HomeMy WebLinkAbout1970-01-17EXECUTIVE SESSION January 17, 1970 ' Mr. Worrell asked if the Selectmen are still planning to put in an article to rezone the triangular piece of land at Westview St. and expressed his concern that the Board of Selectmen might want the Planning Board to provide the front. The Board (Planning) discussed its concern about the traffic problem which could be created at rush hours and the future need of this land for an intersection enlargement. The planning director reported he had written the Depositiors Trust and had not had a reply. The fact was noted that the land had been left for expansion of the Westview Cemetery. Chairman Lund felt the use of this land for a bank is not wise at this time and suggested trying to buy it and not preclude use as part of the traffic intersection. Also discussed was the one employee and having it in writing as to his availability. Another item to be discussed was Colonial Acres III and Capaldi asking for money instead of completion of work. Town Counsel has suggested this might set a precedent unless there is a very good reason for this proposition of paying instead of completing properly .The Planning Board decided to ask the Board of Selectmen to ask the Board of Selectmen to aske the Town Engineer to make a reassessment of this matter. Another item discussed was the fact that Town Counsel has given the Board a very dubious view on its RH district Article. He*would like to submit ' the problem to Frank Michelman and ask him to talk with Legro after asking his view informally. (*Chairman Lund) Out of executive session at 8:20 p.m. Executive session with Board of Selectmen - January 17, 1970. The Board of Selectmen stated they had voted to put in two Articles at ATM re. Westview St. triangle subject to discussion With the Planning Board. 1. to acquire for town use 2. to rezone Mr. Cataldo said he went to Depositors Trust and asked them to consider, thinking this would add to the industrial park and also give it some good use. Mr. Legro suggested not use should be proposed that would preclude use for the intersection. Mr. Cataldo asked if Planning Board had talked with the bank. The planning director reported no answer to a letter written them. Mr. Lund suggested the Board thought it might create traffic problems at banking hours. Mr. Greeley asked about any bank in the same location in other towns and the traffic situations in these cases. Mr. Catado suggested the Board of Selectmen would withdraw the two articles if the Planning Board does not want to support them. The two Boards discussed Colonial Acres III, and the fact that the developer put in a sewer not according to town regulations but one which is working. ' Mr. Legro's concern about setting a precedent if the town takes money instead of correction of work was discussed. Mr. Cataldo stated the sewer creates problems and the Town has to clear or clean out the sewer once a year now. The Boad of Selectmen suggested the developer should take up 250 ft. between stations and correct the work. The Planning Board agreed to ask the developer to correct the work. Executive Session , January 17, 1970 -2 Next discussed was Conservation Restrictions. ' Mr. Cataldo asked why the Planning Board was going for easements. Mr. Lund suggested the land should be preserved and this is one way to prevent the land from being built on and might be less expensive as owner could still use land and Town save sponge areas. It would also release the Town from obligations to maintain the land. Mr. Lund mentioned Drummer Boy and the fact that the Board has done all it can to prevent the developer from building up this area. Mr. Kenney asked about Federal and State reimbursement possibilities on easements. Mr. Zaleski, planning director, replied yes to Federal but no repbyon State. Mr. Cataldo suggested the Boad of Selectmen would like to get other articles out of the way and then discuss this. Mr. Legro, Town Counsel, reiterated his opinion of no basis of acquiring of easements being less than it would cost for a fee. Nothing left for the owner. He feels if you take from an owner the right to use his Land, you might as well take his land. Mr. Lund suggested the Planning Board would like to get an appraisal on the difference. Mr. Mabee suggested letting the Selectmen know the difference. Someone mentioned that the Board of Selectmen had not discussed this as a board. .Mason St. easement discussed with the Town Engineer. The Planning Board has asked the Town to accept the street. Mr. Cataldo says he does not want to accept the street until the problem is resolved. Mr. Lund inquired of the Selectmen's understanding of the availability of the new engineer. Mr. Cataldo suggested if the Conservation Commission and the Recreation Committee were taken off the Planning Board workload, it would need no help. Mr. Cataldo suggested they are asking the departments to get together and work this out with the Town Manager. Mention was made of the purchase of the Grey Nuns property. The Board of Selectmen have withdrawn the article based on the fact that there was not much thrust of any committee to purchase and perhaps later on the Grey Nuns will be a bit more receptive. Mr. Greeley inquired about a request for meny for plans of Meagherville. The Planning Board replied it had given the Board of Selectmen an estimate. Sission ended. Fj
