June 24, 1963
A regular meeting of the Lexington Planning Board was
held in its office in the Town Office Building on Monday,
June 24, 1963 at 7:50 p.m. Present were Chairman Mabee, mem-
bers Campbell, Greeley, and Meyer, and the secretary, Mrs.
Macomber.
From 7:50 until 8:10 p.m. Mr. William Be Maloney,
Treasurer of the Emerson Gardens Realty Corp. met with the
Board to discuss his proposal for modifying the approved
site plan for the Emerson Gardens garden apartment district
on Maple Street. Since meeting with the Planning Board on
May 27, said corporation had filed with the Board of
Appeals an application, dated JunelO, 1963, Which had been
forwarded by letter, dated Junel8, to the Planning Board
for consideration. The plans accompanying the application
were exhibited for discussion purposes.
In discussing the site plan Mr. Maloney stated that
no building would be closer to any `other than was origi-
nally shown, and that a little parking space had been
gained. He also said he was planning to level and remove
the 18 -foot sand bank along the common boundary between the
trust's land and that of the town of Arlington and would
plant the area, thus giving a better outlook from the apart-
ments.
Mr. Maloney also stated that a strip of land would be
left between the ,proposed service road and the Great Meadows
boundary, that the service road would have no access except
at one point to be designated later, and that access would
be used for maintenance and safety purposes only and not as
a public way. It was decided to send a letter to the Board
of Appeals recommending that the corporation's application
be granted but that before taking final action on the matter
to refer the site plan to Mr. Snow for review and for a re-
port to the Planning Board.
At 8:10 Donald D. Wilson of 32 Fern Street not with
the Board for the purpose of discussing the map published
in the Planning Board's Summary Report Which showed a road
through the Wilson farm. The Chairman explained that this
was a proposed one-way connector road to Emerson Road to
serve the houses in that area. Mr. Wilson stated that this
was irreplaceable market garden land. The brook was former-
ly used as the source for watering the garden, but of late
Years the oil from the road kept washing into the brook and
made it unfit for such use. He said that anew water supply
was dug, and that the proposed road would go over the spot

taking
the source of fresh water. He also stated that there
were only four houses in the area to be served and it hardly
seemed worth while to put a road there.
The Chairman explained that this road was one of
two proposals and was not the favored one; that the one
which in all probability would be built would not interfere
with the farm; and that in any event the building of either
road was in the distant future and should not be of concern
at present. Mr. Wilson left the meeting at 8:35 p -m -
At this time Mr. John Castoldi of Adams Estates met
ADAMS ESTATES with the Board. Mr. Castoldi showed a sketch plan of lots
on Emerson and Suzanne Roads, one of which the town owned and
BASTOLDI wished to swap for an abutting one of equal size and value
owned by Mr. Castoldi. It was decided to refer this matter
to Mr. Snow for, further investigation.
At 8:50 p.m. Mr. Emilio V. Spagnuola. of Kingston
KINGSTCH Homes, Inc. and Mr. Donald N. Sleeper, Jr., attorney for
HOMES, INC. the corporation, met with the Board in regard to the Ingle-
side definitive subdivision and said corporations written
INGLESIDE request for (1) a reduction of the $80,000.00 bond for work
to be performed in the subdivision to a penal sum of ' ,
$40,000.00; and (2) a release of lots on Abernatby Road in
exchange for an agreement and a $7,000.00 bond securing said
agreement.
In connection with this request there was exhibited
Mr. John J. Carroll's letter of June 3 to Mr. Sleeper, Mr -
Carroll stating that his estimates of the portion of work
to be done on Ingleside Road servicing lots 1 through 6 and
30, 31, 329 and 41 amounted to $40,000.00 and on AbernatbF
Road to serve lots 33 to 40, inclusive, amounting to
$7,9000.00. (See addendum.) A32 matters appearing to be in
order, upon motions duly made, and seconded, it was unani-
mously
VOTED: to reduce from $80,000.00 to $40,000.00 the Perform-
ance bond, dated August 31, 1962 covering lots 1-6
inclusive, 30, 31, 32, and 41'for required. Work to
be done in the subdivision entitled %#Inglesidet Sub-
division of Land in Lexington_. Mass.*, dated June 23,
1961, revised October 30, 1961 -
VOTED: to sign a partial release of covenant for required
work referred to'in the covenant executed by Kingston
Homes, Inc., Emilio V, Spagnuolo, Treasurer, dated
July 22 1962, and release from said covenant lots 33 ,
to. 40, inclusive, shown on the subdivision plan en-
titled "'Ingleside' Subdivision of Land in Lexington,

Mass. , dated June 23, 196 ,
1961, from the provisions as to sale and building
specified in said covenant and to accept in sub-
stitution therefor an agreement, dated June 10,
1963, and a surety company bond securing the same.

Upon motion duly made, and seconded, it was unanimously
VOTED: that the action of three members of the Board be
validated in determining on June 12, 1963 that
the plan accompanying Form A application #63-38
does not require approval under the Subdivision
Control Lav and that said plan be so endorsed.
Applications #63-39, #63-40 and,#63-41 were referred to
Tam Counsel Legro for advice.
Taken under consideration next was the notice of
petition of Anthony DiRocco to be heard by the Board of
Appeals on June 25 whereby Mr. DiRooco requested per-
mission to build a house on Lot 2, Dunham Street. It
was noted that this lot was on a "paper" street and the
area was served only by a 2" water main. After some dis-
cussion it was decided to send a letter to the Board of
Appeals recommending denial of this petition (see addendum).

BURNHAM FARMS division having been received, and all other matters appearing
SBC. 6 to be in order,, the Board endorsed said above plan, which had
- been approved on May 13, 1963• Mr. Legro took the plans for
TODD REALTY recording.
Also received was the duly executed "Assumption of Ob-
ligations of Subdivider by Subsequent Purchaser" whereby Todd
Realty, Inc. assumed to the Town the obligations of William I.
Burnham, as subdivider.
. Read to the Board was a letter from Todd Realty Trust,
Mark Moore, Jr., president, requesting a reduction in the
amount of security held for performance of work to be done in
the Burnham Farms, Section 6 subdivision from $22,500 to
$11, 250. In view of the fact that a letter haul been received
from John J. Carroll, Supt. of Public Works, stating that
fifty per cent of the work in said subdivision had been com-
pleted to his satisfaction, upon motion duly made, and seconded,
it was unanimously
VOM: to reduce the amount of security held for performance
of required work to be done in the Burnham Farms, Sec-
tion 6 subdivision from $22,500.00 to $11,250.00 in
consideration of the fact that fifty per cent fo the
work has been satisfactorily completed.
Read to the Board was a letter from Arthur J. Thyng,
dated June 173 1963, in which he asked for an opinion from
the, Board in regard to possible use of land, located at 676
Marrett Road. It was decided to refer this matter to Mr.
Snow, Consultant, for further study. (See addendum.)
In response to a written request from Antonio Busa,
dated June 24, 19632 the Board decided to write a letter to
the Board of Assessors stating that 41r. Buss had granted to
the town an easement "in, through, and under the whole of
Lillian Road" as shown on plan entitled "Green Valley Sec-
tion Three Lexington, Mass.", dated January 22n., 1958. (See
addenda.)
The meeting was adjourned at 11:20 p.m.

Dear Mr, Sleeper:
Reference is made to your letter of May 27, 1963 regarding the
"Ingleside Subdivision of Land in Lexington, Mass.", plan dated
September 14, 1961.

The portion of the work done on Ingleside Road from Station 0i-0
to 11+502 which includes Lots 1 through 6 and 30, 312 32, and 41
amounts to $40,000.00.
The amount of bond necessary to cover the lots on Abernatby Road -
Lots 33 to 40 will be $7,000.00.

Re: Anthor J. DiRocco Petition
Gentlemen:
Referring to the petition of AnthorW J. DiRocco requesting per-
mission to erect a house on Lot 2 on Dunham Street, the Planning
Board recommends that the.petition.be denied for the reason that
there is no adequate access to the property and no utilities to
serve the lot.

Dear Sir:
Enclosed is a rough plan of land located at 676 Harrett Road in
Lexington owned by me.
The plan shows in red the portion of land taken by the State. I
wish to determine if this land taking and extention of ramp off
Route 128 would prevent development of land for house lots, as
shown on plan, at some future date. Also in the event of rezoning,
could this land be used for entrance into the Busa land.
I am asking this to help determine the amount of damage this land
taking caused.

Gentlemen: Re: Antonio Buss.
In a letter, dated June 24, 1963, Mr. Antonio Busa requested the
Punning Board to inform you about an easement northerly of Lillian
Road and opposite Anthony Road as shown on the definitive subdivi-
sion plan entitled "Green Valley Section 3 Lexington -Mass.", dated
January 22, 1958.
Attached herewith is a -copy of the instrument wherein Mr. Buss,
granted to the town an easement not only in the -parcel of land to
which he refers but also in lots 4 and 5 in sections 2 and 3, re-
spectively, of the Green Valley development. Attached herewith also
is a marked print of the lot layout plan of Green Valley, Section 3
showing the location of the parcels referred to in said instrument.
