HomeMy WebLinkAbout1964-04-22PLANNING BOARD MEETING ' April 22, 1964 A regular meeting of the Lexington Planning Board was held in its office, Town Office Building, on Wednesday, April 22, 1964. Chairman Meyer called the meeting to order at 8:10 p.m. with members Greeley, Bryson and Riffin present, also planning director Zaleski. Messrs. DeNapoli and Purcell met with the Board regarding plan of land owned by DeNapoli on Center Street in Lexington, FORM A submitted with Form A #64-18 for endorsement as now requiring DeNAPOLI approval under the subdivision control law. The question of whether or not the plan constituted a subdivision was discussed and it was agreed that the plan would qualify for endorsement as not a subdivision provided a note were added thereon as follows: "Lots 26, 27, 28, 29 are now held in common ownership with the land registered as Land Court Case 8584-A.11 Upon motion of A. Bryson, seconded by R. Greeley, it was unanimously VOTED: that approval under the subdivision control law is not required on the plan entitled "Plan of Land in Lex- ington Mass.", dated April 3, 1964, by Jos. J. Sullivan, Surveyor, submitted with Form A #64-18, since lots 26, 27, 28, 29 are now held in common ownership with adja- cent land registered as Land Court Case #8584-A. Mr. G.A.Carbone of 151 Edenfield Ave., Watertown, Mass. met with the Board and presented a sketch showing a proposed REZONING office building and parking area on lot at the northwesterly PROPOSAL corner of Marrett Rd. and Lincoln St. Mr. Carbone requested _ the Board of initiate the rezoning of this lot from R 1 to C 1 CARBONE district. In the discussion which followed, Mr. Greeley and Mr. Meyer expressed their view that this proposed rezoning of land at a major intersection was not in the best interest of the town and that it is the Board's policy to oppose office buildings in such locations. Mr. Carbone was advised of other ways of bringing a rezoning request betore a town meeting if the Board were not in favor of initiating the rezoning. Mr. Carbone requested to be informed of the Board's decision and Chairman Meyer agreed to do so. Upon motion of Mr. Greeley, seconded by Mr. Bryson, it was unanimously VOTED: (by the members present) that the planning board is not in favor of initiating a zoning amendment to rezone the lot at the northwesterly corner of Marrett Rd. and Lincoln St. from R 1 to C 1 district. The minutes of planning board meeting of March 30, 1964 MINUTES were read and approved as read. The following Form A applications for determination of 4-22-64 -2- Planning Board jurisdiction were taken under consideration: #64-19, submitted April 13, 1964 by Donald D. Wilson; FORMS A plan entitled "A Compiled Plan of Land in Lexington, Mass.", dated April 11, 1964, Miller & Nylander, C.E.'s & Surveyors. ##64-20, submitted April 15, 1964 by Mark Moore, Jr.; plan entitled "Plan of Land in Lexington, Mass.", dated April 11, 1964, Miller & Nylander, C.E.'s & Surveyors. ##64-21, submitted April 21, 1964 by Anthony R. Cataldo, plan entitled "A Compiled Plan of Land in Lexington, Mass.", dated April 16, 1964, Miller & Nylander, C.E.'s & Sur- veyors. ##64-22, submitted April 22, 1964,by Harold C. Wilson; plan entitled "A Subdivision of Land Court Case No. 9475 Land in Lexington, Mass.", dated April 18, 1964, Miller & Nylander, C.E.'s & Surveyors. #64-23, submitted April 22, 1964 by Glen Realty Trust, Norman J. MacLeod, Jr., Trustee; plan entitled "Plan of Land in Lexington, Mass.", dated April 21, 1964, Miller & Nylander, C.E.'s & Surveyors. Upon motion of Mr. Greeley, seconded by Mrs. Riffin, it was unanimously VOTED: that the plans accompanying Form A applications ##64-19, ##64-20, ##64-21, ##64-23 do not require approval under the Subdivision Control Law, and that said plans be so endorsed. No action was taken with respect to Form A #64-22, since a parcel of land shown thereon appears not to have the required frontage on a way. Mr. Zaleski will inquire whether the appli- cant wishes to modify the plan to meet the frontage require- ments. COLONIAL A letter was read from Colonial Development Corp. re - DEVELOPMENT questing a reduction of surety on Colonial Acres subdivision CORP. and it was decided to postpone action pending the receipt of recommendations from the town engineer, as requested by Mr. Zaleski. SANDERSON RD. The definitive subdivision plan of Sanderson Rd. Exten- EXTENSION sion was reviewed next. Mr. Zaleski reported that he requested - town counsel's opinion regarding lot DB Sanderson Rd. and ,that WESTCHESTER while the town counsel had not replied in writing, he suggested ESTATES over the phone that the Board had grounds to disapprove the sub- , division and that the Board could also approve the subdivision 4-22-64 -3- with a note that Lot DB does not have the required frontage or area and is not a building lot. In the ensuing discussion it was agreed that the plan be approved with the above notation and that the formal vote of approval be postponed until April 27 to enable Mr. Zaleski to attend to the legal technicalities of the approval, such as the performance guarantee to be furnished. The request of Westchester Estates, Inc. for an exten- sion of time for action on this subdivision was discussed and upon motion by Ar. Bryson, seconded by Mr. Greeley, it was unan- imously VOTED: to extend the time for action on the definitive subdivi- sion plan entitled "Extension of Sanderson Road Lexington, Mass.", dated January 28, 1964, by Fred A. Joyce to May 5, 1964, as requested by the owner, Westchester Estates, Inc. The following bills which had been presented were approved for payment: Ken -Kaye Krafts Co., drafting supplies --$10.00; BILLS B. L. Makepeace, Inc., lamp for copying machine --$11.49; Louise M. Macomber, secretarial service April 6, 1964--$5.00; Andrew T. Johnson Co., Inc., prints --$23.70; Howard Sutton Co., Inc., drafting supplies --$8.00; Com. for Economic Development, studies --$3.00; Minute -man Publications, advertising --$14.70. A notice by the Board of Selectmen that a special town meeting will be called for June 8, 1964, and that all articles TOWN MEETING must be submitted to the selectmen by 4:00 p.m. on May 4, 1964, was read and noted. Minutes of April 13, 1964, meeting of the Lexington CONSERVATION conservation commission were noted. It was decided to thank COMMITTEE the conservation commission for sending the minutes to the planning board. A letter from Sanborn Map Co. advising that the cost LEXINGTON of updating their Lexington Atlas will be $63.00 was read ATLAS Mr. Zaleski was authorized to order the updating. A copy of a letter from the building inspector to the selectmen regarding earth and gravel removal out of town was LOAM REMOVAL read, noted, and placed on file. A memorandum requesting a listing of planning reports and studies for the Boston Metropolitan Area Planning Council was read and referred to the planning director for such action as he may deem necessary. ' A notice of historic districts commission hearings was read and placed on file.
