upon a motion duly made and seconded, it was VOTED:
The plan entitled "A Compiled Plan of Land in Lexington, Mass.", dated
November 26, 1976, by Oiva E. Hintsa, submitted on January 3, 1977, by
Frederick J. Conroy, Esq., for Heidke Realty Trust, with Application
Form A77-1, showing land at Spring St, Concord Ave., and Rte. 2 Inter-
change, requires no approval under the Subdivision Control Law.
The vote was contingent upon willingness of the applicant to have the
notation: "Not a buildable lot because of insufficient frontage" added
to the plan. The planning director was authorized to sign the plan on
behalf of the Planning Board, if the application is not withdrawn by the
applicant.
At 7:55 p.m., Asst. Town Engineer William Martin met with the Board for
presentation of layout plans for four construction streets: Cushing St.,
Banks Ave., Emerald St., and Hancock St.; proposal for abandonment of
portions of Hinchey Rd. and Wood St., and acceptance of four subdivision
streets: Brent, Suzanne, Emerson roads and Lois Lane. The Board's
recommendations on these plans will be presented in a letter to be pre-
pared by the chairman for transmittal to the Bd. of Selectmen, copy to
DPW/Engr., prior to the January 11 street hearings. It was decided that
discussion of name changes for four sections of Emerson Rd., and one
section of Worthen Rd will not take place in conjunction with the street
hearings. All residents deemed affected by the proposed changes will be
invited to an information meeting to be held by the Planning Board on
January 19, in Cary Memorial Hall.

B/A notices for Jan. 13, 1977, were noted. Of these, the Board expressed
oppostiion to the Duff petition for maintenance of a tower at 15 Oxford
St., height of which is in excess of 40'. Mr. Briggs reported on his
investigation of Mr. Duff's commercial activities with respect to the
135' tower, and his operation of Coastal Communications, Inc. from his
Lexington residence. A letter recommending against the granting of
variance regarding the tower will be prepared by the planning director.
As zoning enforcement officer, Mr. Briggs will proceed with issuance of
a formal complaint against Mr. Duff.
Mr. Briggs reported on the Superior Court decision upholding the Lexing- OSTROFF VS.
ton Board of Appeals finding on the Ostroff "Battleview Park" petition, B/A COURT
and implications of this decision were discussed. CASE
It was decided that public hearings on rezoning articles will be held
on February 9, 16, and 23, 1977 in the Science Lecture Hall if it is
available.
