HomeMy WebLinkAbout1970-04-271 1 LEXINGTON PLANNING BOARD April 27, 1970 The regular meeting of the Planning Board was held in its office on Monday, April 27, 1970. Chairman Lund opened the meeting at 7:30 p.m. with members Clarke, Graham, Worrell, Brown and Planning Director Zaleski present. Robert Lyon, a local realtor, met with the Board at 7:30 p.m. to present ROBERT LYON a proposal to discuss with property owners in the Center a plan for the PARKING AREA development of a municipal parking area in the heart of the block between IN CENTER Muzzey and Clarke Streets. He would attempt to arrange options for this, and simultaneously options to expand the present lot between Muzzey and Waltham Streets. Mr. John Culp of Justin Gray Associates met with the Board to discuss the development feasibility study in the Meagherville area and the possibility of a technical assistance grant from funds provided under Title 9 of the Demonstration Development Act of 1966 in the amount of $3,000. A letter to the Department of Community affairs, requesting this assistance, was reviewed and approved as amended. Also discussed was the possibility of the Planning Board and Town Engineer participation in the work on the study. Mr. Culp was asked to furnish the Board with a written form, indicating the work and dates with a deadline in September. It was suggested the Town Manager be asked to issue a letter authorizing Justin Gray Associates to commence with a sum specified up to $10,000 and Mr. Graham agreed to serve as coordinator for the Meagherville study. Dr. Howard Smith met with the Board and asked for a consideration of dividing his 2+ acres on Woodberry Rd. into two sizeable lots without the construction of a new road under the Subdivision Control Law. The Board felt it should consult with Town Counsel on this matter before giving Dr. Smith an answer. Upon a motion duly made and seconded, the Board VOTED: To extend to June 2, 1970, inclusive, the time withing which the Planning Board must act on the definitive subdivision plan entitled "Idylwilde Farm", dated December 29, 1969, as requested in writing by the developer. OF TIME to extend to June 2, 1970, inclusive, the time within which the FOR PL. BD. Planning Board must act on the definitive subdivision plan entitled ACTION - "Springdale Estates", dated July 13, 1969, as requested in writing SPRINGDALE EST. by the developer. Upon a motion duly made and seconded, the Board VOTED: EXT. OF TIME To extend to June 2, 1970, inclusive, the time within which the FOR PL. BD. Planning Board must act on the definitive subdivision pile entitled ACTION - "Drummer Boy", dated August 18, 1969, as requested in writing by the DRUMMER BOY developer. Upon a motion duly made and seconded, the Board VOTED: EXT. OF TIME To extend to June 2, 1970, inclusive, the time within which the FOR PL. BD. Planning Board must act on the definitive subdivision plan entitled ACTION - "Village Circle", dated May 12, 1969, as requested in writing by the VILLAGE CIR. developer. P1. Bd. Meeting, April 27, 1970 0 The minutes of the April 29 meeting were approved as amended. The plan submitted by Robert H. Colbourne with an application Form A #70-13, was reviewed and also discussed was a letter from Town Counsel concerning this plan. Upon a motion duly made and seconded, the Board unanimously VOTED: The plan entitled "Plan of Land in Lexington, Massachusetts'; dated April 19, 1970 by David D. Perley, £.E., showing lots off Turning Mill Rd. - accessible via a right-of-way known as Mountain Rd., requires approval under the Subdivision Control Law. The Conservation Commission met with the Board next to discuss plans for conservation easements. After a brief discussion of land on the Fessenden and Monroe Brooks, a motion was duly made and seconded to go into executive session to discuss matters the disclosure of which would adversely affect the financial interest of the Town or the reputation of any person. Following the discussion of proposed conservation land to be considered in 1970, the Conservation Commission retired and the Planning Board resumed open meeting. -2 The Board reviewed a plan submitted by Frederick J. Conroy for Richard Sparrow and a Form A application #70-14. Upon a motion duly made and seconded, it was VOTED: The plan entitled "Plan of Land in Lexington, Mass.", dated April 17, 1968 by Miller and Nylander, C. E. and Surveyors, showing lots 6, 7 and 8 on Militia Dr. does not require approval under the Subdivision Control Law. The Board reviewed a plan submitted by E. Conrad Levy for Robert Cataldo with a Form A application #70-12. Upon -a motion duly made and seconded, it was VOTED: The plan entitled "Plan of Land in Lexington, Mass.", dated April 20, 1970 by E. Conrad Levy, e. E. & Surveyor, showing lots off Emerson and Bryant Rds. does not require approval under the Subdivision Control Law. MINUTES FORM A #70-13 R. COLBOURNE TURNING MILL (MT. RD.) CONS. Upon a motion duly made and seconded, the Board VOTED: REQUEST BOR To authorize Town Counsel to prepare the instruments to release lots RELEASE OF LOTS on Barrett Rd. of the Minute -Man Highlands subdivision as requested MIN -MAN HGLDS. by Harvey Duffy of Partridge Associates, Inc. Letters prepared by the planning director expressing the Planning Board's HOUSE AND support or opposition to ;various House and Senate bills were discussed and SENATE BILLS signed with copies going to Rep. Khachadoorian, Rep. Cole and Sen. Mac- Kenzie. These letters were concerned with the following bills: House 579, 1064, 32969 43589 3804, 1934, 1224, 1169, 1170, 1171, 4358, 52630 831, 2270 and Senate 1169, 633, 1180, 1181 and 1163. The notices for the Board of Appeals hearings to be held on May 5, 1970 B/A NOTICES were reviewed. The planning director was asked to make an appointment with URBAN SYSTEMS Rudolph Kass, attorney for Urban Systems on May 4 to discuss the proposed APPT. child care facility on Concord Avenue. A letter prepared by the planning director to Mr. O'Connell, Town Manager, LETTER TO concerning the Standing Plumbing and Building By -Law Committee and the TOWN MGR. up -dating of the Building By -Law, was approved and signed. RE. BLDG. BY-LAW 1 1 i April 27, 1970 9 The Board noted and placed on file a copy of a letter from the residents of HAYDEN WOODS Woodhaven to the Selectmen asking about the status of the Hayden Woods CONSERVATION conservation purchase. A copy of a letter from Wayne Sherwood of Nash-Vigier, planning consultants to the Town of Bedford, to the Mass. Port Authority, regarding roads over its land to a Rte. 128 connector was noted and placed on file. Members expressed interest in becoming affiliated with the Subregional Inter -town Liaison Committee (SILO) now comprising Bedford, Burlington, Carlisle, Concord, Lincoln, Sudbury, Wayland, Weston and Wilmington. The planning director will investigate the possibility of joining SILC. NASH-VIGIER CONSULTANTS TOWN OF BEDFORD SILC A letter from William Whalon regarding the use of the Meagherville town WM. WHALON land for a golf course, which was distributed to memlers in advance to the GOLF COURSE meeting, was discussed and the chairman offered to reply. MEAGHERVILLE The chairman also agreed to answer a letter from Sumner Wolsky, expressing S. WOLSKY desire to be appointed to an advisory committee for the Meagherville study. COMMITTEE It is the understanding of the Planning Board that such committee will not FOR THE be appointed by the Board, but rather chosen by neighborhood residents. MEAGHERVILLE STDY The decisions of the Board of Appeals on the following petitions heard on April 14, 1970 were noted and placed on file: Peter Mengert - variance for side porch - granted. Norman N. Connolly - use of residence as law office - granted. Anthony R. Cataldo - addition of shed - denied. Frank E. and Nancy R. Graham - variance for lot with insufficient area and frontage - granted. Campanelli Investment Properties - finding and determination -granted. G. Arnold Haynes Inc. - finding and determination - granted. Robert H. Colbourne - variance to divide land on Mt. Rd. - denied. B/A DECISIONS APRIL 14, 1970 A letter from Seasons Four, Inc. in reply to Mr. Lund's inquiry was read. SEASONS FOUR Seasons Four claims to be operating as a legally non -conforming use antedating zoning.
