HomeMy WebLinkAbout1962-12-10PLANYING BOARD MEETING December 101 1962 The Lexington Planning Board held a regular meeting in its office, Town Office Building, on Monday, December 10, 1962, at 7:40 p.m. Present were Chairman Grindle, Members Br7son, Campbell, Mabee and. Meyer, and Planning Director Snow. The Board approved the minutes of its meet- MINUTES ing of December 3, 1962. Approved for payment were the following bills which had been submitted: from General Ex- BILLS penses account: H. M. Lawrence hardware, Inc., drafting supplies --$2.54; L. M. Foster, Inc., office supplies --A5.27; from Options Account: James J. Murphvv and Bertha J. Murphy, land for school and recreational nurposes--X2500.00. Considered were the following Form A appli- cations for Planning Board jurisdiction: FORMS A ' #62-86, submitted November 302 1962 by Francis W. R. Smith, attorney for Paula T. It was moved, seconded and unanimously VOTED: that the Lexington Planning Board deter - mi es that the Mans accompanyin Form A npl acations #62-861 #62-87 and 62-88 do ' not require approval under the Subdivision Control Law, and that said plans be so en- dorsed. 12-10-62 -2- HISTORIC Read to the Board was the notice of an appli- DISTRICTS cation to be heard on December 13 by the Historic COMMISSION Districts Commission. It was decided to take no action in regard to said application. Considered next was a letter, dated December 7, 1962, from Stephen T. Russian, attorney for Antonio Busa, seeping further extension of the time within which the Board must act on the application of Antonio Busa for approval of the Green Valley, Sec. 7 subdivision. On motion duly made and seconded, it was unanimously VOTED; that the time within which the Planning Board must take final action regarding the defini- tive subdivision plan entitled "Green Valley Section Seven Lexington, Mass.", dated July 6, 1962, be and hereby is further extended to and including January 11�, 1963. Mr. Grindle reported that Messrs. Donald P. EAST Noyes and Aiden L. Ripley of the Lexington Historical LEXINGTON Societv wished to meet with the Board to discuss the HISTORIC proposal to create a study committee to investigate DISTRICT the possibility of establishing an historic district on Massachusetts Avenue in the vicinity of Pleasant ' Street. It was decided to invite these gentlemen to attend a work session of the Board scheduled for '^ted- nesday evening, December 12, at which time the Board would discuss with them their proposal. Mr. Snow gave a report of a conference he had REZONING held with Mr. William L. Potter in regard to amend - PROPOSAL Ing; the zoning by-law so as to hermit golf courses to operate for profit to be located in one -family GOLF COURSE residence areas in Lexinrcton. (See minutes of Plan- ning Boare. meeting of November 191 19(,2. Mr. Snow POTTER then prepared for the Boardts consideration a draft of a letter to the Yarmouth Board of Appeals with reference to a golf course hermit issued in said town. (See addendum.) Read to the Board was a letter, dated Decem- COUNTRYSIDE, ber 4, from the Board of Selectmen to the Planning INC. Board advising that the Selectmen had voted at their REZONING meeting on December 3 to include an article with PROPOSAL reference to Countryside, Inc. in the warrant for the special town meeting to be held in January. (See Planning Board minutes of November 26, 1962.) Distributed to the Board were copies of a letter, dated December 3,1 962, from the Chairman of the Board of Appeals to the Planning Board with 12-10-62 -3- reference to the Itek Corporation's application ' of October 30 for a determination. (See adden- dum. See also Planning Board minutes of November. 26, 1962.) Called to the Board's attention was a letter from the Town Counsel to the Town Clerk notifying the latter that an order adopted by the Board of Selectmen on October 15, 1962 taking; by eminent domain the pronerty of the Anostolu es- tate on Moreland Avenue for school, playground, and other oub lic purposes, had been recorded in the Middlesex South District Deeds on October 16, 1962s Book 101t�li, Page 512. Read to the Board was a letter, dated Decem- ber 2, from Mr. T,Tendell W. Locke to the Planning Board with reference to the Locke land the Board was recommending be acquired as an addition to the so-called Whipple Hill recreational area. Since Mr. Locke stated in the letter that he could pro- ceed no further about the sale of the Locke acres in Lexington because of friction in the family and since he also referred the Planning; Board to his lawyer, Mr. Grindle was asked to call the lawyer, ' Mr. Albert W. Wunderly, to see what prospects there mit,ht be of Lexin7ton obtaining the said. Locke acres. Mr. Snow reported that he had discussed with Mr. John 7. Carroll, Town Engineer, the rr000sal to relocate the Lexin7ton-Winchester town line between bounds L -W-1 and L -W-3, and that Mr. Carroll ex- pressed the opinion that whatever letter was addressed to the Chief Enp,i.neer, State Debt. of Public Works n regard to the proposed line change should be sir*ned by the Town Engineer of Lexington. Mr. Snow said that in view of this opinion he had drafted a letter for the town engineer's use. (See a(7-denda.) From 9:00 p.m. until the end of the meeting Mrs. Canborn C. Frown, essrs. Leslie H. York and eric T. Clarke of the Town Meeting Members Asso- ciation and Mrs. John B. Rawls, Chairman of the Local Affairs Committee of the League of Women `Joters$ met with the Board to discuss some of its planning activities. Princinally discussed was subject matter and general contents of the Planning; Board's summary report in regard to a master plan e for Lexi.nr"ton. The Planning Board adjourned its meeting at 11:15 p.m. Thomas S. Gri.ndle, Chairman December 101 1962 Board of Appeals Town of Yarmouth Massachusetts Gentlemen: Mr. William L. Potter of Lexington has appeared before this planning board in regard to a proposal of his to amend the Lexington Zoning By-law so as to hermit golf courses operated for nrofit to be located in one -family dwellin districts in this town. It is understood that if you were so requested you world be willing to loan this board for its use a copy of the minutes in regard to the Davenport Realty Trust case as set forth in hearing No. 533 held by your board on May 4, 1961. The Lexington Planning? Board would be most appreciative of your courtesy in making such a loan in order that this board may consider more fully what course of action it wishes to take in regard to Mr. Potter's proposal. Grindle,Chairman Lexington Planning Board Town Office Lexington, Massachusetts Re: December 3, 1962 Itek Corp. application October 30, 1962 r 1 1 C 12-10-62 I Dear Mr. Gri_ndle: -5- In reply to your letter of November 30 I gather that you have finally decided to accede to the Itek Corporatlon's request to locate their new addition with insufficient setback, bas- ing your decision on the fact that when they originally located on their nroperty they could have built with this setback. The Board of Appeals has nothing to do but follow your recom- mendation which seems to be the result of recent conferences with the Itek Corporation. We do want to make this observa- tion, however. Inasmuch as we recently denied the Itek' Cor- poration's n etiti.on, based upon your recommendation, we feel somewhat embarrassed to now have a new hearing and note the fact that you have reversed rrour decision. The reason for our embarrassment is that an7-body reading about this situation in our advertisement in the M4-nute-man, and possibly reading of a subsequent decision, would feel that the Board of Appeals has denied and then granted the same petition and our Board could be criticized therefore for vacillating. I am trving to express this fairly and without any animus just so that you may tuck it away in your minds and try not to em- barrass us in the future. Sincerely yours, Isl Donald E. Re: Lexington -Winchester Town Line Dear Sir: Attached herewith is a print of a plan entitled "Lexinr-;ton- Winchester Town Line," and dated December 132 10/62. Marked In red on the nr:'nt is a proposed relocation of a section of the Lexinrtor-Winchester town line between bounds L -W-1 and L -W-3. The proposed relocation has been approved by the Boards of Selectmen and Planning; Boards of Lexin7ton and Winchester. However, b efore submitting the proposed changes 12-10-62 to the respective town meetings for concurrence, it is re- , quested that you give the proposal a preliminary review for clarity and engineering accuracy. The -oro-nosed section of the town line would be located be- tween the property lines of the so-called Sun Valley resi- dential development in Lexington and the "Winchester Estates, Sec. L" and the "Crestview" subdivisions in Winchester (as :narked on the print) so that Thornberry load andthe lots fronting thereon and the lots on Berkshire Drive would all be in W-TLnchester. Also located in Winchester would be Parcel A as marked on the -olan.. The town of Lexington de- sires to acquire this parcel as an addition, and a better access to its so-called-14hipnle Hill recreational area. Mr. Snow,Planning Director for Lexington, discussed this nronosal in a preliminary way with Mr. Robert W. Hunter of your department. If there are any questions you may have in connection with the proposal it is suggested that you communicate with e ther Mr. Snow or the undersigned. As soon as nrelim_inary approval is obtained of the nroposed relocation it is planned to prepare identical articles for insertion in the warrants for the 1963 annual town meetings for Lexington and Winchester and then to follow the pro- cedures outlined in the General Laws under Chapter 42 as ' recently amended in Chapter 157, Acts of 1962.
