HomeMy WebLinkAbout1962-09-17PLANNING BOARD MEETING September 17, 1962 The Lexington Planning Board held a regular meeting in its office in the Town Office Building on Monday, September 17, 1962 at 7:35 o.m. Present were Chairman Grindle, members Bryson, Campbell, Mabee and Meyer, and Mr. Snow, Planning Director. The Board approved the minutes of its meet- ings of August 4 and 10, 1962. Approved for navment was a bill in the amount of $8.46 presented by H. B. McArdle for office supplies. It was moved, seconded and unanimously VOTED: that the Lexington Planning Board determines MINUTES BILLS FORMS A J-17-62 -2- that the plans accompanying Form A applica- tions #62-70 to #62-74, inclusive, do not require approval under the Subdivision Control Law, and that said plans be so en- dorsed. Mr. Snow called the Boards attention to STREET two letters he had written to the Board of Select - ACCEPTANCES men in reply to its inquiries in regard to the acceptance of streets in the Glen Estates and Lowell P'states subdivisions. Mr. Snow recommended the acceptance of a portion of Sanderson Road and all of Bryant and Page Roads in the Lowell Estates subdi- vision and the non-acceptance of streets in the Glen Estates subdivision. (See addenda.) At 8:00 p.m. a public hearing was held on CRESTVTEW the application of Gertrude H. Murphy for approval of a definitive subdivision plan to be known as GERTRUDE H. 'Crestview at Winchester, Mass.', the major nor - MURPHY tion of which is located in Winchester and a small portion in Lexington, said subdivision to be lo- cated northerly of ?finchester Drive. Present at the hearing were Mr. Nicholas H. Fitzgerald, Jr., who prepared the subdivision plan, Mr. Richard H. Murphy, and Mr. Oscar E. Merrill, member of the ' SmTinchester Planning Board. The Chairman read the notice of the hearing as it had been sent to all property owners deemed to be affected and as it had been published in the August 30 and September 6, 1962 issues of the Lex- ington Minute -man. He then explained the procedure in conducting the hearing and called upon Mr. Murphy to present and discuss the plan. Mr. Fitzgerald -resented the definitive plan entitled "Crestview at Vinchester, Mass.P°, dated August 18, 19622 by first stating that unless there were objections he would discuss only that portion of the plan which affected Lexington. There were no objections. Mr. Fitzgerald then said that the Lexington portion of the definitive plan conformed to the nreli.minary subdivision plan, dated April ltd, 1962, which the Lexington Planning Board had approved in- formally (see minutes of Planning Board meeting of May 281 1962). He pointed out that the portion of T7^ornberry Road located over the land of the Win- chester Development Corporation and shown on Land ' Court Plan No. 20756Q would be constructed by Mrs. 9-17-62 -3- Murphy with a 30 -foot pavement to conform to that portion of the said road which Mrs. Murphy would build over her own land. Mr. Fitzgerald said that he understood that if the land of the Winchester Development Corporation and Mrs. Murphy now located in Lexington were transferred to the town of Win- chester in connection with a suggested relocation of the Winchester -Lexington town line, Winchester would lay out Thornberry Road over the land of said cor- poration with a 50 -foot right-of-way instead of the 40 feet shown on the Land Court plan. Mr. Fitzgerald next noted that all the lots on Thornberry Road would be serviced by a sewer. He said, however, that lot L-1 fronting on Winchester Drive would be serviced by a sewer located in an easement in Lot 7 and connecting_ to Berkshire Road Mr. Fitzgerald stated that this arrangement was necessary because of grades and the lack of a sewer In Winchester Drive between Russell Road and the Win- chester town line. Discussed next was the size and frontage of lots through which the existing Lexinaton-Winchester town line now passes, these lots being laid out at the suggestion of the Lexington Planning Board to conform to Winchester's zoning by-law with the thought in mind that all said lots would eventually be located in Winchester. It was pointed out that in approving the subdivision that the Lexington Plan- ning Board would have to do so with the notation that lots 1 to 7, inclusive, 24 and 25 do not comply with the minimum requirements of the Lexington Zoning By-law. It was stated, however, that said Board would support a petition of Mrs. Murphy for a variance in regard to these lots if by the time they were ready to be built on they were not located in Winchester. Inquiry was made in regard to the status of the lot owned by the Winchester Development Corporation. It was pointed out that when this corporation had submitted the proposed revision of the subdivision plan entitled "Winchester estates Section 4" that the Board signed said plan bearing the endorsement "Lex- ington Planning; Board annroval under the Subdivision Control Law not requi_redf1 on the basis that all the Lexington land within said subdivision be combined into one lot. It was noted in the Instrument that the corporation covenants and agrees that It will not sell any lot situated in Lexington and abutting on said portion of Thornberry Road, or erect or place any building on any such lot until such part of Thornberry Road and the improvements and services to serve such lot shall have been com- pletely constructed and installed in accordance with the rules and regulations of the Lexington Planning Board. There being no further questions or discus- sion the hearing was closed at 9:00 p.m, and the subdivision plan taken under advisement. Considered next and approved was the draft of CENTER a letter to the Selectmen in regard to their request PLAYGROUND that the Planning Board prepare a master plan for the Center playground area. (See addendum.) REZONING Also considered and approved was the draft AMENDMENT ' of another letter to the Selectmen with reference - to their request that consideration be given to o-17-62 amend the zoning by-law to orovide for additional locations for package liquor stores. (See adden- dum.) Mr. Charles Kenny's letter of September 12, 1962 to the Planning Board was read. He inquired if it were not the time for the Itek Corporation and Fuller's Hill Associates to discuss the rezon- ing of the Roberts brothers' land between Spring Street and Route 128. A letter of reply was dic- tated for the Chairman's signature. (See adden- dum.) Tne Planning Board adjourned its meeting at 10:00 p.m. and attended until 10:30 p.m. the meeting of the Board of Selectmen to discuss in- formally the published report of the firm of Hay- den, Harding and Buchanan to the State Department of public Works recommending the extension of Route 3 from Route 128 in Burlington through Lex- ington to Route 2 at the Arlington town line. Br7son, Jr. 'Clerk ADDENDUM Board of Selectmen Town Office Building Lexington 73, Massachusetts -5- September 14, 1962 Re: Street acceptances Bryant, Page and Sanderson roads Gentlemen: Reference is made to Miss Murray's letter of September 11 to the Planning Board in regard to the possible acceptance of Sanderson Road. Sanderson Road may be accepted only from station 10+23.26 to 21+97.36. This section of the road ser- vices lots 1, 2, 5, 6, 73 15, 16, 34 and 35. It is pointed out, however, that the section of Bryant Road between Lowell Road and Sanderson Road will have to be ' accepted first since it 3s the only means of access at present to the completed section of Sanderson Road. PACKAGE LIQUOR STORES C 3 DISTRICT REZONING PROPOSAL - ITEK AND FULLERS HILL ASSOCIATES 9-17-62 -- It is recommended that all of Bryant and Page Roads ' as shown on the Lowell Estates definitive subdivision plan be accepted at the same time. Re: Glen Estates Wavm n�i tRealty Trust Dear Alan: Reference is made to your letter of July 24 to the Chairman of the Planning Board and the copy of Mr. Batter's letter of July 17, 1962 to the Board of ' Selectmen. The subdivision involved in this case Is entitled "Glen Estates Lexington, Mass.", dated November 41 1959. This subdivision was approved subject to the n rovl- si.ons of a covenant executed by the original sub- divider. Since the approval of the subdivision the Waymint Realty Trust acquired title to the entire parcel of land shown on said subdivision plan, en- tered into an agreement with the Town to install and construct the ways and services to serve certain lots shown on this n_ lan, and filed a bond securing said agreement. As soon as the required work to be done under this agreement has been completed to the satisfaction of the Lexington Supt, of Public Works and the Planning Board, the latter is prepared to re- lease the bond and recommend acceptance of the streets in the subdivision. Snow Planning; Director 1 1 1 9-17-62 Sentember 17, 1962 Board of Selectmen Town Office Building Lexington 73, Massachusetts Re: Center Playground Area Gentlemen: -7- Reference is made to ,your letter of April 3 in which you requested that the Planning Board prepare a general or master plan of the Center playground area. In late Tune Mr. Staples gave Mr. Snow copies of prints of the proposed addition to the high school and summaries of requirements for various areas for physical education, intramurals, athletics and community recreation. However, Mr. Snow did not undertake any studies for the Center playground area for the reason that he had been asked, as outlined in the Plannin)* Board's memorandum of June 6 to you, to devote the major portion of his time to assisting the Board in completing and publishing a comprehensive re- nort to Lexington citizens. This is still the most im- portant task before the Board. It regrets, therefore, Its reluctance at this time to assign Mr. Snow to any other work during the next few months. This board does not recommend the location of retail liquor stores in local business districts. How- ever, if you have certain nronosals to suggest in regard to 9-17-62 permitting these stores In certain areas the "Tanning , Board would be pleased to receive them.
