HomeMy WebLinkAbout1962-09-04LJ 1 PLANNING BOARD MEETING September 4s 1962 The Lexington Planning Board held a regular meeting in its office in the Town Office Building on Tuesday, September 4, 1962 at 7:45 p.m. Present were Chairman Grindle, members Campbell, Mabee and Meyer, and Planning Director, Mr.Snow. Chairman Grindle read the notice of the hear- ing as it was sent to all property owners deemed to be affected and as it was published in the August 16 and 23, 1962 issues of the Lexington Minute -man. He then outlined the Planning Board's procedure in con- ducting a hearing. Afterwards Mr. Grindle explained that the Board now wished to eliminate the turnaround referred to in said notice in connection with its de- cision to waive its subdivision rules and regulations to the extent of allowing a limited extension of Forbes Road. (See minutes of Planning Board meeting of July 92 1962.) There were no questions or objec- tions. The hearing was declared closed at 8:10 p.m. The Planning Board then held a hearing on the VOTED: That the action of three members of the Board be validated in determining on August 29, 1962 that the plan accompanying Form A application #62-63 does not require approval under the Subdivision Control Law and that said plan be so endorsed. VOTED: That the Lexington Planning Board determines that the plans accompanying Form A applica- tions #62-69 to #62-62, inclusive, and #62-64 to X62-69, inclusive, do not require approval under the Subdivision Control Law, and that said plans be so endorsed. At 8:05 p.m. the Planning Board held a public ' LEXINGTON hearing on its proposal to modify its approval of a - OFFICE certain subdivision plan entitled "Minute Man Re - CENTER TRUST search Park Section One Lexington, Mass.", dated - November 10, 1961, revised January 291, 19621, and filed MODIFICATION in the Land Registration Office as Land Court Plan No. MINUTE MAN 158�4P by eliminating the turnaround as part of Forbes RESEARCH PARK Road and leaving Forbes Road with a uniform width of SEC. X 50 feet. Present were Mr. Daniel G. ;wheeler and Mr. Michael Demone of Cabot, Cabot & Forbes, and Mr. Leslie York of Lexington. He then outlined the Planning Board's procedure in con- ducting a hearing. The hearing was declared closed at 8:10 p.m. The Planning Board then held a hearing on the 9-4-62 -3- application of the Lexington Office Center Trust for approval of its subdivision entitled "Minute LEXINGTON Man Research Park Sect'on Two Lexington, Mass.`, OFFICE dated July 25, 1.962. The same three persons as CEMT ER noted above attended the second hearing. TRUST Mr. Grindle opened the hearing by reading the notice of the same as it had been sent to all property owners deemed to be affected and as It had been published in the August 16 and 23, 1962 issues of the Lexington Minute -man. He then called upon the subdivider to present and explain the subdivision plan. Mr. Michael G. Damone, representing the Lexinotor Office Center Trust, explained that in the first section of the Minute Man Research Park it was originally proposed to lay out a dead-end street, Forbes Road, exactly 500 feet in length. He noted that the plan of this section had not been revised even though the State Dept. of Public Works had taken a parcel of the Trust's land for the future location of Route 2A eliminating about 137 feet of Forbes Road. He pointed out that with the extension of Forbes Road in the second section of the Research Park development the length of Forbes Road from the southwesterly side line of Marrett Road to the end of the permanent turnaround would be 738 feet and that only three lots would front on the subdivision street. There being no questions or discussion of the subdivision plan it was taken under advisement. The hearing was declared closed at 8:15 p.m, The Board approved the minutes of its meet- ing of August 6, 1962. Approved also were the following bills which had been presented: Lexington Ski & Sport Shop, Inc., drafting supplies --$3.15; Minute -man Publications, advertising --05.51. The attention of the Board was called to a letter, dated August 8, 1962, from the Board of Selectmen advising that the Appropriation Com- mittee had approved a transfer of $2500 from the Reserve Fund to the Planni.ng Board Expenses ac- count. It was noted that this transfer was to pay for professional services in connection with studies for connections of Emerson Road to Route 2. The attention of the Board was also called P?INUTE MAN RESEARCH PARK SEC. 2 MINUTES BILLS TRANSFER OF FUNDS 9-4-62 -4- to Town Counsel Stevenst letter of August 30 to the ' INGLESIDE Planning Director stating that there had been re- corded in the Middlesex Registry of Deeds the Ingle - KINGSTON side subdivision plan together with the covenant, HOMES, INC. the grant of easements from Kingston Homes, Inc. to the Town, and the agreement by Kingston Homes, Inc. with the Town in reference to the construction of the second access. (See addendum.) From 8:35 to 8:50 p.m. the Board held a pub - GREEN VALLEY lic hearing relative to the application of Antonio SEC, 7 Busa for approval of the definitive subdivision plan to be known as "Green Valley Section Seven Lexington, BUSA Mass." Mr. Busa was the only person who attended the hearing. Mr. Grindle read the notice of the hearing as it had been sent to those deemed to be affected and as it was published in the August 16 and 23, 1962 Issues of the Lexington Minute -man. After explain- ing the procedure In conducting the hearing he called upon Mr. Busa to present and to discuss his plan. Mr. Busa said he thought the plan as exhibited was self-explanatory. He noted that the subdivision consisted of eight lots all of which would have sewer ' connections. He added that he had a letter from the Town of Arlington granting him permission to cast water from street drains in the subdivision into the Great Meadows owned by that town. Mr. Busa was asked for a copy of this letter which he agreed to furnish for the Planning Board files. Mr. Busals attention was called to the fact that he had been informed in a letter, dated August 21, 1961 (see minutes of Planning Board meeting of said date), the Planning Board would not approve this proposed subdivision until such time as Circle Road as shown on Land Court Plan No. 6807 had been constructed to provide a second means of access to the Green Valley, Section 7 subdivision. Mr. Busa was told that the Board did not wish to disapprove the subdivision but wanted assurance in the form of an agreement that such a second means of access to his subdivision would be provided. He was asked what the status of the situation was in regard to the Busa Realty Trust►s offer in the form of a letter, dated May 22, 1961, to the Board of Selectmen to construct Circle Road from his subdivision to Hillcrest Avenue In exchange for tax title lots owned by the Town on Circle Road. It was stated that the Planning Board ' understood there was a question of foreclosure pro- 9-4-62 I ceedings in regard to these lots and therefore the question of ability to convey the lots to the Trust. Mr. Busa said that he understood that the Trust and the Selectmen had come to an agreement as to the construction and sale of lots and that on this basis he had filed his plan for approval. Mr. Busa was told that there had to be more than a verbal agreement to provide a second means of access. It was decided to take the subdivision plan under advisement and to inquire of the Se- lectmen as to the status of the agreement. Mr. Snow reported that Mr. Murphy had in- formed him by telephone that the Planning Board's offer of $3,000 for his land on Grove Street was not acceptable and that he wanted at least 05,000 for his land. (See minutes of Planning Board meeting of August 8, 1962.) Mr. Snow said that upon being so informed he asked the appraiser, Mr. Keenan, for a letter setting forth the separate values on each of the Murphy parcels it was de- sired to acquire. ' Mr. Keenan's letter of August 22 to the Planning Board in response to Mr. Snow's request was exhibited. (See addendum.) On the basis of this letter Mr. Snow was authorized to offer Mr. Murphy $2,000 for the 5 -acre parcel it was de- sired to add to the Baskin playground. Discussed next was the Planning Board's letter of August 16 to Mr. Morris of the Itek Corporation and his reply of August 22 in regard to the Planning Board's recommendations to the Board of Appeals with reference to said corpora- tion's application and petition, dated May 29, 1962. (See addendum.) After due consideration it was decided to reaffirm the Planning Board's decision as stated in the August 16 letter. Mr. Snow was asked to draft for the Board's consid- eration at its next meeting a brief letter to Mr. Morris reiterating the Planning Board's position in this matter. From 9.35 to 9:50 P.M. Mr. Evans of Charles M. Evans Associates met with the Board presenting his letter of September 4 transmitting for the Planning Board's consideration preliminary copies ' of job descriptions or class specifications. (See addendum.) The Planning Board took the descrip- tions under consideration. -5- MURPHY LAND FOR RECREATIONAL PURPOSES BOARD OF APPEALS ITEK JOB CLASSI- FICATIONS 9-4-62 M After a general discussion of current planning I Board work the meeting adjourned at 10:15 p.m. Thomas S. Snow, Planning Director Planning Board Town Office Building Lexington 73, Massachusetts Dear Sam: Re: "Ingleside' - Lexington Today I recorded in Middlesex South District Registry of Deeds the subdivision plan together with the cove- nant, the grant of easements from Kin7ston Homes, Inc. to the Town, and the agreement by KingstonHomes, Inc. ' with the Town in reference to the construction of the second access. The plan was recorded as plan No. 1233 of 1962. The covenant was recorded as instrument No. 105, the grant of easements as instrument No. 106, and the agreement as instrument No. 107. Copies of these instruments were sent you on May 24, 1962 with copv of my letter of that date to Mr. Sieeper. Mr. Sleeper has informed me that he registered today in the Land Registry section of South Middlesex the grant of easements from Kingston Homes, Inc. to the Town with- in the street located within the small piece of regis- tered land and that this was registered as document No. 383001. Gentlemen: In response to your request to give you for the five acres of land on the west as referred to on Page 3 of my original restate, that the highest and best use the zoning law restriction would be for denc es . -7- August 22, 1962 a fair market value side of Grove Street report, I wish to for this land under single family resi- I also quote from the same page, "Therefore without a defi- nite program of sub -division or a plan that would meet the approval of the officials of the Town of Lexington.. it would be impossible to determine the sub -division value of this land for this use under the present zoning laws." ' Taping into consideration that I originally valued the two parcels as worth 03s O00, I now establish a separate value of 82,200 for the five acres and an $800 value to the one acre plus on the east side of Grove Street. Evans & Associates Subject: Preliminary Copies of Proposed Class Specifications (1) Attached are preliminary copies of job descriptions or class specifications for the authorized position of Planning Director and the contemplated positions of Senior Planner and Junior Planner which we understand be authorized. We assume that one pos'tion the Board has proposed in sitl^er classi- fication has the tacit approval of the Appropiration Com- mittee based on the amount appropriated under Fxpenses to 9-4-62 W engage part-time contractual services during the current I fiscal year. (2) Attached also are preliminary copies of similar de- scrintions for the position classes of Senior Clerk and Senior Clerk -Stenographer for consiaeration by the Board in the light of existing and contemplated clerical fune- tins considered necessary for the operation of the Plan- ning office and the conduct of the Board's programs. (3) It would be appreciated if these preliminary drafts could be reviewed by the Board and the Director and inthe event changes are proposed we be so advised during the week of September 10th or prior to the n reparation of our re- port to the Board of Selectmen. 3 1
