' October 21, 1963
The Lexington Planning Board held a regular meeting in
its office in the Town Office Building on Monday, October 21,
1963 at 7:45 p.m. Present were Chairman Mabee, members Bryson,
Campbell, and Meyer, and Mr. Snow, planning consultant.
Considered first were the following Form A applications
for determination of planning board jurisdiction: FORMS A
#63-65 (see minutes of Planning Board meeting of
October 14, 1963.)
#63-67, submitted by Vincent A. Canavan, attorney, for
Francis Buckley; plan entitled "Plan of Land in Lex-
ington, Mass.", dated Oct. 11, 1963, Scale: 1" = 401,
Albert A. Miller, Wilbur C. Nylander, Civil Engineers
& Surveyors, Lexington, Mass.
#63-68, submitted by Norman T. May, attorney, for F.
Carpenter; plan entitled "A Subdivision of Land Court
Case No. 19700 Lexington, Mass.", dated Oct. 153 1963,
Scale: 111 = 401, Albert A. Miller, Wilbur C. Nylander,
Civil Engineers & Surveyors, Lexington, Mass.
It was noted that the plan accompanying application
#63-68 was a subdivision. Before acting on the application,
however, it was decided to refer it to the Town Counsel to see
if there was any way the plan might be amended or a notation
made upon it so the Board need not determine it was a subdivi-
sion.
Upon motion duly made and seconded, it was unanimously
VOTED: that the plans accompanying Form A applications #63-65
and #63-67 do not require approval under the subdivi-
sion control law, and that said plans be so endorsed.
The attention of the Board was called to a copy of a
letter,°dated October 9, 1963, from former Town Counsel CARY ACRES
Stevens to Mr. Carroll, Lexington Superintendent of Public SECS. 1 AND 2
Works, recommending that the town should now proceed to lay
out the streets as town ways in sections 1 and 2 of the Cary
Acres development, and should acquire the drain easement
through lot 357 in section 1 by eminent domain. (See adden-
dum.)
Considered next were notices of petitions to be held
by the Board of Appeals on November 5. It was decided to BOARD OF APPEALS
take no action in regard to these petitions.

From 8:30 to 8:35 p.m. Mr. James Taurasi of the Pond
COUNTRY CLUB Realty Trust and Mr. Wilbur C. Nylander, civil engineer, met
MANOR, SEC. 2 with the Board to obtain its informal opinion of a revised
sketch plan entitled 11Country Club Manor Proposed Section Two
POND REALTY Lexington, Mass.", dated October 21, 1963 and prepared by the
TRUST firm of Miller & Nylander. The plan was taken under advise-
ment.
Considered next was Mr. Henry W. Hardy's draft of pro- '
PROPOSED ZON- posed zoning articles for the November 25, 1963 special town
ING ARTICLES meeting. (See minutes of Planning Board meeting of October 14,
1963.) After considering the draft a number of minor changes
SPECIAL TOWN were made in it. The modified draft was then discussed with
MEETING Town Counsel Legro who came to the meeting for a general dis-
cussion of these and other articles proposed for inclusion in
the warrant for this special town meeting.
Mr. Legro was asked to review the description of the
SETH & MAXNER parcel of land on Worthen Road as submitted by Charles H.
PROPOSED A 1 Cole, II, in connection with his proposed rezoning for A 1 use,
DISTRICT Seth and Maxner land. Mr. Snow was asked to prepare as many
proposals as possible for hearings scheduled for November 14,
WORTHEN ROAD the deadline for legal advertising in the Lexington Minute -man
for said date being noon the following day. It was decided to
schedule a second group of hearings on November 21 for the re-
mainder of the rezoning proposals to be heard before the
special town meeting.
The Board's attention was called again to Mrs. William
WALTHAM-MUZZEY H. Lyon's letter of October 11 to the Planning Board offering
STS. MUNICIPAL for sale certain portions of the Lyon property situated at 55
PARKING AREA Waltham Street. (See minutes of Planning Board meeting of
LYON October 14, 1963.) Copies of the appraisal Mr. Henry E. Keenan '
of Arlington had made of this property were also exhibited. It
was decided to postpone a study of this appraisal until after

to the Planning Board's letter of the previous week indicating

that the latter board did not plan to place in the warrant for

the November special town meeting an article proposing to rezone
for special commercial uses land situated southwesterly of Route
2 and on either side of Spring Street. (See minutes of Planning
Board meeting of October 14, 1963.) Mr. Mabee said that Mr. Cole
requested that the Planning Board reconsider its position and
later on in the evening discuss the matter at the Board of Select-
men meeting. Thereupon, the Planning Board did reconsider its
position, deciding to reaffirm the same for the reasons that (1)
both boards had made a commitment to the State Department of
Public Works, as noted in the letter referred to above, and that
(2) there was not available any legal description of the proposed
land takings to be made by said department for the Spring Street -
Route 2 interchange.

The Planning Board met with the Board of Selectmen from
10:00 to 10:25 p.m. and thereafter adjourned its meeting at
10:45 p.m. Before doing so the Planning Board scheduled its
next meeting for October 28, 1963.

certain portions of the Lyon property situated at 55 Waltham Street.
The Planning Board is very much interested in this matter and in
discussing it with you or your representatives. We request that
this be done as soon as the November special town meeting is con-
cluded. Right now the Board has an especially heavy work load pre-
paring for this meeting.
