HomeMy WebLinkAbout1962-04-09PLANNING BOARD MEETING ' April 92 1962 The Lexington Planning Board held a regular meeting in its office, Town Office Building, on Monday, April 9, 1962 at 7:40 n.m. Present were Chairman Grindle, members Bryson, Campbell, Mabee and Meyer, and Planning Director Snow. Approved by the Board were the minutes of its April 2, 1962 meeting. Approved for payment were the following bills which had been submitted: Samuel P. Snow, car allowance for month of March, 1962- P20.00, reim- bursement for U.L.T. technical bulletins, 145.52-- 925.52; M;nute-man Publications, Inc., advertising -- A4.90; Arthur 7. Bryson, Jr., transparenc7--X8.00; Andrew T. Johnson Co. Inc., white prints --18.66. Considered next were the following Form A applications for determination of Planning Board jurisdiction: #62-20, submitted April 6, 1962 by Ernest E. Outhet, Trustee, for Outhet Realty Trust; plan entitled "Compiled Plan of Land in Lexington, Mass.", Scale: 1" = 40', dated April 3, 1962, Miller & Nylander, C.F.'s & Surveyors. #62-21, submitted April 6, 1962 by Pat J. Monsignore for Mary Monsi,gnore; plan entitled "A Subdivision of Land Court Case No.12,100 Land in Lexington, Mass.", Scale: 1" = li0', dated April 5, 1962, Miller & Nylander, C.E.'s & Surveyors. Upon motion duly made and seconded, it was unanimously MINUTES BILLS FORMS A VOTED: that the Lexington Planning Board determines that the -plans accompanying, Form A anplica- tions #62-18 and 462-19 do not require approval under the Subdivision Control Law and that said plans be so endorsed. Mr. Snow gave a report of his view of the study plans which Abbott Engineering Co., consultants ROUTE 2 ' for the State Dent. of Public Works, had made for various accesses to Poute 2. Mr. Snow said that it was his understanding that said department was con- 4-9-62 -2- sidering these studies and would make a recommendation ' in regard to the same within a matter of weeks. It was his understanding also that construction of said accesses and of Route 2 itself was scheduled to take place shortly after July 1, 1962 from Spring Street to a point midway between Pleasant and Watertown Streets. With reference to the proposal that Route 3 ROUTE 3 might be relocated and/or extended so as to pass through Lexington from Butterfield Pond to Route 2 at the Arlington line, Mr. Snow reported that the State Dept.of Public Works was waiting for the final report of the firm of Hayden, Harding and Buchanan, consult- ing engineers to said department. He stated that it was his understanding that the report would be filed with the Department on May 15, and that within a matter of six weeks said department was to hold a pub- lic hearing on the Route 3 study plans. Mr. Snow also stated that as far as he could determine there had been no change in the study plan for this proposed location of Route 3 from that which representatives of the planning Board and the Board of Selectmen had viewed in the offices of said firm in February, 1960. (See minutes of Planning Board meeting of February 8, 1960.) From 8:15 to 9:00 p.m. Town Counsel Stevens ' met with the Board. Mr. Stevens first presented a copy of his BUCKMAN letter of April 9, 1962 to the Town Clerk stating DRIVE that the acquisition by the Town of land for the ex- tension of Buckman Drive to Moreland Avenue had been consummated. (See addendum.) The Board next showed to Mr. Stevens a copy SPFCIAL of a letter, dated April 9, which the Planning Board COUNSEL had addressed to the Board of Selectmen setting forth the Board's need for a Snecial Counsel and suggest- ing teat Mr. Stevens be appointed the same upon his termination of duties as the present Town Counsel. (See addendum.) After Mr. Stevens left the meeting attention CENTER was called to two letters addressed to the Planning PLAYGROUND Board, one dated April 31 1962 from the Board of Selectmen and the second dated April 4, 1962 fro -n the " School Committee. Set forth in the Selectments letter was their requests that the Planning Board prepare a general or master plan for the Center Playground area and that the School and Recreation Committees deter- , mine jointly the number, size and types of areas needed to accommodate their programs at said playground. 4-9-62 In its letter the School Committee indicated its interest in working with the Planning Board and other town agencies in order to evolve a total program which would be in the best interests of the town. (See addenda.! It was decided to dis- cuss the letter of April 3 with the Board of Se- lectmen. From 9:30 to 10:30 p.m. the Planning Board met with the Board of Selectmen relative to the Route 2 and Route 3 studies referred to above. At the conclusion of the conference the Board of Selectmen VOTED: to hire a consultant with the intention of laying out Therson Road from Massachusetts Avenue to Route 2. The Planning Board returned to its office and adjourned its meeting, the time being 10:45 p.m. ' Arthur E. Bryson Clerk ADDENDUM April 9, 1962 James J. I enclose the instruments hereinafter enumerated that pertain to the acquisition by the Town of the land for the extension of Buckman Drive to Moreland Avenue, each of which has been duly recorded in Middlesex South District Registry of Deeds: 1. Order adopted by the Board of Selectmen on November 27, 1961 taking a parcel of land on Moreland Avenue. This was recorded on November 291 1961, Book 9942, Page 136 and the plan referred to t-1,erein was re- corded at the same time as plan No. 1730 of 1961s ' Book 9942, Page 137. 2. Deed dated February 26, 1962 from Pasquale Luongo to 4::gr62 the Town conveying the parcel taken by the release of damages from the taking. Gentlemen: The Planning Board understands that Mr. Stevens does not wish to be reappointed Town Counsel. The Board regrets that he has come to this decision even though it realizes how burdensome the position has become under present circumstances. Mr. Stevens has made an extraordinary contribution. This Board especially appreciates his efforts. In considering the appointment of a new Town Counsel the Planning Board suggests that a Special Counsel be appointed to assist the Board in the legal aspects of zoning and subdivision control, the services of said Special Counsel to be paid for in the form of special fees and to be charged to the Law Department account. As you know, the Planning Board has a great need of assistance in these particular matters. The past sit- uation has not been satisfactory, not because of the personality involved but simply because the Town Counsel has been so overloaded with work that he could not pos- sibly undertake all the zoning and subdivision reguls- tions study and amending the Board would have liked to have considered. It is recommended, therefore, if he will so agree, teat Mr. Stevens be appointed Special Counsel to assist the Planning Board in zoning and sub- division control matters. The changes caused by Worthen Road, the new areas ac- quired and the termination of Park Drive require that a coordinated plan for the whole area be developed which will make the best possible use of the areas available. The School and Recreation Committees have been asked to determine jointly the number, size and types of areas needed to accommodate their programs at the Center Play- ground. The School Committee wants to' Indicate to you its interest in working with vour committee and other Town committees in order to evolve a total program in this area which would be in the best interests of the town.
