HomeMy WebLinkAbout1975-12-29PLANNING BOARD MEETING December 29, 1975 The meeting of the Lexington Planning Board was called to order at 7:35 p.m. by the chairman Dr. Clarke with members Brown, MacKenzie, Zabin, planning director Briggs and secretary Mrs. Snow present. Also in attendance were Gordon Brigham, D.A.C., and Steve Politi, Lexington Minute Man. Draft Articles concerning wetlands, prepared by the Wetland Subcommittee, were considered. WETLAND ART. Draft Article "W-1" (setback requirements for streams) was reviewed and approved as written. Upon a motion duly made and seconded, it was unani- mously voted to ratify the action of the planning director in advertising the Public Hearing on the Article to be held on February 18, 1976. Draft Article "W-211, proposing rezoning of the Munroe Brook Meadow area as wetland, was reviewed and revised. Upon a motion duly made and seconded, it was unanimously voted to approve the revised draft Article and to ratify the action of the planning director in advertising the public hearing on the proposed amendment to be held on February 18, 1976. Corrected text for this advertisement will be submitted to the Minute Man for 2 -week publication. Draft Article "W -31f, Interim Wetland Protection Districts, was reviewed. It was agreed to delete references to maps 18-56, 19-56 and 24-56, from the last paragraph. Upon a motion duly made and seconded, it was unani- mously voted to approve the Article as corrected, and to ratify the action of the planning director in legally advertising the public hearing to be held on February 18, 1976. Draft Article "W-4", amendments to Section 37 of the Zoning By-law, was reviewed and accepted as written. Upon a motion duly made and seconded, it was unanimously voted to approve the Article, and to ratify the action of the planning director in legally advertising the Public Hearing to be held on the Article on February 19, 1976. Draft Article "-5", concerning basement elevations was reviewed and revised. Upon a motion duly made and seconded, it was voted to approve the Article as revised, and to ratify the action of the planning director in legally advertising the Public Hearing to be held on February 19, 1976. Draft Article "P", planting requirements (SPS), was reviewed, amended, ARTICLE SPS and upon a motion duly made and seconded, it was voted to accept Article PLANTING "P" as amended. REQUIREMENTS Dr. Clarke` draft Article "C", regarding condominium regulations, was ART."C" reviewed and approved as written. CONDO. REGS Article "R", concerning corrections of numbering to do with RD district ART. "R" was approved as written. RD Article "S" regarding correction of number designation in swimming ART. "S" pool regulations, was approved. SWIMMING POOL REGS. Draft Article "B", replacing several references to "Building Inspector" ART. "B" with "Building Commissioner", was approved. BLDG. INSPR. Draft Article "PUD -1", regarding acceptance of open space in Lowell Est. ART. "PUD -1" II subdivision, was approved as written. LOWELL EST. OPEN SPACE Draft Article "U", regulations concerning repair of unaccepted ways, ART. "U" was approved as written. REPAIR OF STS. Upon a motion duly made and seconded, it was unanimously voted that the Board of Selectmen will be requested to insert the aforementioned Articles in the Warrant of the 1976 A.T.M. It was also voted that the planning director be authorized to legally advertise Public Hearings for the Articles concerned with Zoning By-law amendments to be held on February 11, 1976, in Estabrook Hall. Draft Covenant, prepared by Town Counsel, for Bicentennial Farms COVENANT subdivision was reviewed. Question arose as to need for reference in BICENTENNIAL the text to matters involved with D.N.R. Order of Conditions. Town FARMS SUBDV. Counsel will be asked to advise. Plan submitted with Application Form A75-35, showing Lots 11 - 15 on FORM A75-35 Emerson Road, was reviewed. Upon a motion duly made and seconded, it EMERSON RD. was VOTED: CORBIN The plan submitted on December 22, 1975, with Application Form A75-35, by Roger Corbin, entitled "Compiled Plan of Land in Lexington, Mass.", dated December 19, 1975, by Joseph W. Moore Co., showing Lots 11-15 on Emerson Road, requires no approval under the Subdivision Control Law. It was also voted that the planning director be empowered to sign the plan on behalf of the Board. Plan submitted with Application Form A7536on December 23, 1975, by FORM A75-36 Alfred Tropeano, was reviewed. Upon a motion duly made and seconded, REVERE ST. it was VOTED: TROPEANO The plan submitted with Application Form A75-36 on December 23, 1975, by Alfred P. Tropeano for E.A.T. Realty Trust, entitled "Plan of Land in Lexington, Mass.", dated December 19, 1975, by Miller & Nylander, showing Parcels B and C off Revere Street, requires no approval under the Subdivision Control Law. The planning director was empowered to sign the plan on behalf of the Board. Plan submitted by Mr. Tropeano with Application Form A75-37 was reviewed FORM A75-37 It was noted that the plan, showing Lots 1, 3, and 10 on Hartwell Ave. HARTWELL PL. and Hartwell Place had been previously endorsed by the Planning Board TROPEANO under Application Form A74-13 in April, 1974, but apparently not recorded. The Board declined to re -endorse the plan seeing no need for such. Page 3 12.29.75 Reference was made to previous discussion (on 12.15.75) of A. J. Lane's WOODPARK EST. request that the Covenant for Woodpark Estates be rewritten, and the COVENANT favorable view of the Board at that time on the request. Dr. Clarke reported on subsequent advice of Town Counsel not to allow amendment of the instrument based on State statute which is explicite on such pro- cedures, which resulted in reversal of the Planning Board's position on the matter. The decision of the Board not to rewrite the Covenant was reiterated. The planning director reported on Recreation Survey data received to RECREATION date. Upon a motion duly made and seconded, it was voted to instruct STUDY the planning director and staff that no general distribution of the Recreation Survey print-out is to be made. Recreation Committee and Planning Board members only will receive preliminary information at this time. Board of Appeals notices for January 8, 1976, were noted. Of these, B/A HEARINGS the Planning Board will comment, in opposition, to the Calogero petition 1/8/76 for division and combination of two lots at Blake Road.
