HomeMy WebLinkAbout1962-02-12PLA'7NTNG BOAFD MEET TTTG ' February 121, 1962 On Monday, February 12, 1962 at 7:40 p.m. the Lexington Planning Board held a regular meet- ing in its office in the Town Office building, Present were Chairman Soule, members Bryson, Mabee and Meyer and Planning Director Snow. Considered first was the draft of a letter to the Winchester Planning Board with reference to the Murphy nrelim nar7 subdivision plan approved by the Lexin7ton Planning Board at its last meeting. Said draft w^.s a-nroved by the Board and signed by the Chairman (see addendum). Also approved by the Board and signed by the Chairman was the draft of a letter to the Right -of - Way Engineer of the Mass. Dent. of Public Works in regard to said department's proposed additional land taking and road to serve the Trombetta and Foran lots, numbered 246 Cambridge -Concord Highway and 7 Lawn Avenue, respectively (see addendum). ' The attention of the Board was called to a February 7 letter from the chairman of the School Committee and another letter, dated. February Q, from the chairman of the Standing School Building Committee in regard to the Planning Board's memo- randum concerning the C. Henry Jackson property on the Clark Street extension. (See minutes of Janu- ary 20, 1962.) Mr. Soule agreed to make arrange - m ents for a joint meeting of the Board and said com- mittees for the purpose of discussing the possible acquisition of the Jackson land for school and/or recreational nrrposes. The Board approved the minutes of its Jan- uary 20, 196? meeting. Approved for paT-ment were the following bills which had been submitted: Wallace B. Mitchell Co., drafting supplies -46.80; L. M. Foster, Inc., office suppli.es--t5.94; H. M. Gold- berg; plan entitled "plan of Land in Lex- ington, Mass.", Scale: 1 in = 20 ft, dated Feb. 8, 1962, Fred A. Joyce, Surveyor. #62-11, submitted February 12, 1962 by James P. Cassini; plan entitled "Compiled Plan Showing casement Land in Lexington, Mass.tt, Scale: ill = 40', dated February 8, 1962, Miller 2„ Nvlander, C.r.'a & Surveyors. Upon motion duly made, and seconded, it was unanimously VOTED: that the Lexington Planning Board determines that the plan accompanying applications #62-10 and #62-11 do not require approval under the Subdivision Control Law, and that said plan be so endorsed. With _ reference to said subdivision there was presented WYNWOOD a letter from John J. Carroll, Superintendent of ASSOCIATES Public 'nbrks, dated November 15, 1961s stating INC. that the work of the subdivider is 95 percent com- nlete and a supplementary letter from ,,"r. Carroll, dated February 7, 1962, stating that $4j,000 would be satisfactory surety to cover the performance of the remaining work to be done in the subdivision. It was pointed out that the agreement of the sub- divider, Wynwood Associates, Inc., dated October 13, 1960, to perform and complete the required work in the subdivision is secured by the dep6sit with the Town of two savings accounts of 'ldynwood Associates, Inc. in the Lexington Savings Bank, namely: Account No. 41160 with a balance of ksoo0, and account No. 41161 with a balance of $12,000. , Upon consideration thereof, it was unanimously 2-12-62 VOTED: to release as security for the nerformance of the agreement of Wynwood Associates, T_nc., dated October 13, 19601 in reference to the subdivision entitled "-Oak Hill Fs- tates Section Three," the savings account of Wynwood Associates, Inc. in the Lexington Savings Bank No. 41161 and to return the bank book representing said account to Wynwood Associates, Inc. -3- Discussed next with Mr. Stevens was Mr. Harry G. Berglund's written appraisal, dated February 71 1962, of the Mary A. Hennessy nroperty located at the end of Robinson Road. Mr. Stevens was informed that it was the unanimous decision of the Board to recom- mend the acquisition of the 10.02 -acre parcel of said Hennessy land for playground and recreational pur- poses regardless of price. In view of the difference in the arpraisals, however, Mr. Ber land's being 9191508 and Mr. Ernest Giroux of t3 ,853-48, members of the Board sought counsel on how to proceed with negotiations of the acquisition of the narcel it was recommending the town acquire. After the conference with Mr. Stevens it was decided to meet with Mrs. Hennessy and Mr. Wilbur M. Jaquith, her attorney, at ' the next meeting of the Board on February 19 for the purpose of beginning negotiations for said parcel. Mr. Mabee was asked to arrange for such a meeting. After the Town Counsel left the meeting the Board discussed the study plan which Mr. Jack P. Gensemer has prepared as of February 12 for the pro - Dosed CH 1 -CM 1 district situated in the Hartwell Avenue area. Tt was the concensus that it would not be necessary at this time to complete a detailed topographical model of the district in view of the fact that there appeared to be a general agreement in regard to the Planning Board's rezonirg proposal for the area involved. It was also decided that if, after the public hearir a on said proposal, it was found that there was substantial opposition to the pronosal the Board would have the model completed. It was decided in the meantime to ask Mr. Gensemer to make such minor changes in the site plan in accordance with Mr. Snow's suggestions and to pre- pare a final plan for presentation at the public hearing on said proposals to be held on March 8 and for presentation also at the annual town meeting. Mr. Snow was instructed to inform Mr. Gensemer of the Board's decision in regard to a continuation of his services for the purpose of completing said pre- sentation plan. HENNESSY LAND FOR RECREATIONAL PURPOSES STUDY PLAN HARTVELL AVE. AREA 2-12-62 Attenti6.n was called to a letter, dated February 6, 1962, from the Selectmen replying to the Planning Board's letter of January 301 1962 with reference to the granting of an option to the Lexing- ton Golf Club. Dept. of Public ?-Iorks 100 Nashua Street Boston 14, Massachusetts Dear Mr. Dodge: Reference is made to the marked prints which Mr. Naiman Of your department left with Mr. Carroll, Lexington Sunt. of Public Works.. and Mr. Snow, Planning Director. One print is returned herewith. The Lexington Planning Board has reviewed the proposal set forth on said prints to construct a road from Webster Road in this town to Lawn Avenue, a so-called paper street, for the nurnose of nroviding a means of access to the remaining portions of the Trombetta and Foran lots. In regard to this pro- posals the planning Board makes the following observa. tions and comments for your consideration. 1. After the taking of parcels 10-20 and 10-211. t?^e houses on the remaining portions of the Trombetta and Foran lots are non -conforming under the Lexington Zoning B7 -law. 2. In addition, the remaining portions of lot 70 and the Foran lot and the two newly -created Trombetta lots - four in number --have less than the minimum size re- quired under said zoning b7 -law. 3. If the proposed road were constructed under Lexington's subdivision rules and regulations, the Planning Board ' would require the subdivider to construct a permanent turnaround at the end of said road for the reason that 2-12-62 -5- Lawn Avenue as shown on the plan does not exist in fact on the F7round. The Board recommends that the entire Trombetta and Foran lots be taken, the houses sold and moved to another loca- tion. The remainder of said lots not now taken together with the area designated as Lawn Avenue could be added to the adjacent Corazzini land and incorporated into the pronosed lots beinpr created. (A preliminary subdivi- sion plan of said. land was approved by the'Planning Board on March 2P, 1961.) If the Department decides to make the additional taking; and lay out the road as pro- posed, the Dlannina Board believes that the four small lots created would be detrimental to the neighborhood. Tf the recommendations of the Board are carried out, it Is its opinion that there would be not only a general improvement in this area involved but there would be much less cost to the Commonwealth also. Tt is the opinion that the cost of constructing the proposed road. Itself together with the cost of taking the land for said road and the resulting damages to lot 70 on Webster Road and the severing of Trombetta property would be very high.
